II.6.3. Licens<strong>in</strong>g<br />

On pass<strong>in</strong>g <strong>the</strong> pharmaceutical degree exam<strong>in</strong>ati<strong>on</strong> a written applicati<strong>on</strong> can be made for licens<strong>in</strong>g as a pharmacist. This<br />

entitles <strong>the</strong> holder to work as a pharmacist and to use <strong>the</strong> professi<strong>on</strong>al designati<strong>on</strong> Apo<strong>the</strong>ker (pharmacist).<br />

II.7. State exam<strong>in</strong>ati<strong>on</strong>s <strong>in</strong> law<br />

Tra<strong>in</strong><strong>in</strong>g for <strong>the</strong> legal professi<strong>on</strong> is carried out <strong>on</strong> <strong>the</strong> basis of Secti<strong>on</strong>s 5 and 6 of <strong>the</strong> German judiciary act (Deutsches<br />

Richtergesetz) which<br />

c<strong>on</strong>ta<strong>in</strong>s <strong>the</strong> basic pr<strong>in</strong>ciples for legal tra<strong>in</strong><strong>in</strong>g. The exact details of <strong>the</strong> tra<strong>in</strong><strong>in</strong>g are set out by <strong>the</strong> Länder <strong>in</strong> <strong>the</strong>ir educati<strong>on</strong>al<br />

requirements<br />

(laws or regulati<strong>on</strong>s).<br />

Legal tra<strong>in</strong><strong>in</strong>g is <strong>in</strong>tended to provide a qualificati<strong>on</strong> entitl<strong>in</strong>g <strong>the</strong> holder to exercise judicial functi<strong>on</strong>s. This qualificati<strong>on</strong> is <strong>the</strong><br />

legally b<strong>in</strong>d<strong>in</strong>g prerequisite for becom<strong>in</strong>g a judge, public prosecutor, lawyer, notary public or legal specialist <strong>in</strong> higher public<br />

adm<strong>in</strong>istrative service. Employers usually demand that legal experts <strong>in</strong> <strong>in</strong>dustry and <strong>in</strong> associati<strong>on</strong>s have also atta<strong>in</strong>ed this<br />

entitlement to exercise judicial functi<strong>on</strong>s.<br />

Apart from <strong>the</strong> qualificati<strong>on</strong> to exercise judicial functi<strong>on</strong>s, no provisi<strong>on</strong> is made for fur<strong>the</strong>r or specialised tra<strong>in</strong><strong>in</strong>g.<br />

II.7.1. Structure and durati<strong>on</strong> of tra<strong>in</strong><strong>in</strong>g<br />

Tra<strong>in</strong><strong>in</strong>g <strong>in</strong> law comprises two stages:<br />

a course of study <strong>in</strong> law at a university, culm<strong>in</strong>at<strong>in</strong>g <strong>in</strong> <strong>the</strong> first State exam<strong>in</strong>ati<strong>on</strong> (Erste Staatsprüfung);<br />

a probati<strong>on</strong>ary period <strong>in</strong> law (Vorbereitungsdienst), culm<strong>in</strong>at<strong>in</strong>g <strong>in</strong> <strong>the</strong> sec<strong>on</strong>d State exam<strong>in</strong>ati<strong>on</strong> (Zweite Staatsprüfung).<br />

Previously, this course of study took <strong>in</strong> practice an average of nearly six years, ra<strong>the</strong>r than <strong>the</strong> three and a half years foreseen<br />

by <strong>the</strong> regulati<strong>on</strong>s. There has been a noticeable reducti<strong>on</strong> <strong>in</strong> <strong>the</strong> average length of time required <strong>in</strong> practice s<strong>in</strong>ce <strong>the</strong> new<br />

regulati<strong>on</strong>s were <strong>in</strong>troduced. Although <strong>the</strong> course of study is not divided <strong>in</strong>to basic studies and advanced studies<br />

(Grundstudium and Hauptstudium), admissi<strong>on</strong> to <strong>the</strong> first exam<strong>in</strong>ati<strong>on</strong> depends up<strong>on</strong> students dem<strong>on</strong>strat<strong>in</strong>g a certa<strong>in</strong><br />

structure <strong>in</strong> <strong>the</strong>ir study programme.<br />

The probati<strong>on</strong>ary period is two years <strong>in</strong> length.
