3.5.5 Trends<br />

The follow<strong>in</strong>g trends emerge from the figures collected.<br />

Implementati<strong>on</strong><br />

An <strong>in</strong>creas<strong>in</strong>g number of prosecuti<strong>on</strong>s and trials are be<strong>in</strong>g carried out for offences c<strong>on</strong>cern<strong>in</strong>g child<br />

pornography<br />

The annual number of child pornography cases registered with the Public Prosecuti<strong>on</strong> Service <strong>in</strong>creased<br />

<strong>in</strong> 2009 and 2010. This also applies to the number of child pornography cases settled by the Public<br />

Prosecuti<strong>on</strong> Service. This trend is visible with regard to the courts <strong>in</strong> first <strong>in</strong>stance <strong>in</strong> 2010. Accord<strong>in</strong>g to<br />

the Public Prosecuti<strong>on</strong> Service, these recent developments are the result of a more <strong>in</strong>tensive approach<br />

towards tackl<strong>in</strong>g child pornography.<br />

In particular, c<strong>on</strong>victi<strong>on</strong>s are be<strong>in</strong>g handed down for n<strong>on</strong>-aggravated child pornography<br />

The vast majority of child pornography cases registered at the Public Prosecuti<strong>on</strong> Service <strong>in</strong>volve n<strong>on</strong>aggravated<br />

child pornography (91%). This is strik<strong>in</strong>g, c<strong>on</strong>sider<strong>in</strong>g the fact that it is relatively easy from<br />

a legal po<strong>in</strong>t of view to prove the circumstance of mak<strong>in</strong>g a professi<strong>on</strong> or habit of possessi<strong>on</strong> of child<br />

abuse material, which <strong>in</strong>creases the penalty. However, it is possible that these figures provide a distorted<br />

view of the reality as a result of <strong>in</strong>complete registrati<strong>on</strong>.<br />

<str<strong>on</strong>g>Child</str<strong>on</strong>g> pornography offences often also <strong>in</strong>volve other sexual offences<br />

If a graver offence than child pornography is <strong>in</strong>volved <strong>in</strong> the same child pornography offence that is<br />

registered with the Public Prosecuti<strong>on</strong> Service (23%), this almost always <strong>in</strong>volves a sexual offence, usually<br />

<strong>in</strong>volv<strong>in</strong>g a m<strong>in</strong>or. This also applies to child pornography cases <strong>in</strong> which suspects are sentenced by<br />

the courts <strong>in</strong> first <strong>in</strong>stance.<br />

C<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong>s not to prosecute are be<strong>in</strong>g made occasi<strong>on</strong>ally, but <strong>in</strong>creas<strong>in</strong>gly often<br />

In the period between 2005 up to and <strong>in</strong>clud<strong>in</strong>g 2010, the percentage of c<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong>s not to<br />

prosecute <strong>in</strong>creased from 2% to 6%. This is an <strong>in</strong>terest<strong>in</strong>g development, c<strong>on</strong>sider<strong>in</strong>g the fact that c<strong>on</strong>diti<strong>on</strong>al<br />

decisi<strong>on</strong>s not to prosecute can (partly) be employed as an <strong>in</strong>strument of <strong>in</strong>fluence.<br />

Relatively speak<strong>in</strong>g, fewer prosecuti<strong>on</strong>s took place <strong>in</strong> 2010<br />

The percentage of prosecuti<strong>on</strong>s <strong>in</strong> first <strong>in</strong>stance <strong>in</strong> 2010 was lower than <strong>in</strong> the preced<strong>in</strong>g years (85%<br />

compared to an average of 92% <strong>in</strong> the period between 2005 and 2009.) It is possible that this can –<br />

partly – be expla<strong>in</strong>ed by the fact that the Public Prosecuti<strong>on</strong> Service is tak<strong>in</strong>g less obvious forms of child<br />

pornography to court more and more often. These less obvious forms of child pornography can <strong>in</strong>clude<br />

virtual child pornography or child pornography <strong>in</strong>volv<strong>in</strong>g adolescents. The Public Prosecuti<strong>on</strong> Service is<br />

also tak<strong>in</strong>g cases to court with the <strong>in</strong>tenti<strong>on</strong> of creat<strong>in</strong>g case law with regard to the ‘grey area’ between<br />

the material that does and does not c<strong>on</strong>stitute a crim<strong>in</strong>al offence.<br />

In most cases, a suspended custodial sentence with a community service order is imposed<br />

In the event that a sentence is imposed <strong>in</strong> first <strong>in</strong>stance, a fully suspended/ custodial sentence <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong><br />

with a community service order is imposed <strong>in</strong> half of all cases. On appeal, this figure is approximately<br />

40%. In first <strong>in</strong>stance as well as <strong>on</strong> appeal, this is the most prevalent comb<strong>in</strong>ati<strong>on</strong> of ma<strong>in</strong><br />

sentences imposed <strong>in</strong> child pornography cases.<br />

Increas<strong>in</strong>gly severe sentences are be<strong>in</strong>g imposed<br />

In the period between 2006 up to and <strong>in</strong>clud<strong>in</strong>g 2010, the proporti<strong>on</strong> of n<strong>on</strong>-suspended or partially sus-<br />
