<str<strong>on</strong>g>Child</str<strong>on</strong>g> PornograPhy First report oF the Dutch NatioNal rapporteur<br />
In the period follow<strong>in</strong>g this, the M<strong>in</strong>istry of (Security and) Justice assumed resp<strong>on</strong>sibility for, and took<br />
the <strong>in</strong>itiative <strong>in</strong>, the task of combat<strong>in</strong>g child pornography. As seen <strong>in</strong> various programmes, this seems<br />
to be directed towards the implementati<strong>on</strong> of measures, or the improvement of exist<strong>in</strong>g measures to<br />
tackle child pornography, such as the Programme of Improvements <strong>in</strong> Tackl<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g>, the<br />
Korpsm<strong>on</strong>itor and the policy implemented by the police with regard to the approach towards tackl<strong>in</strong>g<br />
child pornography <strong>in</strong> general. The start<strong>in</strong>g po<strong>in</strong>t for this is the enforcement of Article 240b of the Dutch<br />
Crim<strong>in</strong>al Code. This approach, <strong>in</strong>itiated by the M<strong>in</strong>istry of (Security and) Justice, is primarily a digital<br />
approach and is primarily based <strong>on</strong> repressive measures. Nevertheless, this m<strong>in</strong>istry also employs an<br />
analogue and (partly) preventive approach towards combat<strong>in</strong>g sexual violence aga<strong>in</strong>st children, as a<br />
comp<strong>on</strong>ent of the domestic violence programme.<br />
Other m<strong>in</strong>istries are also tak<strong>in</strong>g <strong>in</strong>itiatives to develop policies aimed at combat<strong>in</strong>g and prevent<strong>in</strong>g child<br />
abuse, combat<strong>in</strong>g sexual violence (<strong>in</strong> dependency relati<strong>on</strong>ships), promot<strong>in</strong>g the ability to defend <strong>on</strong>eself<br />
aga<strong>in</strong>st sexual approaches and promot<strong>in</strong>g sexual health, creat<strong>in</strong>g safe day-care centres, and <strong>in</strong>creas<strong>in</strong>g<br />
children’s knowledge about digital safety. Am<strong>on</strong>gst other th<strong>in</strong>gs, this <strong>in</strong>volves immediately combat<strong>in</strong>g or<br />
prevent<strong>in</strong>g sexual violence aga<strong>in</strong>st children. Work is almost always carried out <strong>on</strong> an <strong>in</strong>ter-departmental<br />
basis. Initiatives sometimes start out <strong>in</strong> the form of programmes implemented by a s<strong>in</strong>gle m<strong>in</strong>istry, and<br />
other departments jo<strong>in</strong> <strong>in</strong> at a later stage, whereas other programmes are implemented governmentwide.<br />
An example of the latter is the <strong>in</strong>itiative of the M<strong>in</strong>istry of Justice with regard to domestic violence<br />
that later went <strong>on</strong> to form part of the governmental policy. In additi<strong>on</strong> to the M<strong>in</strong>istry of Security and<br />
Justice, the M<strong>in</strong>istry of Health, Welfare and Sport, as coord<strong>in</strong>at<strong>in</strong>g m<strong>in</strong>istry <strong>in</strong> this field, also <strong>in</strong>stigates<br />
a great many <strong>in</strong>itiatives.<br />
The Sexual Health Programme, the Regi<strong>on</strong>al Plan to Tackle <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse, and educati<strong>on</strong>al programmes<br />
at schools and day-care centres can also be listed as examples of programmes aimed at the preventi<strong>on</strong><br />
of sexual violence. The M<strong>in</strong>istry of Security and Justice, and the M<strong>in</strong>istry of Health, Welfare and Sport, as<br />
well as the M<strong>in</strong>istry of Educati<strong>on</strong>, Culture and Science, the M<strong>in</strong>istry of Social Affairs and Employment,<br />
and the M<strong>in</strong>istry of Ec<strong>on</strong>omic Affairs, Agriculture and Innovati<strong>on</strong> are <strong>in</strong>volved <strong>in</strong> these programmes.<br />
These broad, <strong>in</strong>tegrated programmes do not generally devote much attenti<strong>on</strong> to the digital aspects of<br />
sexual violence aga<strong>in</strong>st children that have developed <strong>in</strong> recent years, nor is a great deal be<strong>in</strong>g d<strong>on</strong>e<br />
to <strong>in</strong>vestigate the opportunities that the digital world presents for prevent<strong>in</strong>g and combat<strong>in</strong>g child<br />
pornography.<br />
No effective c<strong>on</strong>necti<strong>on</strong> between the judicial, explicit approach towards tackl<strong>in</strong>g child pornography and<br />
the more wide-rang<strong>in</strong>g <strong>in</strong>itiatives with regard to the preventi<strong>on</strong> and further tackl<strong>in</strong>g of sexual violence<br />
has been formed. In this respect, a comprehensive policy framework, <strong>in</strong> which analogue and digital<br />
developments <strong>in</strong> the c<strong>on</strong>text of sexual violence aga<strong>in</strong>st children are c<strong>on</strong>nected, does not yet exist. This<br />
means that this aspect of the policy is fragmented. As a result, the complexity of the phenomen<strong>on</strong> of<br />
child pornography is also <strong>in</strong>sufficiently represented <strong>in</strong> policy.<br />
Policy <strong>in</strong>itiatives with regard to child pornography seem to be <strong>in</strong>cident-driven, and there appear to be<br />
gaps <strong>in</strong> the c<strong>on</strong>t<strong>in</strong>uity of the policy. This po<strong>in</strong>t is illustrated by the way <strong>in</strong> which the previously-stated<br />
NAPS disappeared without a sound. Nevertheless, the exist<strong>in</strong>g governmental <strong>in</strong>itiatives show great<br />
promise. The process of l<strong>in</strong>k<strong>in</strong>g together the various programmes is the area <strong>in</strong> which progress can be<br />
made. Initiatives have also already been developed <strong>in</strong> the practical implementati<strong>on</strong> programmes that<br />
seek to form such c<strong>on</strong>necti<strong>on</strong>s, and these have been described as best practices <strong>in</strong> the previous chapters.
