The Lanzarote C<strong>on</strong>venti<strong>on</strong><br />
The Lanzarote C<strong>on</strong>venti<strong>on</strong> c<strong>on</strong>ta<strong>in</strong>s an <strong>in</strong>structi<strong>on</strong> <strong>in</strong> relati<strong>on</strong> to practically all of the processes<br />
described <strong>in</strong> the subsequent secti<strong>on</strong>s. In this regard the C<strong>on</strong>venti<strong>on</strong> applies a number of pr<strong>in</strong>ciples<br />
that apply equally to all forms of sexual exploitati<strong>on</strong> and sexual abuse stated <strong>in</strong> the C<strong>on</strong>venti<strong>on</strong>,<br />
<strong>in</strong>clud<strong>in</strong>g child pornography. With regard to the treatment of victims, this means that a victim must<br />
be prevented from revictimisati<strong>on</strong>. This is particularly relevant <strong>in</strong> relati<strong>on</strong> to issues such as the<br />
protecti<strong>on</strong> of the victim’s identity when child pornography is reported (§3.5.2):<br />
“Each Party shall adopt a protective approach towards victims, ensur<strong>in</strong>g that the <strong>in</strong>vestigati<strong>on</strong>s and<br />
crim<strong>in</strong>al proceed<strong>in</strong>gs do not aggravate the trauma experienced by the child and that the crim<strong>in</strong>al<br />
justice resp<strong>on</strong>se is followed by assistance, where appropriate.” 6<br />
Most paragraphs will therefore make reference to the Articles and pr<strong>in</strong>ciples of the C<strong>on</strong>venti<strong>on</strong>.<br />
We will also exam<strong>in</strong>e the extent to which cohesi<strong>on</strong> exists between these different processes. As previously<br />
stated, child pornography must be viewed <strong>in</strong> the broader c<strong>on</strong>text of sexual violence aga<strong>in</strong>st<br />
children. For that reas<strong>on</strong> the processes will also be viewed with<strong>in</strong> this broader c<strong>on</strong>text where necessary.<br />
This chapter will therefore not <strong>on</strong>ly exam<strong>in</strong>e specific <strong>in</strong>terventi<strong>on</strong>s <strong>in</strong> relati<strong>on</strong> to child pornography, but<br />
also the extent to which any abusive c<strong>on</strong>text is taken <strong>in</strong>to account <strong>in</strong> the current forms of <strong>in</strong>terventi<strong>on</strong><br />
<strong>in</strong> relati<strong>on</strong> to sexual violence aga<strong>in</strong>st children. As far as certa<strong>in</strong> elements are c<strong>on</strong>cerned, it is not always<br />
easy to dist<strong>in</strong>guish between cases that <strong>in</strong>volve child pornography and those that do not with<strong>in</strong> the broad<br />
c<strong>on</strong>text of sexual violence aga<strong>in</strong>st children.<br />
By its very nature, child pornography exists is an <strong>in</strong>ternati<strong>on</strong>al phenomen<strong>on</strong>. It is therefore essential to<br />
seek <strong>in</strong>ternati<strong>on</strong>al cooperati<strong>on</strong> to tackle this issue. We will focus up<strong>on</strong> this <strong>in</strong>ternati<strong>on</strong>al aspect <strong>in</strong> the<br />
secti<strong>on</strong> <strong>on</strong> detecti<strong>on</strong>, and also provide recommendati<strong>on</strong>s with regard to mak<strong>in</strong>g specific agreements.<br />
Similar issues also exist <strong>in</strong> other countries. In this chapter, examples from other countries will be exam<strong>in</strong>ed<br />
<strong>in</strong> greater detail, and the relevance of those examples to actual practices be<strong>in</strong>g implemented <strong>in</strong> the<br />
Netherlands will be expla<strong>in</strong>ed.<br />
F<strong>in</strong>ally, we will also devote special attenti<strong>on</strong> to public-private sector partnerships, which play an essential<br />
role <strong>in</strong> tackl<strong>in</strong>g child pornography (§3.8). This secti<strong>on</strong> will describe the <strong>in</strong>itiatives that have already<br />
proved successful <strong>in</strong> this area and the ideas <strong>on</strong> how the partnership could develop further. A large<br />
proporti<strong>on</strong> of child abuse material exists <strong>on</strong> the Internet, which is primarily the doma<strong>in</strong> of the private<br />
sector.<br />

image and by tak<strong>in</strong>g measures <strong>in</strong> accordance with <strong>in</strong>ternal law to prevent the public dissem<strong>in</strong>ati<strong>on</strong> of<br />
any <strong>in</strong>formati<strong>on</strong> that could lead to their identificati<strong>on</strong>”. See also §3.5.2.<br />
