AN ORDINANCE AMENDING CHAPTER XXXVI AND AMENDMENTS<br />

^HERETO, OR REVISED ORDINANCES OF 1929, BY SUBSTJL.<br />

TOTING IN PLACE THEROF THE FOLLOWING NEW CHAP-<br />

TER, XXXVI, RELATIVE TO HACKNEY CARRIAGES, HACKNEY<br />

STANDS AND HACKNEY DRIVERS. *<br />

Be it ordained by the Board <strong>of</strong> Aldermen <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Somerville</strong>, as<br />

follows:<br />

SECTION 1. Every vehicle used or to be used for the conveyance <strong>of</strong><br />

persons for hire from place to place, within the <strong>City</strong> <strong>of</strong> <strong>Somerville</strong>, shall<br />

be deemed to be a hackney carriage within the meaning <strong>of</strong> this ordinance<br />

except a street railway car or a trackless trolley vehicle within the meaning<br />

<strong>of</strong> General Laws, Chapter 163, Section 2, or a motor vehicle, commonly<br />

known as a jitney, operated in a manner and for the purposes<br />

stated in General Laws, Chapter 159, Section 45, or a sightseeing automobile,<br />

as defined in Statutes <strong>of</strong> 1913, Chapter 592, Section 1.<br />

SECTION 2. No person shall drive or have charge <strong>of</strong> a hackney<br />

carriage, nor shall any person or corporation set up and use a hackney<br />

carriage unless licensed thereto, by the Board <strong>of</strong> Aldermen.<br />

No owner or person having the care or ordering <strong>of</strong> a hackney carriage<br />

shall suffer or allow any person other than a driver licensed by<br />

the Board <strong>of</strong> Aldermen to drive such- carriage, subject to the provisions<br />

<strong>of</strong> Section 26, in the hire <strong>of</strong> said vehicle.<br />

SECTION 3. Any person, firm or corporation violating any <strong>of</strong> the<br />

provisions <strong>of</strong> this ordinance shall forfeit and pay a fine not exceeding<br />

twenty dollars for each <strong>of</strong>fence; and any <strong>of</strong> the provisions <strong>of</strong> this ordinance<br />

shall, in addition to said penalty, thereupon become liable to forfeit<br />

his license_and be disqualified to hold a license thereafter.<br />

SECTION 4. The Board <strong>of</strong> Aldermen may grant licenses to suitable<br />

persons, who are owners <strong>of</strong> such vehicles, to set up and use them<br />

as hackney carriages, and all persons who are qualified as drivers,<br />

and in other respects, to drive and have charge <strong>of</strong> hackney carriages.<br />

Said licenses to be issued by the Inspector <strong>of</strong> Carriages.<br />

Such licenses will be given subject to such terms, conditions and<br />

regulations, and upon the payment <strong>of</strong> such fees, as the Board <strong>of</strong> Aldermen<br />

shall, from time to time, prescribe in general orders or otherwise.<br />

SECTION 5. New applications for licenses and for permits for special<br />

stands may be filed with the Board <strong>of</strong> Aldermen at any time, but applications<br />

for the renewal <strong>of</strong> licenses and permits already in force shall be<br />

filed annually in April. They shall be made on <strong>of</strong>ficial forms provided by<br />

the Board and shall contain all the information therein required. All<br />

licenses and permits shall become void on the first day <strong>of</strong> May annually,<br />

except as are granted in April as valid for the year beginning on the next<br />

succeeding first day <strong>of</strong> May.<br />

SECTION 6. No person shall be licensed to be a driver or an owner <strong>of</strong><br />

a public hackney carriage unless he can read, write and speak the English<br />

language intelligently.<br />

SECTION 7. Hackney Carriages shall be registered at the place at<br />

which they are kept in <strong>Somerville</strong>, and in no case at the stands, public or<br />

special, for which provision is made in Section 3 <strong>of</strong> this ordinance.<br />
