The phenomen<strong>on</strong> of child pornography<br />

to the Explanatory Report. C<strong>on</strong>tact and communicati<strong>on</strong>s made by an adult to a child exclusively<br />

<strong>on</strong> the Internet, irrespective of the <strong>in</strong>tenti<strong>on</strong> and the c<strong>on</strong>tent of the communicati<strong>on</strong> are not subject<br />

to crim<strong>in</strong>alisati<strong>on</strong>.<br />

The <strong>in</strong>ternati<strong>on</strong>al regulati<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography that are currently <strong>in</strong> place are not entirely<br />

unambiguous. For example, where the EU Framework Decisi<strong>on</strong> and the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Cybercrime refer<br />

to visual images and depicti<strong>on</strong>, the UN def<strong>in</strong>iti<strong>on</strong> is broader <strong>in</strong> scope. In view of the fact that this<br />

<strong>in</strong>strument refers to ‘any representati<strong>on</strong> by whatever means’, this could also encompass text and written<br />

material, 139 as well as audio material. In additi<strong>on</strong>, the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Cybercrime, the current EU<br />

Framework Decisi<strong>on</strong> and the Opti<strong>on</strong>al Protocol to the UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights of the <str<strong>on</strong>g>Child</str<strong>on</strong>g> all<br />

def<strong>in</strong>e a child as an <strong>in</strong>dividual below the age of 18 years. However, countries may apply a lower age limit<br />

by virtue of the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Cybercrime, although that limit must not be less than 16 years of age. 140<br />

The Lanzarote C<strong>on</strong>venti<strong>on</strong> offers similar scope for excepti<strong>on</strong> with regard to the obligati<strong>on</strong> to crim<strong>in</strong>alise<br />

producti<strong>on</strong> and possessi<strong>on</strong> of child abuse material <strong>in</strong> which children are <strong>in</strong>volved who are below the<br />

age of c<strong>on</strong>sent accord<strong>in</strong>g to nati<strong>on</strong>al law and who have produced or possess images with their c<strong>on</strong>sent<br />

and for their own use. 141 The various sources of <strong>in</strong>ternati<strong>on</strong>al regulati<strong>on</strong>s also not <strong>on</strong>ly c<strong>on</strong>cern actual<br />

images but also realistic and simulated images of n<strong>on</strong>-existent children – virtual child abuse material,<br />

but excepti<strong>on</strong>s to these regulati<strong>on</strong>s are possible. After the enactment of the Lanzarote C<strong>on</strong>venti<strong>on</strong> <strong>in</strong><br />

2007, the European Commissi<strong>on</strong> eventually presented a proposal for a new directive with regard to<br />

tackl<strong>in</strong>g child pornography <strong>in</strong> March 2010. 142 The proposal of the European Commissi<strong>on</strong> is broader than<br />

the current EU Framework Decisi<strong>on</strong> 143 due to the fact that, just as the Lanzarote C<strong>on</strong>venti<strong>on</strong>, it not <strong>on</strong>ly<br />

c<strong>on</strong>cerns the tackl<strong>in</strong>g of sexual exploitati<strong>on</strong> of children and child pornography, but also sexual abuse of<br />

children. The c<strong>on</strong>tents of the forthcom<strong>in</strong>g directive have not yet been determ<strong>in</strong>ed but may give rise to<br />

new legislati<strong>on</strong> <strong>in</strong> the Netherlands <strong>in</strong> due course. Once it has been drawn up, the new directive will, for<br />

the time be<strong>in</strong>g, form the most recent development <strong>in</strong> <strong>in</strong>ternati<strong>on</strong>al regulati<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g the tackl<strong>in</strong>g<br />

of child pornography, with the aim of harm<strong>on</strong>is<strong>in</strong>g the regulati<strong>on</strong>s. 144 In additi<strong>on</strong> to striv<strong>in</strong>g to achieve<br />

uniformity, this development also dem<strong>on</strong>strates that the phenomen<strong>on</strong> of child pornography is be<strong>in</strong>g<br />

placed <strong>in</strong> a broader c<strong>on</strong>text, al<strong>on</strong>g with sexual abuse and sexual exploitati<strong>on</strong> of children.<br />

Term<strong>in</strong>ology <strong>in</strong> relati<strong>on</strong> to child pornography<br />

The fact that child pornography is <strong>in</strong> itself a form of sexual abuse of children is recognised <strong>in</strong>ternati<strong>on</strong>ally<br />
