2.3 The significance of the Lanzarote C<strong>on</strong>venti<strong>on</strong><br />
The Lanzarote C<strong>on</strong>venti<strong>on</strong> was ratified <strong>on</strong> 1 March 2010 and entered <strong>in</strong>to force <strong>in</strong> the Netherlands <strong>on</strong> 1<br />
July 2010. 63 The M<strong>in</strong>isters for Justice, Youth and Families and Foreign Affairs signed the Act to <strong>in</strong>dicate<br />
that the protecti<strong>on</strong> of the child from sexual violence can not <strong>on</strong>ly be the resp<strong>on</strong>sibility of a s<strong>in</strong>gle m<strong>in</strong>istry.<br />
The Explanatory Memorandum 64 opened with the sentence, “Opgroeiende k<strong>in</strong>deren verdienen <strong>on</strong>s aller bescherm<strong>in</strong>g”<br />
[<str<strong>on</strong>g>Child</str<strong>on</strong>g>ren who are grow<strong>in</strong>g up deserve to be protected by us all]. Accord<strong>in</strong>g to the Explanatory<br />
Memorandum, the C<strong>on</strong>venti<strong>on</strong> aims to protect children from sexual abuse <strong>in</strong> broad terms, and covers a<br />
large number of topics that relate to this protecti<strong>on</strong>. The material behaviours that c<strong>on</strong>stitute an offence<br />
are all stated with<strong>in</strong> the scope of the same pr<strong>in</strong>ciples. Therefore, this means that the provisi<strong>on</strong>s relat<strong>in</strong>g<br />
to crim<strong>in</strong>al offences and sancti<strong>on</strong>s, preventive and protective measures, procedural stipulati<strong>on</strong>s,<br />
<strong>in</strong>terventi<strong>on</strong> measures and measures that relate to co-ord<strong>in</strong>ati<strong>on</strong> and <strong>in</strong>ternati<strong>on</strong>al co-operati<strong>on</strong> not<br />
<strong>on</strong>ly relate to sexual abuse as such, but also apply to the issue of combat<strong>in</strong>g child pornography. Article<br />
10 of the C<strong>on</strong>venti<strong>on</strong> also obliges parties to bear resp<strong>on</strong>sibility for co-ord<strong>in</strong>ati<strong>on</strong> between the various<br />
<strong>in</strong>stituti<strong>on</strong>s that are resp<strong>on</strong>sible for prevent<strong>in</strong>g and combat<strong>in</strong>g the sexual exploitati<strong>on</strong> and sexual<br />
abuse of children. Am<strong>on</strong>gst others, such co-ord<strong>in</strong>ati<strong>on</strong> lies with<strong>in</strong> the resp<strong>on</strong>sibility of the M<strong>in</strong>istry<br />
of Justice and the programme m<strong>in</strong>istry for Youth and Families. 65 It will also become apparent from<br />
the chapters below that these m<strong>in</strong>istries have also developed the greatest number of <strong>in</strong>itiatives. The<br />
Explanatory Memorandum also lists a number of these <strong>in</strong>itiatives, such as the <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse Report<strong>in</strong>g<br />
and Counsell<strong>in</strong>g Centres 66 and the Acti<strong>on</strong> Plan to Tackle <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse. 67 Nevertheless, <strong>in</strong> order to achieve<br />
success <strong>in</strong> combat<strong>in</strong>g child abuse, efforts are required <strong>on</strong> the part of all the authorities, <strong>in</strong>stituti<strong>on</strong>s<br />
and professi<strong>on</strong>als <strong>in</strong>volved, as well as close co-operati<strong>on</strong>, which also needs to extend to the tackl<strong>in</strong>g<br />
of child pornography. 68<br />
Such co-operati<strong>on</strong> is necessary, but a first step towards this <strong>in</strong>volves creat<strong>in</strong>g awareness. Not all m<strong>in</strong>istries<br />
feel a sense of resp<strong>on</strong>sibility for tackl<strong>in</strong>g child pornography, for example. This becomes apparent<br />
from the resp<strong>on</strong>se of the programme m<strong>in</strong>ister for Youth and Families at the time (resp<strong>on</strong>sible for the<br />
RAAK [Reflecti<strong>on</strong> and Acti<strong>on</strong> Group to Tackle <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse]) to questi<strong>on</strong>s regard<strong>in</strong>g child pornography<br />
from Member of Parliament Verd<strong>on</strong>k. 69 He writes that whenever people from a child’s circle of family,<br />
friends and professi<strong>on</strong>als observe signs or suspect that a child is a victim of child pornography, they<br />
can of course report this to the <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse Report<strong>in</strong>g and Counsell<strong>in</strong>g Centre, 70 whereby the standard<br />
course of acti<strong>on</strong> may then be pursued, which may <strong>in</strong>clude the <strong>in</strong>volvement of the <str<strong>on</strong>g>Child</str<strong>on</strong>g> Care and<br />
Protecti<strong>on</strong> Board and the police. He c<strong>on</strong>t<strong>in</strong>ues by stat<strong>in</strong>g that the task of tackl<strong>in</strong>g child pornography<br />
does, however, necessitate a specific programme of measures. Due to the emphasis placed <strong>on</strong> detect-<br />
