Service, this recent <strong>in</strong>crease is the result of a more <strong>in</strong>tensive approach to tackl<strong>in</strong>g child pornography<br />

that has been implemented s<strong>in</strong>ce 2009. 456<br />

C<strong>on</strong>cluded cases by type of settlement<br />

Figure 3.13 shows the ways <strong>in</strong> which the Public Prosecuti<strong>on</strong> Service c<strong>on</strong>cluded cases <strong>in</strong> the period between<br />

2005 and 2010. 457<br />

Summ<strong>on</strong>s<br />

On average, the Public Prosecuti<strong>on</strong> Service decides to issue a summ<strong>on</strong>s <strong>in</strong> three quarters of all cases 458 , 459<br />

and the unc<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong> not to prosecute is taken <strong>in</strong> 14% of cases. The rema<strong>in</strong><strong>in</strong>g types of settlement<br />

c<strong>on</strong>cern 11% of all cases <strong>on</strong> average. Besides this, a decrease <strong>in</strong> the number of out-of-court settlements can<br />

be seen (from 8% <strong>in</strong> 2006 to 1% <strong>in</strong> 2010) as well as an <strong>in</strong>crease <strong>in</strong> the percentage of c<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong>s not<br />

to prosecute (from 2% <strong>in</strong> 2005 to 6% <strong>in</strong> 2010). This is an <strong>in</strong>terest<strong>in</strong>g development, c<strong>on</strong>sider<strong>in</strong>g the fact that<br />

c<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong>s not to prosecute can (partly) be employed as an <strong>in</strong>strument of <strong>in</strong>fluence. (see §3.6.2).<br />
