Verbindlichkeitsmerkmal nur in
Bezug auf Anleihen als Lieferbares
Verbindlichkeitsmerkmal gilt und nur
maßgeblich ist, falls die Lieferbare
Verbindlichkeitskategorie Anleihen
umfasst; (b) "Übertragbar" als
Lieferbares Verbindlichkeitsmerkmal
bestimmt, so wird dies so ausgelegt,
dass dieses Lieferbare
Verbindlichkeitsmerkmal nur in
Bezug auf andere Lieferbare
Verbindlichkeiten als Darlehen als
gewähltes Lieferbares
Verbindlichkeitsmerkmal gilt (und
nur maßgeblich ist, soweit die
gewählte Lieferbare
Verbindlichkeitskategorie
Verbindlichkeiten außer Darlehen
umfasst); oder (c) "Übertragbares
Darlehen, "Zustimmungspflichtiges
Darlehen" oder "Direkte
Darlehensbeteiligung" als
Lieferbares Verbindlichkeitsmerkmal
bestimmt, so wird dies so ausgelegt,
dass dieses Lieferbare
Verbindlichkeitsmerkmal nur in
Bezug auf Darlehen als Lieferbares
Verbindlichkeitsmerkmal gilt und nur
maßgeblich ist, falls die gewählte
Lieferbare Verbindlichkeitskategorie
Darlehen umfasst.
(iii) Ist "Zahlung", "Aufgenommene
Gelder", "Darlehen oder Anleihe",
oder "Darlehen" als Lieferbare
Verbindlichkeitskategorie bezeichnet
worden und von den Lieferbaren
Verbindlichkeitsmerkmalen
"Übertragbares Darlehen",
"Zustimmungspflichtiges Darlehen"
und "Direkte Darlehensbeteiligung"
mehr als eines bestimmt worden, so
können die Lieferbaren
Verbindlichkeiten Darlehen
beinhalten, die irgendeines der
jeweiligen, aber nicht unbedingt alle
solcher Lieferbarer
Verbindlichkeitsmerkmale erfüllen
und
(iv) Sofern eine Lieferbare
Verbindlichkeit eine Qualifizierte
Garantie ist, gilt Folgendes:
(a) Für die Zwecke der
Anwendung der Lieferbaren
Verbindlichkeitskategorie gilt,
dass die Qualifizierte
Garantie dieselbe Kategorie
bzw. Kategorien erfüllt wie
diejenigen, welche die
Primärverbindlichkeit
beschreiben.

(b) the Deliverable Obligation
Characteristic "Transferable" is
specified hereon, it shall be

Deliverable Obligation
Characteristic had been specified
as a Deliverable Obligation
Characteristic only with respect to
Deliverable Obligations that are not
Loans (and shall only be relevant
to the extent that obligations other
than Loans are covered by the
selected Deliverable Obligation
Category); or (c) any of the
Deliverable Obligation
Characteristics "Assignable Loan",
"Consent Required Loan" or
"Direct Loan Participation" is
specified hereon, it shall be
construed as though such
Deliverable Obligation
Characteristic had been specified
as a Deliverable Obligation
Characteristic only with respect to
Loans and shall only be relevant if
Loans are covered by the selected
Deliverable Obligation Category;
(iii) If any of Payment, Borrowed
Money, Loan or Bond or Loan is
specified as the Deliverable
Obligation Category and more than
one of Assignable Loan, Consent
Required Loan and Direct Loan
Participation are specified as
Deliverable Obligation
Characteristics, the Deliverable
Obligations may include any Loan
that satisfies any one of such
Deliverable Obligation
Characteristics specified and need
not satisfy all such Deliverable
Obligation Characteristics and
(iv) In the event that a Deliverable
Obligation is a Qualifying
Guarantee, the following will apply:
(a) For purposes of the
application of the
Deliverable Obligation
Category, the Qualifying
Guarantee shall be
deemed to satisfy the same
category or categories as
those that describe the
Underlying Obligation.
