Dur<strong>in</strong>g <strong>the</strong> placement period, it is also possible to undertake tra<strong>in</strong><strong>in</strong>g abroad, particularly for <strong>the</strong> elective placement but also<br />

for <strong>the</strong> compulsory placement, with a foreign lawyer for example.<br />

This practical tra<strong>in</strong><strong>in</strong>g is accompanied by study groups <strong>in</strong> which <strong>the</strong> experience accumulated dur<strong>in</strong>g <strong>the</strong> various phases of<br />

tra<strong>in</strong><strong>in</strong>g is critically analysed under <strong>the</strong> supervisi<strong>on</strong> of a State-appo<strong>in</strong>ted judge, lawyer or o<strong>the</strong>r legal expert and preparati<strong>on</strong>s<br />

are made for <strong>the</strong> sec<strong>on</strong>d State exam<strong>in</strong>ati<strong>on</strong>.<br />

II.7.5. Sec<strong>on</strong>d State exam<strong>in</strong>ati<strong>on</strong><br />

The sec<strong>on</strong>d State exam<strong>in</strong>ati<strong>on</strong> also requires written work and oral work. In some Länder <strong>the</strong> written part takes <strong>the</strong> form of a<br />

written assignment (to be submitted with<strong>in</strong> four weeks) and between four and six written exam<strong>in</strong>ati<strong>on</strong>s. In o<strong>the</strong>r Länder it<br />

c<strong>on</strong>sists <strong>on</strong>ly of written exam<strong>in</strong>ati<strong>on</strong>s (between 8 and 11). In most Länder <strong>the</strong> oral exam<strong>in</strong>ati<strong>on</strong> c<strong>on</strong>sists of a case presentati<strong>on</strong><br />

(after a short preparati<strong>on</strong> time) and an assessed discussi<strong>on</strong>.<br />

Both <strong>the</strong> written and oral exam<strong>in</strong>ati<strong>on</strong>s focus <strong>on</strong> <strong>the</strong> resoluti<strong>on</strong> of practical cases. Students might be asked, for example, to<br />

draft judgments.<br />

The exam<strong>in</strong>ati<strong>on</strong> covers all <strong>the</strong> material dealt with throughout <strong>the</strong> entire course.<br />

Aga<strong>in</strong>, <strong>the</strong> grade awarded is based <strong>on</strong> a po<strong>in</strong>t system (see II.7.3). The same assessment scale applies as <strong>in</strong> <strong>the</strong> case of <strong>the</strong> first<br />

State exam<strong>in</strong>ati<strong>on</strong>.<br />

Candidates pass<strong>in</strong>g <strong>the</strong> exam<strong>in</strong>ati<strong>on</strong> are awarded a certificate show<strong>in</strong>g <strong>the</strong> overall result as a grade and a mark <strong>in</strong> figures. The<br />

certificate en- titles <strong>the</strong> holder to use <strong>the</strong> professi<strong>on</strong>al designati<strong>on</strong> ‘Assessor’, and at <strong>the</strong> same time qualifies <strong>the</strong> holder to<br />

exercise <strong>the</strong> legal functi<strong>on</strong>s described at <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g of this secti<strong>on</strong>.<br />

An Assessor may at any time apply to practise as a lawyer.<br />

II.8. Postgraduate studies and degrees<br />

Under specific subject-related c<strong>on</strong>diti<strong>on</strong>s students may take postgraduate courses, supplementary study programmes or<br />

complementary study programmes at most higher educati<strong>on</strong> <strong>in</strong>stituti<strong>on</strong>s after acquisiti<strong>on</strong> of <strong>the</strong> Diplom or Magister or after<br />

pass<strong>in</strong>g <strong>the</strong> first State exam<strong>in</strong>ati<strong>on</strong>. These courses allow students to ga<strong>in</strong> a fur<strong>the</strong>r professi<strong>on</strong>al qualificati<strong>on</strong>, to specialise <strong>in</strong><br />

<strong>on</strong>e area or to pursue fur<strong>the</strong>r studies. There are no uniform regulati<strong>on</strong>s for degree programmes of this k<strong>in</strong>d. They may last<br />

from anyth<strong>in</strong>g between a few weeks or m<strong>on</strong>ths up to several semesters. These courses are c<strong>on</strong>cluded with <strong>the</strong> award of a<br />

certificate or, under certa<strong>in</strong> c<strong>on</strong>diti<strong>on</strong>s, an academic degree (Diplom- or Magisterabschluß).<br />

II.9. Doctoral degree<br />

In order to c<strong>on</strong>t<strong>in</strong>ue studies with <strong>the</strong> aim of ga<strong>in</strong><strong>in</strong>g a doctorate, students must have passed <strong>the</strong> Diplom or Magister<br />

exam<strong>in</strong>ati<strong>on</strong> or <strong>the</strong> first State exam<strong>in</strong>ati<strong>on</strong> with at least a ‘good’ grade. Particular c<strong>on</strong>diti<strong>on</strong>s apply to Fachhochschule<br />

graduates. Except <strong>in</strong> medic<strong>in</strong>e and chemistry, where most students take <strong>the</strong> doctoral exam<strong>in</strong>ati<strong>on</strong> as well as <strong>the</strong> State<br />

exam<strong>in</strong>ati<strong>on</strong> or Diplom exam<strong>in</strong>ati<strong>on</strong>, relatively few German students attempt <strong>the</strong> doctorate after pass<strong>in</strong>g <strong>the</strong>ir f<strong>in</strong>al<br />

exam<strong>in</strong>ati<strong>on</strong>s.
