COURT OF APPEAL<br />

A court for the hear<strong>in</strong>g <strong>of</strong> appeals <strong>in</strong> cases <strong>of</strong><br />

compla<strong>in</strong>ts and protests aga<strong>in</strong>st court rul<strong>in</strong>gs,<br />

decisions <strong>of</strong> courts <strong>of</strong> orig<strong>in</strong>al jurisdiction and<br />

court judgements which have not come <strong>in</strong>to<br />

legal force. For example, if a court rules that<br />

crim<strong>in</strong>al proceed<strong>in</strong>gs be brought aga<strong>in</strong>st an<br />

<strong>of</strong>ficial for significant damage caused to the<br />

environment as a result <strong>of</strong> the pollution, he may<br />

protest that decision, turn<strong>in</strong>g to the higher court<br />

which has the right to confirm or override the<br />

decision <strong>of</strong> the lower court.<br />

COVENANT<br />

Agreement between at least two parties. The<br />

word is used <strong>in</strong> covenant policies <strong>in</strong> which an<br />

agreement between the <strong>in</strong>dustry (as an<br />

organisation) and the government is signed to<br />

reduce emissions or change a process or<br />

sometimes stop operat<strong>in</strong>g completely. The<br />

Dutch system <strong>of</strong> covenants represents (<strong>in</strong><br />

European terms) an unusual hybrid, s<strong>in</strong>ce these<br />

agreements both address collective and sector<br />

wide environmental issues and are legally<br />

b<strong>in</strong>d<strong>in</strong>g on <strong>in</strong>dividual companies through the<br />

permit system, and are thus <strong>in</strong>timately l<strong>in</strong>ked to<br />

ma<strong>in</strong>stream command and control. They form a<br />

key component <strong>of</strong> Dutch environmental policy.<br />

They set str<strong>in</strong>gent quantitative pollution<br />

abatement targets for over 200 substances,<br />

premised on the basis that such targets can only<br />

be reached if <strong>in</strong>dustry accepts a greater share <strong>of</strong><br />

responsibility <strong>in</strong> develop<strong>in</strong>g and implement<strong>in</strong>g<br />

pollution abatement measures. Covenants have<br />

the status <strong>of</strong> contracts <strong>in</strong> civil law. There are two<br />

agreements. The first, a declaration <strong>of</strong> <strong>in</strong>tent, is<br />

signed by the government and a branch (i.e.<br />

<strong>in</strong>dustry) association. This contract has no legal<br />

value, but it serves as a framework for the<br />

second type <strong>of</strong> contract, namely a series <strong>of</strong><br />

agreements between the government and<br />

<strong>in</strong>dividual firms will<strong>in</strong>g to jo<strong>in</strong> the covenant<br />

scheme. These <strong>in</strong>dividual contracts may imply<br />

firms’ liability <strong>in</strong> a civil court. The covenants<br />

are also tightly l<strong>in</strong>ked to the permit system,<br />

which def<strong>in</strong>es detailed emission standards for<br />

each <strong>in</strong>dividual site to be able to operate.<br />

Covenants are l<strong>in</strong>ked to this system, as their<br />

pollution abatement targets are eventually<br />

<strong>in</strong>tegrated <strong>in</strong>to the permit requirements.<br />

Individual monitor<strong>in</strong>g and sanction<strong>in</strong>g <strong>of</strong> firms<br />

<strong>in</strong> the covenant system is executed via the<br />

permit system. Firms whose company<br />

environmental plans (which <strong>in</strong>dicate their
