Le transporteur, sous réservedes dispositions de l’article 4, procéderade façon appropriée et soigneuse au chargement,à la manutention, à l’arrimage, autransport, à la garde, aux soins et au déchargementdes marchandises transportées.3. Après avoir reçu et pris encharge les marchandises, le transporteurou le capitaine ou agent du transporteurdevra, sur demande du chargeur, délivrerau chargeur un connaissement portantentre autres choses:a) Les marques principales nécessairesà l’identification des marchandisestelles qu’elles sont fournies par écrit par lechargeur avant que le chargement de cesmarchandises ne commence pourvu queces marques soient imprimées ou apposéesclairement de toute autre façon surles marchandises non emballées ou sur lescaisses ou emballages dans lesquels lesmarchandises sont contenues, de telle sortequ’elles devraient normalement resterlisible jusqu’à la fin du voyage;b) Ou le nombre de colis, ou depièces, ou la quantité ou le poids, suivantles cas, tels qu’ils sont fournis par écrit parle chargeur;c) L’état et le conditionnement apparentdes marchandises.Cependant aucun transporteur, capitaineou agent du transporteur ne sera tenude déclarer ou de mentionner dans leconnaissement des marques, un nombre,une quantité ou un poids, dont il a une raisonsérieuse de soupçonner qu’ils ne représententpas exactement les marchandisesactuellement reçues par lui, ou qu’il n’a pasArticle 3.1. The carrier shall be bound beforeand at the beginning of the voyage to exercisedue diligence to:a) Make the ship seaworthy.b) Properly man, equip and supplythe ship.c) Make the holds, refrigerating andcool chambers, and all other parts of theship in which goods are carried, fit andsafe for their reception, carriage andpreservation.2. Subject to the provisions of Article 4,the carrier shall properly and carefullyload, handle, stow, carry, keep, care for,and discharge the goods carried.3. After receiving the goods into hischarge the carrier or the master or agentof the carrier shall, on demand of theshipper, issue to the shipper a bill of ladingshowing among other things:a) the leading marks necessary foridentification of the goods as the sameare furnished in writing by the shipperbefore the loading of such goods starts,provided such marks are stamped or otherwiseshown clearly upon the goods ifuncovered, or on the cases or coveringsin which such goods are contained, insuch a manner as should ordinarily remainlegible until the end of the voyage.b) Either the number of packages orpieces, or the quantity, or weight, as thecase may be, as furnished in writing bythe shipper.c) The apparent order and conditionof the goods.Provided that no carrier, master oragent of the carrier shall be bound tostate or show in the bill of lading anymarks, number, quantity, or weightwhich he has reasonable ground for suspectingnot accurately to represent thegoods actually received, or which he hashad no reasonable means of checking.4. Such a bill of lading shall be prima facieevidence of the receipt by the carrierof the goods as therein described in accordancewith paragraph 3 (a), (b) and(c).5. The shipper shall be deemed to haveguaranteed to the carrier the accuracy at
