The City of Somerville, about five years ago, constructed a wooden flight of steps on land adjoining 69 and 71 Ten Hills Road, owned by Carmela Cedrone, without any legal authority* These steps were constructed as a result of petitions and requests by people in that vicinity so that they could get to the bus stop on the Fellsway. The City of Somerville has received noticea from the owner, of the latter's intention to close the steps so as to prevent the City of Somerville or any persons acquiring the rights by prescription over a period of twenty years. These steps are in constant use by many every day and serve as a great convenience to the people in that vicinity* It would be inadvisable to close these steps and if the City were to remove these steps and construct new steps in another location, the cost would be very high. After investigation of the matter and many discussions with the owner, the City Engineer and City Solicitor, etc., I believe It is for the best interest of the City of Somerville to purchase this particular parcel of land on which the steps are located, for the sum of Three Hundred and Fifty dollars ($350.00). Therefore, I respectfully request that your Honorable Board will take prompt action so that the people in the Ten Hills section will.be allowed to continue using the steps. The oumer of the property is very much interested In getting this matter settled as soon as possible because so long as the steps are on the latter's land, there might be a question of recovery by one injured using the steps and suing the owner of the land.
