SECTION 3. In said city, no person shall drive or have charge of a hackney carriage, nor shall (any person, firm or corporation set up and use a hackney carriage unless licensed thereto by the Chief of Police of Somerville, nor shall any person having care or ordering of such a vehicle in said city suffer or allow any person other than a driver so licensed to drive such vehicle. SECTION 4. Said Chief of Police annually shall grant hackney licenses in said city to suitable persons, firms and corporations who are owners of vehicles known as hackney carriages, if such persons, or one member of such firm, resides in such city, or if the principal place of such corporation is in such city; provided, that, at any time within one year after expiration of a license under this section, the holder thereof shall be entitled as of right, upon payment of the proper fee, to a renewal of such license, unless after a hearing before said Chief of Police, it appears that he has good cause to refuse to issue the same. Licenses granted under this section shall be assignable subject to the approval of said Chief of Police and shall be subject to such other terms, conditions and limitations, and be issued subject to the payment of such fees, as said Chief of Police shall from time to time prescribe. Said Chief of Police shall also from time to time fix maximum and minimum rates to be charged by said licensees for use of such vehicles. Said Chief of Police shall, as soon as may be, fix a limit for the number of licenses to be issued under this section, which limit .shall be based upon the number of licenses then issued and outstanding, and he may from time to time, after reasonable notice and a hearing, decrease the limit so fixed. SECTION 5. Any person, firm or corporation licensed under section four may occupy as a private hackney stand, subject to general provisions of law, private property in said city, if thereto authorized by the owner, lessee or official representative thereof. SECTION 6. Said police chief shall, from time to time, designate certain portions, other than sidewalks, of public ways in said city, to be used and known as private hackney stands. Such stands shall be used by vehicles whose owners are licensed^nder section four, and who have complied with all provisions of sections IS. to Ns, inclusive, of this ordinance, relative to such stands, and with all rules and regulations of said Chief of Police relative thereto. Within that portion of the city proper, as denned in the present rules and regulations of the police department of said city relative to hackney carriages, said Chief of Police shall, so far as practicable, establish such stands at intervals of not more than one quarter of a mile. All such stands shall be plainly marked as private hackney stands. No motor vehicle other than a licensed hackney carriage shall make use of any such private stand. Said Chief of Police shall, upon application for a private hackney stand by an applicant for a license under section four, issue to such applicant for each hackney carriage for which a license under said section four is granted, a license for said carriage to use the private hackney stand. fee^ SECTION 7. All rules and parts of rules inconsistent with section KJ i to eighteen, inclusive, of this ordinance, are hereby repealed, and all rules and regulations of the Chief of Police of Somerville inconsistent with said sections are hereby made null and void. SECTION 8. Notwithstanding the provisions of this ordinance, all licenses otherwise affected thereby which are in effect on its effective date shall continue in force until the expiration date of such licenses, unless sooner revoked in accordance with law. SECTION 9. Whenever in these regulations the following terms are used, they shall have the meanings respectively ascribed to them in this section: INSPECTOR OF CARRIAGES.—A superior officer of the Traffic Division assigned in that capacity. APPEAL BOARD.—A Board consisting of three superior officers designated by the Chief of Police. TAXICAB.—A motor vehicle licensed as a hackney carriage on which a taximeter is affixed. TAXIMETER.—A mechanical instrument or device by which the charge for hire is mechanically calculated either for distance travelled, or for waiting time, or for both, and upon which such charge shall be indicated by means of figures. PUBLIC AUTOMOBILE.—A hackney carriage used for livery purposes without a taximeter. -197-
HACKNEY CARRIAGE LICENSES GRANTED UNDER THESE RULES AND REGULATIONS. SECTION 10. The Chief of Police of the City of Somerville shall, in accordance with law, annually grant hackney carriage licenses to suitable persons, firms and corporations who are owners of such vehicles (if the individual or one member of the firm resides in Somerville and if the principal place of business of the corporation is in Somerville) to set up and use them as hackney carriages. The fee for such license shall be five dollars. For the substitution of the license to set up and use a hackney carriage for that of a hackney carriage previously licensed in accordance with this section, the fee shall be one dollar. Hackney carriages, except "funeral licenses," shall be licensed from the garage at which they are kept in Somerville, and in no case at the stands. No license or permit provided for in this rule shall be sold, assigned or transferred without first obtaining the consent of the Chief of Police in writing. When a licensed owner changes his address or the place at which a hackney carriage owned by him is garaged, he shall, within twenty-four hours of such change, notify the Inspector of Carriages in writing. Employment cards shall be issued to drivers by the Chief of Police, and the licensed owners of hackney carriages shall not employ drivers without such employment cards; said employment cards to be kept by. employers during the period that the driver is in their employ. Licensed owners shall return immediately to the Office of Inspector of Carriages the employment card of every driver when he ceases to be in their employ, and, further, the licensed owner shall in writing give the reasons for the termination of the employment. An applicant for a license as owner of a motor hackney carriage shall present for examination in the case of each car a valid certificate of registration issued by the Registrar of Motor Vehicles of the Commonwealth of Massachusetts, the date of which together with the car number shall be entered on the application, and also on the license of the Chief of Police if granted. Upon any change in the certificate of registration of a motor hackney carriage, issued by the Registrar of Motor Vehicles, licensed owners shall immediately present such certificate together with hackney carriage license to the Office of the Inspector of Carriages. The owner of a licensed hackney carriage must keep, on a form approved by the Chief of Police, and produce upon demand of the Chief of Police or Inspector of Carriages or any officer, a record of all trips made by said vehicle and containing all information requested on form approved by the Chief of Police for a period of each calendar day. TRADE NAMES USED BY LICENSED OWNERS. SECTION 11. All trade names used by licensed owners shall be approved by the Chief of Police and recorded in the Office of the Inspector of Carriages. Any licensee who shall cease to be the owner of a hackney carriage shall at once surrender his license to the Chief of Police. No person shall be licensed to be an owner who is not of the age of twenty-one years or over, who cannot read, write and speak the English language intelligibly, or who is addicted to the use of intoxicating liquors or narcotic drugs. All licenses issued to owners must be called for at the Office of Inspector of Carriages within thirty days of filing day of application. The Chief of Police shall refuse a license for, or, if already issued, revoke or suspend the license of any hackney carriage found by him to be unfit or unsuited for public patronage. HACKNEY CARRIAGE DRIVERS' LICENSES. SECTION 12 . The Chief of Police of the City of Somerville may annually grant licenses in said city to suitable persons, residents of Somerville, or cities and towns within a radius of ten (10) miles of Somerville, as drivers who are properly qualified to have charge of Hackney Carriages. The fee for such license shall be two dollars. Each applicant for a driver's license must file with his application four recent photographs of himself wearing uniform cap; photographs to be of a size 2% inches by 2V& inches, one of which shall be attached to his license when issued, one attached to his identification card, one filed with the application, and the remaining photograph to be filed in the application office of the Inspector of Carriages. _ -198-
