Alderman McCarthy <strong>of</strong>fered the following draft <strong>of</strong><br />

ORDINANCE No.<br />

AN ORDINANCE AMENDING CHAPTER XXXVI AND AMEND-<br />

MENTS THERETO,, REVISED ORDINANCES OF 1929. BY<br />

SUBSTITUTING IN PLACED THEREQH THE FOLLOWING NEW<br />

CHAPTER XXXVI," RELATIVE TO HACKNEY CARRIAGES,<br />

HACKNEY STANDS AND HACKNEY DRIVERS. -<br />

Be it ordained by the Board <strong>of</strong> Aldermen <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Somerville</strong>,<br />

as follows:<br />

SECTION 1. Except as otherwise provided in chapter two hundred and<br />

sixty-three <strong>of</strong> the Acts <strong>of</strong> nineteen hundred and twenty-nine, the Chief <strong>of</strong><br />

Police <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Somerville</strong> shall have exclusive authority to make<br />

rules and orders for the regulation <strong>of</strong> hackney carriages and hackney<br />

stands, both as defined in section two, within the limits <strong>of</strong> said city, with<br />

penalties for the violation there<strong>of</strong> not exceeding twenty dollars for each<br />

<strong>of</strong>fence. Such rules and orders shall not take effect until they have been<br />

published at least once in a newspaper published in said city.<br />

SECTION 2. Each vehicle used or designed to be used for the conveyance<br />

<strong>of</strong> persons for hire from place to place within the <strong>City</strong> <strong>of</strong> <strong>Somerville</strong>,<br />

except a street or elevated railway car or a trackless trolley<br />

vehicle, within the meaning <strong>of</strong> section two <strong>of</strong> chapter one hundred and<br />

sixty-three <strong>of</strong> the General Laws, or a motor vehicle, known as a jitney,<br />

operated in the manner and for the purposes set forth in chapter one<br />

hundred and fifty-nine A <strong>of</strong> the General Laws, or a sight-seeing automobile<br />

licensed under chapter three hundred and ninety-nine <strong>of</strong> the acts <strong>of</strong> nineteen<br />

hundred and thirty-one, shall be deemed to be a hackney carriage<br />

within the meaning <strong>of</strong> sections two to sure, inclusive, <strong>of</strong> this ordinance;<br />

and in said sections, unless the context otherwise expressly requires, the<br />

words "drive" and "driver" shall be respectively deemed to include<br />

"operate" and "operator" and a private hackney stand shall be one<br />

established only upon private property, for hackney carriage purposes,<br />

<strong>of</strong> all licensees under section four.<br />
