Toutefois,je désire, avec votre permission puisqueje suis à la tribune, déclarer que noussommes en faveur de l’élimination dumot “agent” ou “agents” repris dans laproposition de la commission.La délégation suédoise vient de rappelerce qui est mentionné dans laConvention de Varsovie mais je proposeà l’Assemblée d’accorder son attention àce qui est mentionné dans les Règles deLa Haye de 1924 qui sont imprimées à lafin du rapport de la Commission internationaleet j’attire votre attention sur lespages 8 et 9 du texte des Règles de LaHaye où vous remarquerez que ce mêmepoint a été traduit et vous verrez que lesRègles de La Haye sous le n° 2 qui accordedes exonérations, mentionnent enfrançais “des actes, négligence ou défautdu capitaine, marin, pilote ou des préposésdu transporteur...” et en anglais “act,neglect, or default of the master, mariner,pilot, or the servants of the carrier” et “ofthe agents or servants [512] of the carrier”.Cette même traduction est employéedans la Règle 2 (q) au bas despages 8 et 9. Il me semble donc que c’estun amendement valable que nous proposonsaux Règles de La Haye, amendementqui consiste à se conformer aux traductionsdes Règles de La Haye et nonpas à celles de la Convention de Varsoviequi traite d’une autre question. Je soumetscela à votre réflexion.Messieurs, la question de fond poséepar la Délégation canadienne en est unequi a déjà été discutée et qui concerne leprincipe de savoir si un sous-traitant indépendantou si les sous-traitants indépendantssont couverts. I would like,however, if I may - as I am on my feet - tosay why we advocate the elimination ofthe word “agent” or “agents” from theproposal that has come from the Sub-Committee.We have just heard from the SwedishDelegation of what appears in the WarsawConvention but I suggest to the Assemblythat we should pay some attentionto what appears in the Hague Rulesof 1924 which are printed at the back ofthe Report of the International Sub-Committee and I direct your attentionthere to pages 8 and 9 of the text of theHague Rules where you will find thisvery matter dealt with in translation andyou will see that in the version of theHague Rules giving the exemptions under(2), you have “des actes, négligenceou défaut du capitaine, marin, pilote oudes préposés du transporteur...” in theFrench version and in the English versionyou have: “Act, neglect, or defaultof the master, mariner, pilot, or the servantsof the carrier” and “of the agents orservants [512] of the carrier”. It seemsto me a strong proposition that we areputting forward that the amendments tothe Hague Rules and the translations inthem should conform to the HagueRules rather than to the Warsaw Conventionon another matter and I leavethat with you for your consideration.Now, Gentlemen, the point of substancethat concerns the Canadian delegationis the one that has already beendiscussed and that is whether independentcontractors are covered. It was
