DRIVER SHALL SEARCH CARRIAGE AFTER<br />

DELIVERING PASSENGER.<br />

SECTION 30. Licensed drivers shall immediately after delivering any<br />

passenger search hackney carriage for any property which may have been<br />

left therein, and any property found therein shall be immediately delivered<br />

by the finder there<strong>of</strong> to the Office <strong>of</strong> Inspector <strong>of</strong> Carriages or any police<br />

<strong>of</strong>ficer, the driver taking a receipt therefor, and the Inspector <strong>of</strong> Carriages<br />

shall -within twenty-four hours deliver the property to the Property Clerk<br />

<strong>of</strong> the Police Department.<br />

SOLICITING OF PASSENGERS.<br />

SECTION 31. No person having charge <strong>of</strong> a hackney carriage while in a<br />

public way or place, shall solicit passengers. If such carriage is rightfully<br />

standing upon a hackney stand, the person in charge there<strong>of</strong> may solicit<br />

passengers by motion <strong>of</strong> the hand. No Hackney Carriage not licensed by the<br />

<strong>City</strong> <strong>of</strong> <strong>Somerville</strong> may solicit passengers within the confines <strong>of</strong> the city.<br />

OCCUPANCY OF DRIVER'S SEAT.<br />

SECTION 32. No person in charge <strong>of</strong> a hackney carriage, known as a<br />

taxicab, shall allow any one to ride upon the driver's seat, or adjacent to the<br />

driver's seat, <strong>of</strong> the same.<br />

In the event that the rear compartment <strong>of</strong> a taxicab is fully occupied<br />

by passengers, all <strong>of</strong> whom have entered the vehicle at the same time, and<br />

there then exists need <strong>of</strong> seating one more male person <strong>of</strong> such group which<br />

has engaged the taxicab, such latter male person may ride upon the driver's<br />

seat or adjacent to the driver's seat <strong>of</strong> the taxicab.<br />

SMOKING BY DRIVERS.<br />

SECTION 33. Drivers <strong>of</strong> hackney carriages shall not smoke cigars,<br />

cigarettes or pipes while transporting passengers.<br />

PASSENGERS WITH INFECTIOUS DISEASES; DEAD BODIES.<br />

SECTION 34. No driver having charge <strong>of</strong> any hackney carriage shall<br />

receive or permit to be placed therein, nor convey in or upon the same, any<br />

persons infected with any contagious disease. No driver <strong>of</strong> a licensed carriage,<br />

designated as a taxicab, shall accept for transportation any body <strong>of</strong><br />

a deceased person. Whenever a death occurs in a hackney carriage the<br />

driver without disturbing the body must drive immediately to the police<br />

station and notify the <strong>of</strong>ficer in charge.<br />

TAGGING BY POLICE OFFICERS.<br />

SECTION 35. Police <strong>of</strong>ficers shall, whenever there has been a violation<br />

<strong>of</strong> any hackney carriage regulation or any law or ordinance, give to the<br />

driver a tag with instructions to report to the Inspector <strong>of</strong> Carriages in<br />

accordance with instructions on tag. The part <strong>of</strong> the tag that is returned<br />

to the station by the <strong>of</strong>ficer is to be given to the Inspector <strong>of</strong> Carriages<br />

before 10 A.M. <strong>of</strong> the following day. The Inspector <strong>of</strong> Carriages shall have<br />

the authority to strip a driver <strong>of</strong> his credentials consisting <strong>of</strong> badge and<br />

driver's license card, if in the judgment <strong>of</strong> the Inspector <strong>of</strong> Carriages, there<br />

has been a violation to warrant such action.<br />

On penalty imposed by the Inspector <strong>of</strong> Carriages upon a driver for<br />

unlawfully operating for hire in such a manner as to afford a means <strong>of</strong><br />

transportation similar to that afforded by a railway company, notice in<br />

writing <strong>of</strong> such action shall be sent to the owner <strong>of</strong> the hackney carriage,<br />

which notice shall include proper identification <strong>of</strong> the hackney carriage and<br />

driver involved.<br />

In all arrests <strong>of</strong> a licensed driver, the <strong>of</strong>ficer in charge <strong>of</strong> the station<br />

shall strip the driver <strong>of</strong> his credentials. In all cases <strong>of</strong> stripped credentials,<br />

the Commanding Officer <strong>of</strong> the Station shall forward the same within<br />

twenty-four hours to the Inspector <strong>of</strong> Carriages with report <strong>of</strong> all facts<br />

connected with the arrest.<br />

TAXICAB.<br />

SECTION 36. The taxicab shall have affixed thereto, upon the partition<br />

dividing the driver's and passengers' seats, a taximeter <strong>of</strong> the size and<br />

design approved by the Chief <strong>of</strong> Police.<br />

No taxicab shall be licensed as a hackney carriage until the taximeter<br />

attached thereto shall have been <strong>of</strong>ficially approved. After sundown the<br />

face <strong>of</strong> every taximeter shall be illuminated by a suitable light, so arranged<br />

as to throw a continuous steady light thereon. Upon order <strong>of</strong> the Chief <strong>of</strong><br />

Police a licensee shall have his taximeter reinspected.<br />

If in a calendar year, more than three penalties are imposed by the<br />

Inspector <strong>of</strong> Carriages upon a driver or drivers <strong>of</strong> a particular taxicab for<br />

unlawfully operating for hire in such a manner as to afford means <strong>of</strong><br />

transportation similar to that afforded by a railway company, the Inspector<br />

<strong>of</strong> Carriages shall have the authority to strip such taxicab <strong>of</strong> its hackney<br />

carriage medallion, and to suspend the hackney carriage license <strong>of</strong> such<br />

vehicle for a period not exceeding ten days.<br />
