DRIVER SHALL SEARCH CARRIAGE AFTER
DELIVERING PASSENGER.
SECTION 30. Licensed drivers shall immediately after delivering any
passenger search hackney carriage for any property which may have been
left therein, and any property found therein shall be immediately delivered
by the finder thereof to the Office of Inspector of Carriages or any police
officer, the driver taking a receipt therefor, and the Inspector of Carriages
shall -within twenty-four hours deliver the property to the Property Clerk
of the Police Department.
SOLICITING OF PASSENGERS.
SECTION 31. No person having charge of a hackney carriage while in a
public way or place, shall solicit passengers. If such carriage is rightfully
standing upon a hackney stand, the person in charge thereof may solicit
passengers by motion of the hand. No Hackney Carriage not licensed by the
City of Somerville may solicit passengers within the confines of the city.
OCCUPANCY OF DRIVER'S SEAT.
SECTION 32. No person in charge of a hackney carriage, known as a
taxicab, shall allow any one to ride upon the driver's seat, or adjacent to the
driver's seat, of the same.
In the event that the rear compartment of a taxicab is fully occupied
by passengers, all of whom have entered the vehicle at the same time, and
there then exists need of seating one more male person of such group which
has engaged the taxicab, such latter male person may ride upon the driver's
seat or adjacent to the driver's seat of the taxicab.
SMOKING BY DRIVERS.
SECTION 33. Drivers of hackney carriages shall not smoke cigars,
cigarettes or pipes while transporting passengers.
PASSENGERS WITH INFECTIOUS DISEASES; DEAD BODIES.
SECTION 34. No driver having charge of any hackney carriage shall
receive or permit to be placed therein, nor convey in or upon the same, any
persons infected with any contagious disease. No driver of a licensed carriage,
designated as a taxicab, shall accept for transportation any body of
a deceased person. Whenever a death occurs in a hackney carriage the
driver without disturbing the body must drive immediately to the police
station and notify the officer in charge.
TAGGING BY POLICE OFFICERS.
SECTION 35. Police officers shall, whenever there has been a violation
of any hackney carriage regulation or any law or ordinance, give to the
driver a tag with instructions to report to the Inspector of Carriages in
accordance with instructions on tag. The part of the tag that is returned
to the station by the officer is to be given to the Inspector of Carriages
before 10 A.M. of the following day. The Inspector of Carriages shall have
the authority to strip a driver of his credentials consisting of badge and
driver's license card, if in the judgment of the Inspector of Carriages, there
has been a violation to warrant such action.
On penalty imposed by the Inspector of Carriages upon a driver for
unlawfully operating for hire in such a manner as to afford a means of
transportation similar to that afforded by a railway company, notice in
writing of such action shall be sent to the owner of the hackney carriage,
which notice shall include proper identification of the hackney carriage and
driver involved.
In all arrests of a licensed driver, the officer in charge of the station
shall strip the driver of his credentials. In all cases of stripped credentials,
the Commanding Officer of the Station shall forward the same within
twenty-four hours to the Inspector of Carriages with report of all facts
connected with the arrest.
TAXICAB.
SECTION 36. The taxicab shall have affixed thereto, upon the partition
dividing the driver's and passengers' seats, a taximeter of the size and
design approved by the Chief of Police.
No taxicab shall be licensed as a hackney carriage until the taximeter
attached thereto shall have been officially approved. After sundown the
face of every taximeter shall be illuminated by a suitable light, so arranged
as to throw a continuous steady light thereon. Upon order of the Chief of
Police a licensee shall have his taximeter reinspected.
If in a calendar year, more than three penalties are imposed by the
Inspector of Carriages upon a driver or drivers of a particular taxicab for
unlawfully operating for hire in such a manner as to afford means of
transportation similar to that afforded by a railway company, the Inspector
of Carriages shall have the authority to strip such taxicab of its hackney
carriage medallion, and to suspend the hackney carriage license of such
vehicle for a period not exceeding ten days.
