i i i i The photograph shall be attached to the license so that it cannot be removed and another photograph substituted without detection. No person shall be licensed to be a driver who is not of the age of nineteen years or over, who cannot read, write and speak the English language intelligibly, or who is addicted to the use of intoxicating liquors or narcotic drugs. All licenses issued to drivers must be called for at the Office of Inspector of Carriages within thirty days of the filing of the application. Any licensee who shall cease to be the driver of a hackney carriage shall at once surrender his license to the Chief of Police. When a licensed driver changes his address, or his place of employment, or his employer, he shall within twenty-four hours of such change notify the Inspector of Carriages in writing. An applicant for a license to drive a motor hackney carriage shall present for examination a valid license as an operator issued to him by the Registrar of Motor Vehicles of the Commonwealth of Massachusetts and the date and the number thereof shall be entered on the application. PAINTING OF HACKNEY CARRIAGES. SECTION 13. No owner of a licensed hackney carriage known as a taxicab shall paint his vehicle in colors or designs to so closely resemble other licensed hackney carriages classified as taxicabs as to mislead the public as to its identity. ADVERTISEMENTS. SECTION 14. No advertising matter shall be permitted in or upon hackney carriages without the permission of the Chief of Police. INSPECTION OF VEHICLES. SECTION 15. Before a hackney carriage shall be licensed it shall be thoroughly inspected in regard to mechanical condition and general appearance, and all hackney carriages licensed shall be inspected to meet the above requirements every six months. All licensed hackney carriages shall have a card of such size and form as may be required by the Chief of Police which shall show the license number assigned to said vehicle by the Chief of Police, and a statement to the effect that in cases of complaint the Inspector of Carriages shall be notified, giving the number of the hackney carriage, and rates of fare as required in Section tSJfe- There shall be no lights on taxicabs, except those required by law, without obtaining the approval of the Chief of Police. All hackney carriages must be kept in good condition, suitable for occupancy and mechanically fit for the safety of passengers. The interior and exterior shall be clean and sanitary at all times. All hackney carriages shall be thoroughly cleaned, inspected and repaired by the owner at least once each week. On the first of each month, the' owner of each hackney carriage shall file with the Inspector of Carriages a report, on a form supplied by said Inspector of Carriages, certifying under the penalties of perjury the fact that said hackney carriage was thoroughly cleaned, inspected and repaired at least once in every week of the preceding month and setting forth the results of said inspections and the repairs made. RATE OF FARE. SECTION 16. Every licensed hackney carriage, operating as a taxicab, shall contain a card showing the rate of fare that the particular cab is operated under and approved by the Chief of Police and recorded in the Office of the Inspector of Carriages. This card shall be displayed on the interior of the vehicle in clear view of the passenger and so placed or secured in the frame in which it is enclosed that it may not be easily molested or destroyed. Said rate shall be uniform for all licensed taxicabs, namely: Twenty-five (25) cents for the first two-fifths mile or fraction thereof; five (5) cents for each additional one-fifth mile or fraction thereof. Waiting time shall include all time during which the vehicle is not in motion, beginning nine minutes.after its arrival at the place to which it has been called, or, if engaged in the street or at a stand, beginning nine minutes after the time of such engagement. A charge of ten (10) cents for each three minutes may be made. But no charge shall be made for time lost through the inefficiency of the vehicle or its driver, or for time between premature arrival in response to a call and the hour for which the vehicle was ordered. Hand baggage may be carried by passengers without charge. The carriage of trunks shall be optional with the person in charge of the vehicle; but if carried, the charge shall be twenty-five (25) cents for each trunk. TIME OF FILING APPLICATIONS. SECTION 17. New applications for all licenses and for designated private stands may be filed with the Chief of Police at any time, but applica- -199-
i i i tions for the renewal of licenses and designated stands already in force shall be filed annually before May 1. They shall be made on official forms provided by the Inspector of Carriages, shall contain all the information therein required, and shall be examined and reported on by the said inspector. All licenses and private stand designations shall become void on the first day of May annually, "FUNERAL LICENSES." SECTION 18. The Chief of Police may grant licenses to be known as "funeral licenses" to suitable persons not residents of the City of Somerville, who are owners of such vehicles (and whose principal business is the conveyance of persons for hire at funerals), to set up and use them as hackney carriages within said city. Every such license shall have stamped upon its face the words, "Funeral License." CONDUCT OF DRIVERS ON STANDS. SECTION 19. No hackney carriage driver shall make or permit anyone else to make any repairs to his vehicle while on a Hackney Stand. No driver shall sit in the passenger compartment of a hackney carriage and shall permit no one else to sit therein except passengers. PARKING. SECTION 20. No driver shall park his car in a double line at a private stand nor shall any driver park his vehicle in such a manner as to interfere with traffic, both vehicular and pedestrian, at any location. CONDUCT OF HACKNEY CARRIAGE DRIVERS. SECTION 21. It is the duty of police officers to observe the movements of hackney carriages, especially at night, and at all times to see that the rules governing such carriages and their drivers are obeyed. Licensed drivers shall be respectful to and are required to answer fully and civilly any questions put to them by police officers in the performance of their duty. The Chief of Police will regard as unsuited to hold a license any driver who violates any State or Federal liquor law, or who gives direction, information or service to a man or woman, seeking a place or a person for immoral purposes, or any driver who offers such direction, information or service. He will regard as unsuited to hold a license any driver who conveys from place to place a person who is noisy or otherwise disorderly, or who conveys a person who is intoxicated, even though not disorderly, except directly to the place which the driver has reason to believe is the passenger's house of lodging; but this provision shall not apply to cases in which persons are conveyed by direction of a police officer. When a passenger becomes noisy or otherwise disorderly while in a carriage and persists in such conduct after warning, the driver may appeal to any police officer who shall assist him in any lawful way, and if in possession of the necessary evidence shall prosecute the offending passenger. The police shall observe with particular care the matters to which this section relates, and shall report thereon. No driver in charge of a licensed hackney carriage, while awaiting employment by passengers, shall stand the same in any public street or place other than at a stand, nor shall any driver of such hackney carriage seek employment by repeatedly and persistently driving his vehicle to and fro in a short space before, or by otherwise interfering with the proper and orderly access to or egress from any theater, hall, hotel, public resort, or other places of public assembly; but any licensed hackney carriage driver may accept employment while driving through any public street or place without stops other than those due to obstruction of traffic and at such speed as not to interfere with or impede traffic. Every driver of any licensed hackney carriage shall remain with said vehicle while it is unemployed or standing in the streets or squares of the city unless he shall be necessarily absent therefrom in the course of his duty and business as such driver, but in no event longer than thirty minutes. Every driver of any licensed hackney carriage shall place the flag of the taximeter in a recording position as soon as he takes on a passenger, and shall keep the flag in a recording position so long as the said carriage is engaged. A recording position shall be deemed to be any position of the flag except a raised vertical position. Every driver of any licensed hackney carriage shall report to the police station any suspicious actions of passengers or conditions which he may observe. A driver shall not refuse, unless previously engaged or unless the conditions are such as those described in Section Ssfof these rules, to carry any passenger lawfully entitled to be carried in a hackney carriage. The hackney carriage driver shall not demand from any passenger more than the fare recorded on the taximeter. -200-
