TRAVAIL AU NOIR ET FRAUDE : APERCUDES MESURES DU GOUVERNEMENT *PARPIERRE-PAUL MAETERChef de Cabinet de Laurette Onkelinx, alors Ministre de l’EmploiDans sa déclaration « La voie vers le XXIème siècle », le Gouvernement a mis l’accentsur la nécessité d’un Etat social actif. Parmi les sept mesures prévues pour augmenterle taux d’activité de manière significative, le Gouvernement avait retenu lalutte contre le travail au noir. Il était notamment prévu de mener la lutte dans le secteurdes services à domicile et les services aux personnes mais il allait de soi quecette lutte devait concerner tous les secteurs d’activités.Le 29 octobre 1999, la Ministre de l’Emploi, Laurette Onkelinx, présentait au Gouvernementune note de politique générale en matière de lutte contre le travail illégalen Belgique. Le Gouvernement a fait sienne cette note et je me propose de garderl’architecture de cette communication gouvernementale comme soutien de monexposé.La stratégie adoptée est globale c’est-à-dire que la Ministre a entendu développerplusieurs initiatives simultanément qui permettent de contrer les deux réalités dutravail non déclaré : la micro économie au noir et l’économie au noir intégrée.La micro économie au noir est la face la plus connue du travail non déclaré, celledes services de proximité rendus entre particuliers ; il peut s’agir aussi de travaildans des petites entreprises. Ce type de fraude se caractérise par ses aspects individuelset peu structurés.L’autre aspect concerne l’économie au noir intégrée qui se déroule au sein mêmedes entreprises et des circuits de distribution, c’est en quelque sorte la formemoderne du travail non déclaré.Tous les secteurs sont concernés, généralement on peut retrouver les caractéristiquessuivantes : ce sont des entreprises de petites tailles, les activités se trouventsoumises à d’importantes fluctuations saisonnières, une utilisation de main d’œuvreabondante est constatée et la concurrence par les coûts y est très sensible.* Cette intervention s’efforce de brosser un tableau des initiatives prises depuis 1999 par MadameOnkelinx, alors Vice-Première Ministre et Ministre de l’Emploi.765
