judgment. In the future, this amendment should prevent the situati<strong>on</strong> <strong>in</strong> which, <strong>in</strong> the judgment,<br />

a special c<strong>on</strong>diti<strong>on</strong> stat<strong>in</strong>g merely ‘compliance with the <strong>in</strong>structi<strong>on</strong>s from probati<strong>on</strong> and after-care<br />

services’ is deemed sufficient. On the <strong>on</strong>e hand, this amendment serves the <strong>in</strong>terests of legal certa<strong>in</strong>ty,<br />

and <strong>on</strong> the other hand, the <strong>in</strong>tenti<strong>on</strong> is to c<strong>on</strong>tribute to the effectiveness of probati<strong>on</strong> and after-care<br />

supervisi<strong>on</strong>. Accord<strong>in</strong>g to the government, the judgment – and therefore, to a significant extent, the<br />

c<strong>on</strong>diti<strong>on</strong>s – need to be described as specifically as possible. The legislative proposal sets out to reflect<br />

current practice as much as possible, especially with regard to the special c<strong>on</strong>diti<strong>on</strong>s <strong>in</strong> the form<br />

<strong>in</strong> which they can currently be imposed, which <strong>in</strong> some <strong>in</strong>stances <strong>on</strong>ly <strong>in</strong>volves a codificati<strong>on</strong>. The<br />

legislative proposal provides for an extensi<strong>on</strong> to the list of special c<strong>on</strong>diti<strong>on</strong>s, which rema<strong>in</strong>s n<strong>on</strong>exhaustive.<br />

This list <strong>in</strong>cludes a locati<strong>on</strong> ban, am<strong>on</strong>gst other th<strong>in</strong>gs. In the event of a locati<strong>on</strong> ban, the<br />

c<strong>on</strong>victed perpetrator is not allowed to go to a certa<strong>in</strong> place or the surround<strong>in</strong>g area, for example if<br />

the offender lives <strong>in</strong> the vic<strong>in</strong>ity of a victim (this c<strong>on</strong>diti<strong>on</strong> is regularly imposed <strong>in</strong> the event of sexual<br />

abuse <strong>in</strong> particular). A locati<strong>on</strong> ban is usually imposed <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with electr<strong>on</strong>ic m<strong>on</strong>itor<strong>in</strong>g.<br />

Besides this, the list also provides for a locati<strong>on</strong> order. An example of this is the impositi<strong>on</strong> of house<br />

arrest. Another possibility is that the c<strong>on</strong>victed perpetrator is not allowed to leave the Netherlands<br />

without the approval of probati<strong>on</strong> and after-care services. This can be the case <strong>in</strong> the event that the<br />

suspect has committed crim<strong>in</strong>al offences abroad. This special c<strong>on</strong>diti<strong>on</strong> can be imposed <strong>in</strong> the case of<br />

child sex tourists. 548 Besides this special c<strong>on</strong>diti<strong>on</strong>, the list also <strong>in</strong>cludes the opportunity to impose an<br />

obligati<strong>on</strong> to report and outpatient treatment. The list does not <strong>in</strong>clude any explicit c<strong>on</strong>diti<strong>on</strong>s that<br />

are specifically associated with m<strong>on</strong>itor<strong>in</strong>g computer use and access to the Internet. Partly <strong>in</strong> light of<br />

<strong>in</strong>ternati<strong>on</strong>al developments, such as those outl<strong>in</strong>ed above, more detailed research is required <strong>in</strong> order<br />

to reveal the extent to which impos<strong>in</strong>g these c<strong>on</strong>diti<strong>on</strong>s would be c<strong>on</strong>trary to fundamental rights, the<br />

effects that such special c<strong>on</strong>diti<strong>on</strong>s could have, and whether or not impos<strong>in</strong>g these special c<strong>on</strong>diti<strong>on</strong>s<br />

would also be able to be implemented <strong>in</strong> terms of capacity, both of the police and of probati<strong>on</strong> and<br />

after-care services.<br />

The proposed special c<strong>on</strong>diti<strong>on</strong>s also differ from the proposed legal measure of an exclusi<strong>on</strong> order, c<strong>on</strong>tact<br />

ban or an obligati<strong>on</strong> to report 549 <strong>in</strong> the sense that they have different purposes. Whereas the suspended<br />

sentence with special c<strong>on</strong>diti<strong>on</strong>s is <strong>in</strong>tended to permanently <strong>in</strong>fluence the behaviour of the c<strong>on</strong>victed<br />

perpetrator, the legal measure is <strong>in</strong>tended to restore the system of law and order that has been breached.<br />

The legal measure is specifically <strong>in</strong>tended for those cases <strong>in</strong> which the court does not wish to or is not<br />

able to <strong>in</strong>fluence behaviour through the imposed sancti<strong>on</strong>, but does want to restore the legal order by<br />

a restricti<strong>on</strong> of freedom. Special c<strong>on</strong>diti<strong>on</strong>s have a greater scope than the legal measure, as their focus<br />

is <strong>on</strong> exert<strong>in</strong>g a last<strong>in</strong>g <strong>in</strong>fluence <strong>on</strong> behaviour. This is therefore also the reas<strong>on</strong> why, <strong>in</strong> the legislative<br />

proposal, there is no provisi<strong>on</strong> for supervisi<strong>on</strong> of the probati<strong>on</strong> and after-care services <strong>in</strong> c<strong>on</strong>necti<strong>on</strong><br />

with the legal measure. 550<br />
