<strong>City</strong> <strong>of</strong> <strong>Somerville</strong> 74837<br />

I respectfully request the_<br />

approval <strong>of</strong> your Honorable Board to the appropriation <strong>of</strong><br />

Three Hundred~~and Fifty dollars ($350.00) for the purchas.e<br />

°£__ a _PJi QC - e <strong>of</strong> l an< * owned by Carmela Cedrone on Ten Hills<br />

Road.<br />

The <strong>City</strong> <strong>of</strong> <strong>Somerville</strong>, about five years ago, constructed<br />

a wooden flight <strong>of</strong> steps on land adjoining 69 and<br />

71 Ten Hills Road, owned by Carmela Cedrone, without any<br />

legal authority* These steps were constructed as a result<br />

<strong>of</strong> petitions and requests by people in that vicinity so<br />

that they could get to the bus stop on the Fellsway.<br />

The <strong>City</strong> <strong>of</strong> <strong>Somerville</strong> has received noticea from<br />

the owner, <strong>of</strong> the latter's intention to close the steps so<br />

as to prevent the <strong>City</strong> <strong>of</strong> <strong>Somerville</strong> or any persons<br />

acquiring the rights by prescription over a period <strong>of</strong><br />

twenty years. These steps are in constant use by many every<br />

day and serve as a great convenience to the people in that<br />

vicinity* It would be inadvisable to close these steps and<br />

if the <strong>City</strong> were to remove these steps and construct new<br />

steps in another location, the cost would be very high.<br />

After investigation <strong>of</strong> the matter and many discussions<br />

with the owner, the <strong>City</strong> Engineer and <strong>City</strong> Solicitor,<br />

etc., I believe It is for the best interest <strong>of</strong> the <strong>City</strong> <strong>of</strong><br />

<strong>Somerville</strong> to purchase this particular parcel <strong>of</strong> land on<br />

which the steps are located, for the sum <strong>of</strong> Three Hundred<br />

and Fifty dollars ($350.00).<br />

Therefore, I respectfully request that your<br />

Honorable Board will take prompt action so that the people<br />

in the Ten Hills section will.be allowed to continue using<br />

the steps.<br />

The oumer <strong>of</strong> the property is very much interested<br />

In getting this matter settled as soon as possible because<br />

so long as the steps are on the latter's land, there might<br />

be a question <strong>of</strong> recovery by one injured using the steps<br />

and suing the owner <strong>of</strong> the land.<br />
