SECTION 3. In said city, no person shall drive or have charge <strong>of</strong> a<br />

hackney carriage, nor shall (any person, firm or corporation set up and<br />

use a hackney carriage unless licensed thereto by the Chief <strong>of</strong> Police <strong>of</strong><br />

<strong>Somerville</strong>, nor shall any person having care or ordering <strong>of</strong> such a<br />

vehicle in said city suffer or allow any person other than a driver so<br />

licensed to drive such vehicle.<br />

SECTION 4. Said Chief <strong>of</strong> Police annually shall grant hackney<br />

licenses in said city to suitable persons, firms and corporations who are<br />

owners <strong>of</strong> vehicles known as hackney carriages, if such persons, or one<br />

member <strong>of</strong> such firm, resides in such city, or if the principal place <strong>of</strong><br />

such corporation is in such city; provided, that, at any time within one<br />

year after expiration <strong>of</strong> a license under this section, the holder there<strong>of</strong><br />

shall be entitled as <strong>of</strong> right, upon payment <strong>of</strong> the proper fee, to a<br />

renewal <strong>of</strong> such license, unless after a hearing before said Chief <strong>of</strong><br />

Police, it appears that he has good cause to refuse to issue the same.<br />

Licenses granted under this section shall be assignable subject to the<br />

approval <strong>of</strong> said Chief <strong>of</strong> Police and shall be subject to such other<br />

terms, conditions and limitations, and be issued subject to the payment<br />

<strong>of</strong> such fees, as said Chief <strong>of</strong> Police shall from time to time<br />

prescribe. Said Chief <strong>of</strong> Police shall also from time to time fix maximum<br />

and minimum rates to be charged by said licensees for use <strong>of</strong> such<br />

vehicles. Said Chief <strong>of</strong> Police shall, as soon as may be, fix a limit for<br />

the number <strong>of</strong> licenses to be issued under this section, which limit .shall<br />

be based upon the number <strong>of</strong> licenses then issued and outstanding, and<br />

he may from time to time, after reasonable notice and a hearing, decrease<br />

the limit so fixed.<br />

SECTION 5. Any person, firm or corporation licensed under section<br />

four may occupy as a private hackney stand, subject to general provisions<br />

<strong>of</strong> law, private property in said city, if thereto authorized by the owner,<br />

lessee or <strong>of</strong>ficial representative there<strong>of</strong>.<br />

SECTION 6. Said police chief shall, from time to time, designate certain<br />

portions, other than sidewalks, <strong>of</strong> public ways in said city, to be used<br />

and known as private hackney stands. Such stands shall be used by vehicles<br />

whose owners are licensed^nder section four, and who have complied with<br />

all provisions <strong>of</strong> sections IS. to Ns, inclusive, <strong>of</strong> this ordinance, relative to<br />

such stands, and with all rules and regulations <strong>of</strong> said Chief <strong>of</strong> Police<br />

relative thereto. Within that portion <strong>of</strong> the city proper, as denned in the<br />

present rules and regulations <strong>of</strong> the police department <strong>of</strong> said city relative<br />

to hackney carriages, said Chief <strong>of</strong> Police shall, so far as practicable,<br />

establish such stands at intervals <strong>of</strong> not more than one quarter <strong>of</strong> a mile.<br />

All such stands shall be plainly marked as private hackney stands. No<br />

motor vehicle other than a licensed hackney carriage shall make use <strong>of</strong> any<br />

such private stand. Said Chief <strong>of</strong> Police shall, upon application for a<br />

private hackney stand by an applicant for a license under section four,<br />

issue to such applicant for each hackney carriage for which a license under<br />

said section four is granted, a license for said carriage to use the private<br />

hackney stand.<br />

fee^ SECTION 7. All rules and parts <strong>of</strong> rules inconsistent with section KJ i<br />

to eighteen, inclusive, <strong>of</strong> this ordinance, are hereby repealed, and all rules<br />

and regulations <strong>of</strong> the Chief <strong>of</strong> Police <strong>of</strong> <strong>Somerville</strong> inconsistent with said<br />

sections are hereby made null and void.<br />

SECTION 8. Notwithstanding the provisions <strong>of</strong> this ordinance, all<br />

licenses otherwise affected thereby which are in effect on its effective date<br />

shall continue in force until the expiration date <strong>of</strong> such licenses, unless<br />

sooner revoked in accordance with law.<br />

SECTION 9. Whenever in these regulations the following terms are<br />

used, they shall have the meanings respectively ascribed to them in this<br />

section:<br />

INSPECTOR OF CARRIAGES.—A superior <strong>of</strong>ficer <strong>of</strong> the Traffic Division assigned<br />

in that capacity.<br />

APPEAL BOARD.—A Board consisting <strong>of</strong> three superior <strong>of</strong>ficers designated<br />

by the Chief <strong>of</strong> Police.<br />

TAXICAB.—A motor vehicle licensed as a hackney carriage on which a taximeter<br />

is affixed.<br />

TAXIMETER.—A mechanical instrument or device by which the charge for<br />

hire is mechanically calculated either for distance travelled, or for<br />

waiting time, or for both, and upon which such charge shall be indicated<br />

by means <strong>of</strong> figures.<br />

PUBLIC AUTOMOBILE.—A hackney carriage used for livery purposes without<br />

a taximeter.<br />
