862 COMITE MARITIME INTERNATIONALThe Travaux Préparatoires of the Hague and Hague-Visby Rulesà la garde, aux soins et au déchargementdes dites marchandises, soumis aux responsabilitéset obligations, comme il bénéficierades droits et exonérations cidessousénoncés.Article 3.1. Le transporteur sera tenu avant et audébut du voyage d’exercer une diligenceraisonnable pour:a) Mettre le navire en état de navigabilité.b) Convenablement armer, équiperet approvisionner le navire.c) Approprier et mettre en bon étatles cales, chambres froides et frigorifiqueset toutes autres parties du navireoù des marchandises sont chargées pourleur réception, transport et conservation.2. Le transporteur, sous réserve des dispositionsde l’article 4, procédera de façonappropriée et soigneuse au chargement,à la manutention, à l’arrimage, autransport, à la garde, aux soins et au déchargementdes marchandises transportées.3. Après avoir reçu et pris en charge lesmarchandises, le transporteur ou le capitaineou agent du transporteur devra, surdemande du chargeur, délivrer au chargeur,un connaissement portant entreautres choses:a) Les marques principales nécessairesà l’identification des marchandisestelles qu’elles sont fournies par écrit parle chargeur avant que le chargement deces marchandises ne commence pourvuque ces marques soient imprimées ou apposéesclairement de toute autre façonsur les marchandises non emballées ousur les caisses ou emballages dans lesquellesles marchandises sont contenues,de telle sorte qu’elles devraient normalementrester lisibles jusqu’à la fin du voyage.b) Ou le nombre de colis, ou depièces, ou la quantité ou le poids, suivantles cas, tels qu’ils sont fournis par écritpar le chargeur.c) L’état et le conditionnement apparentdes marchandises.Cependant aucun transporteur, capibesubject to the responsibilities and liabilities,and entitled to the rights andimmunities hereinafter set forth.Article 3.1. The carrier shall be bound beforeand at the beginning of the voyage to exercisedue diligence to:a) Make the ship seaworthy.b) Properly man, equip and supplythe ship.c) Make the holds, refrigerating andcool chambers, and all other parts of theship in which goods are carried, fit andsafe for their reception, carriage andpreservation.2. Subject to the provisions of Article 4,the carrier shall properly and carefullyload, handle, stow, carry, keep, care for,and discharge the goods carried.3. After receiving the goods into hischarge the carrier or the master or agentof the carrier shall, on demand of theshipper, issue to the shipper a bill of ladingshowing among other things:a) the leading marks necessary foridentification of the goods as the sameare furnished in writing by the shipperbefore the loading of such goods starts,provided such marks are stamped orotherwise shown clearly upon the goodsif uncovered, or on the cases or coveringsin which such goods are contained, insuch a manner as should ordinarily remainlegible until the end of the voyage.b) Either the number of packages orpieces, or the quantity, or weight, as thecase may be, as furnished in writing bythe shipper.c) The apparent order and conditionsof the goods.Provided that no carrier, master oragent of the carrier shall be bound tostate or show in the bill of lading anymarks, number, quantity, or weightwhich he has reasonable ground for sus-
