House Bill 300 – Chair, Judiciary Committee (By Request – <strong>Maryland</strong> Judicial<br />

Conference)<br />

AN ACT concerning<br />

Courts – Violation <strong>of</strong> Condition <strong>of</strong> Probation or Suspension <strong>of</strong><br />

Sentence – Notice or Warrant<br />

FOR the purpose <strong>of</strong> repealing a requirement that the District Court issue a warrant or give<br />

notice <strong>of</strong> a hearing on a violation <strong>of</strong> a condition <strong>of</strong> probation or suspension <strong>of</strong><br />

sentence during the period <strong>of</strong> probation; stating certain powers <strong>of</strong> a circuit court to<br />

end probation at any time, to issue a warrant or notice concerning a violation <strong>of</strong> a<br />

condition <strong>of</strong> probation or suspension <strong>of</strong> sentence, to remand or release a<br />

probationer or defendant, and to revoke probation or suspension <strong>of</strong> sentence and<br />

impose a certain sentence under certain circumstances; requiring the State to<br />

proceed with reasonable promptness and diligence to prosecute a violation <strong>of</strong> a<br />

condition <strong>of</strong> probation or suspension <strong>of</strong> sentence under certain circumstances;<br />

requiring that a certain hearing date be timely; clarifying language; making<br />

stylistic changes; and generally relating to a proceeding in the District Court or<br />

circuit courts for a violation <strong>of</strong> a condition <strong>of</strong> probation or suspension <strong>of</strong> sentence.<br />
