House Bill 364 – Delegate Simmons<br />

AN ACT concerning<br />

Controlled Dangerous Substance Offenses – Subsequent Offender Penalties –<br />

Incarceration in Another Jurisdiction<br />

FOR the purpose <strong>of</strong> providing that the enhanced penalties for a third time <strong>of</strong>fender who<br />

has committed certain controlled dangerous substance <strong>of</strong>fenses apply if the person<br />

serves a term <strong>of</strong> confinement <strong>of</strong> a certain number <strong>of</strong> <strong>days</strong> in a correctional<br />

institution as a result <strong>of</strong> a conviction <strong>of</strong> a crime under the laws <strong>of</strong> another state or<br />

the United States that would be a crime under certain provisions if committed in<br />

this State; and generally relating to subsequent <strong>of</strong>fender penalties.
