violent <strong>in</strong> other respects. When tak<strong>in</strong>g the age of the victims <strong>in</strong>to account, the younger the victims are, the<br />
higher the demands are with regard to the sentence to be handed down. Accord<strong>in</strong>g to the Guidel<strong>in</strong>es, child<br />
abuse material <strong>in</strong>volv<strong>in</strong>g children under the age of twelve must carry the most severe sentences. In determ<strong>in</strong><strong>in</strong>g<br />
the period dur<strong>in</strong>g which the activities took place, a dist<strong>in</strong>cti<strong>on</strong> is made between a short period of time<br />
and a lengthy period of time. Accord<strong>in</strong>g to the Guidel<strong>in</strong>es, a short period of time is understood as be<strong>in</strong>g a<br />
maximum of <strong>on</strong>e year. F<strong>in</strong>ally, the Public Prosecuti<strong>on</strong> Service also looks at reoffend<strong>in</strong>g, <strong>in</strong> the event that the<br />
suspect has already been sentenced for sexual abuse. The start<strong>in</strong>g po<strong>in</strong>t, for prosecut<strong>in</strong>g the possessi<strong>on</strong> of<br />
child abuse material as a predicate offence, is a demand of 120 po<strong>in</strong>ts, which means a custodial sentence of<br />
120 days. Accord<strong>in</strong>g to the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> Expertise Centre, a part of the sentence is, <strong>in</strong> practice,<br />
demanded as a suspended sentence <strong>in</strong> the majority of cases, due to the importance of modificati<strong>on</strong> of behaviour;<br />
a special c<strong>on</strong>diti<strong>on</strong> dur<strong>in</strong>g a probati<strong>on</strong>ary period allows for rehabilitati<strong>on</strong> supervisi<strong>on</strong> and treatment. 415<br />
Special sessi<strong>on</strong> regard<strong>in</strong>g the possessi<strong>on</strong> of child abuse material<br />
In order to call attenti<strong>on</strong> to the severity of the offences, the Public Prosecuti<strong>on</strong> Service organises<br />
so-called special sessi<strong>on</strong>s. At the end of 2010, such a sessi<strong>on</strong> was held at the Court of The Hague,<br />
<strong>in</strong> which six suspects stood trial for the possessi<strong>on</strong> of child abuse material. The Public Prosecuti<strong>on</strong><br />
Service is of the op<strong>in</strong>i<strong>on</strong> that due to this fact, the suspects are partly resp<strong>on</strong>sible for ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the<br />
producti<strong>on</strong> and distributi<strong>on</strong> of such material. Accord<strong>in</strong>g to the Public Prosecuti<strong>on</strong> Service, a work<strong>in</strong>g<br />
order or suspended custodial sentence does not do justice to the severity of the offences, which is<br />
why the Public Prosecuti<strong>on</strong> Service demands a n<strong>on</strong>-suspended sentence <strong>in</strong> pr<strong>in</strong>ciple. 416 It emerges<br />
from the judgments that the court has not followed this demand <strong>in</strong> all <strong>in</strong>stances. 417<br />

also imposed a community service order of 240 hours, with a suspended custodial sentence of n<strong>in</strong>e m<strong>on</strong>ths<br />
and a probati<strong>on</strong>ary period of five years. In this case, the court took <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> the fact that the man<br />
was voluntarily undergo<strong>in</strong>g therapy and that a custodial sentence would <strong>in</strong>terfere with this therapy); BO5184<br />
(acquittal); BO5183 (suspect had a relatively small collecti<strong>on</strong> of child erotica <strong>in</strong> his possessi<strong>on</strong>. Partly due to<br />
this reas<strong>on</strong>, the judge did not follow the prosecutor’s demand for ten m<strong>on</strong>ths’ n<strong>on</strong>-suspended, six m<strong>on</strong>ths’<br />
suspended and a probati<strong>on</strong>ary period of five years. The suspect was sentenced to a work<strong>in</strong>g order of 180<br />
hours, six m<strong>on</strong>ths suspended with a probati<strong>on</strong>ary period of three years); BO5163 (the suspect had searched<br />
for material for over two years, and had also found it: almost <strong>on</strong>e thousand five hundred images. But with<br />
regard to this suspect, it also primarily c<strong>on</strong>cerned child erotica and not ‘hard-core’ child abuse material.<br />
The judge did not follow the public prosecutor’s demand of eighteen m<strong>on</strong>ths’ custodial sentence of which<br />
six m<strong>on</strong>ths suspended with a probati<strong>on</strong>ary period of five years, <strong>in</strong> this case either. The court c<strong>on</strong>sidered a<br />
community service order (180 hours) and a suspended sentence of six years with a probati<strong>on</strong>ary period of<br />
three years to be sufficient). The judgment with regard to the f<strong>in</strong>al suspect has not been published.
