Je pense que pouréviter toute ambiguité et pour que l’onne puisse croire que l’article 15 visé estcelui du Protocole, il conviendrait, dansle texte français, d’ajouter après les mots“en vertu de l’article 15”, les termes “decelle-ci” de façon qu’il n’y ait aucun doutesur le fait que l’on ne vise pas le Protocolequi contient lui aussi des clausesde dénonciation, mais que l’on vise bienla Convention originelle.Ma deuxième remarque est pour exprimerun regret. Je crois savoir qu’à unmoment donné, dans les travaux dugroupe de travail, figurait un projet d’article7 qui a disparu dans le texte définitifet qui précisait que lorsqu’on parlaitdes Etats contractants, on parlait desEtats contractants au Protocole.[137]Ce texte a disparu. Je pense qu’il étaitutile et j’estime que le Président du groupede travail devrait peut-être nous direpourquoi, en définitive, ce texte qui précisaitun point sur lequel peut subsisterune certaine ambiguité, a disparu. Jeprésente les excuses de la commissionpour avoir oublié cette correction.En ce qui concerne l’autre observation,il s’agit d’une proposition du déléguédu Royaume-Uni disant que, sauflorsque le contexte indique clairement lecontraire, toute référence dans le présentProtocole à la Convention et à l’Etatcontractant sera respectivement considéréecomme référence à la Convention telpointof view, concerns the French textof article 7 of the draft. This article 7refers to article 15 of the original Convention.I think, to avoid any ambiguityand so that we will not think that the article15 we refer to is the one of the Protocol,we should, in the French text, addafter the words “en vertu de l’article 15”(“in accordance with article 15”), thewords “de celle-ci” (“thereof”) so thatthere will be no doubt that we are not referringto the Protocol which also includesdenunciation clauses, but that weare rather referring to the original Convention.My second remark is to express a regret.It is my understanding that, at onetime during the work of the Committee,there was a draft of article 7 that has disappearedfrom the final text. This draftspecified that when we speak of contractingStates, we mean the contractingStates to the Protocol.[137]This text has disappeared. I thinkthat it was useful and I feel that the chairmanof the working group should maybetell us why this happened.
