The phenomen<strong>on</strong> of child pornography<br />

c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g an image’. Audio, or sound clips, are not <strong>in</strong> themselves subject to crim<strong>in</strong>al provisi<strong>on</strong>s. The<br />

same also applies to texts c<strong>on</strong>cern<strong>in</strong>g the sexual abuse of children. Websites <strong>on</strong> which paedophiles and<br />

paedosexuals share views or describe sexual acts between adults and children do not c<strong>on</strong>stitute a crim<strong>in</strong>al<br />

offence by virtue of Article 240b of the Dutch Crim<strong>in</strong>al Code. 173 Similarly, accounts of sex featur<strong>in</strong>g<br />

fictitious children do not c<strong>on</strong>stitute crim<strong>in</strong>al offences by virtue of this provisi<strong>on</strong>. It appears as if the<br />

freedom of speech prevents this from be<strong>in</strong>g the case. 174<br />

The aim of the law is to crim<strong>in</strong>alise behaviour <strong>in</strong> relati<strong>on</strong> to the material. The behaviour may be directed<br />

towards the producti<strong>on</strong>, (forms of ) distributi<strong>on</strong>, possessi<strong>on</strong> or obta<strong>in</strong><strong>in</strong>g access to a (data storage medium<br />

c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g an) abusive image <strong>in</strong>volv<strong>in</strong>g a child. The elements that form part of the law and serve to<br />

qualify material as child abuse material are phrased clearly: the material <strong>in</strong> questi<strong>on</strong> must depict sexual<br />

c<strong>on</strong>duct, <strong>in</strong> which a pers<strong>on</strong> who has evidently not yet reached the age of eighteen years is <strong>in</strong>volved or<br />

is apparently <strong>in</strong>volved. 175 The assessment of material <strong>on</strong> the basis of these elements is somewhat more<br />

complex <strong>in</strong> practice, however.<br />

‘Sexual c<strong>on</strong>duct’<br />

The image c<strong>on</strong>cerned must be an image of ‘sexual c<strong>on</strong>duct’. A questi<strong>on</strong> that arises regularly with<strong>in</strong> the<br />

judicial system is what exactly is meant by that term ‘sexual c<strong>on</strong>duct’. 176 This does not have to be actual<br />

physical abuse of a m<strong>in</strong>or but could, for example, also be a photograph of the genitals of a m<strong>in</strong>or,<br />

depend<strong>in</strong>g <strong>on</strong> the manner and situati<strong>on</strong> <strong>in</strong> which the genitals of a m<strong>in</strong>or are shown. 177 Accord<strong>in</strong>g to<br />

the Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography, the issue of whether or not the image<br />

c<strong>on</strong>cerned is an ord<strong>in</strong>ary image of a (whether or not fully or partially naked) child <strong>in</strong> the family sett<strong>in</strong>g<br />

forms the divid<strong>in</strong>g l<strong>in</strong>e between an image of a m<strong>in</strong>or that c<strong>on</strong>stitutes a crim<strong>in</strong>al offence and <strong>on</strong>e that<br />

does not. An image that is <strong>in</strong> pr<strong>in</strong>ciple an ord<strong>in</strong>ary image of a fully or partially naked child <strong>in</strong> the family<br />

sett<strong>in</strong>g depicts behaviour that is appropriate of a child of that age and the behaviour was recorded <strong>in</strong> an<br />

envir<strong>on</strong>ment and <strong>in</strong> a c<strong>on</strong>text <strong>in</strong> which the child would normally be found. An unnatural pose and/or<br />

the additi<strong>on</strong> of unnatural attributes render the image unnatural <strong>in</strong> appearance and (may) result <strong>in</strong> that<br />

image hav<strong>in</strong>g to be designated as sexual c<strong>on</strong>duct. 178<br />

In order to determ<strong>in</strong>e which material c<strong>on</strong>stitutes a crim<strong>in</strong>al offence, the Implementati<strong>on</strong> Provisi<strong>on</strong>s<br />

c<strong>on</strong>cern<strong>in</strong>g child pornography are based up<strong>on</strong> the classificati<strong>on</strong> below, am<strong>on</strong>gst other criteria. 179 Ma-<br />
