Focus: the protecti<strong>on</strong> of children from sexual violence<br />

The aforementi<strong>on</strong>ed core elements of the phenomen<strong>on</strong> make it clear that child pornography is <strong>in</strong>extricably<br />

l<strong>in</strong>ked to other forms of sexual violence, and that it cannot be tackled, neither can that strategy be<br />

m<strong>on</strong>itored, if the focus solely rests <strong>on</strong> the child abuse material and does not extend to the underly<strong>in</strong>g<br />

sexual violence. This also means that the report<strong>in</strong>g role must be performed <strong>in</strong> such a way that the phenomen<strong>on</strong><br />

of child pornography is regarded as <strong>on</strong>e aspect of the broad area of sexual violence aga<strong>in</strong>st<br />

children, both offl<strong>in</strong>e and <strong>on</strong>l<strong>in</strong>e. If the report<strong>in</strong>g task is limited to child abuse material as such, the<br />

purpose it would serve would be too limited. 19<br />

There is a broad c<strong>on</strong>sensus with regard to the great importance of protect<strong>in</strong>g children from sexual violence<br />

and with regard to the harm that sexual violence causes to the child’s development and wellbe<strong>in</strong>g.<br />

20 <str<strong>on</strong>g>Child</str<strong>on</strong>g> pornography has been made a punishable offence <strong>in</strong> order to provide a means of tackl<strong>in</strong>g<br />

the sexual abuse of children. 21 The crim<strong>in</strong>alisati<strong>on</strong> is <strong>in</strong> keep<strong>in</strong>g with the obligati<strong>on</strong> imposed up<strong>on</strong><br />

countries, <strong>in</strong> the form of various c<strong>on</strong>venti<strong>on</strong>s and tools, <strong>in</strong> order to protect children from all forms of<br />

sexual exploitati<strong>on</strong> and abuse, <strong>in</strong>clud<strong>in</strong>g the use of children <strong>in</strong> pornographic material. 22 For this reas<strong>on</strong>,<br />

tackl<strong>in</strong>g child pornography partly serves to protect children from sexual violence, both <strong>in</strong> the form of<br />

actual abuse and <strong>in</strong> the form of exposure to the implicati<strong>on</strong>s of the producti<strong>on</strong>, distributi<strong>on</strong> and possessi<strong>on</strong><br />

of such images. The producti<strong>on</strong>, acquisiti<strong>on</strong> and view<strong>in</strong>g of child abuse material via Internet are<br />

deemed to c<strong>on</strong>stitute <strong>on</strong>l<strong>in</strong>e sexual violence, whilst the actual abuse c<strong>on</strong>stitutes a form of offl<strong>in</strong>e sexual<br />

violence aga<strong>in</strong>st children. 23<br />

Perspective: from the view<strong>in</strong>g of child abuse material to protecti<strong>on</strong> policy<br />

In this report, we will exam<strong>in</strong>e the policy used by the government and other organisati<strong>on</strong>s to protect children<br />

from sexual violence <strong>in</strong> a broader c<strong>on</strong>text, from the perspective of child pornography. As such, this<br />

report will not allow us to fully map out this policy of protecti<strong>on</strong>, nor can we exam<strong>in</strong>e the even broader<br />

topic relat<strong>in</strong>g to the combat<strong>in</strong>g of child abuse <strong>in</strong> general. However, this report can <strong>in</strong>dicate the extent to<br />

which aspects associated with child pornography are taken <strong>in</strong>to account <strong>in</strong> the protecti<strong>on</strong> policy and its<br />

implementati<strong>on</strong> <strong>in</strong> practice. In short, the f<strong>in</strong>d<strong>in</strong>gs boil down to the fact that policy <strong>in</strong>itiatives that aim to<br />

tackle sexual violence <strong>in</strong> the analogue, real world do not take account of specific <strong>on</strong>l<strong>in</strong>e aspects (such as<br />

child abuse images), and that the same applies vice versa. With regard to the practical implementati<strong>on</strong><br />

of the policy, we not <strong>on</strong>ly exam<strong>in</strong>ed specific <strong>in</strong>terventi<strong>on</strong>s <strong>in</strong> relati<strong>on</strong> to child pornography (s<strong>in</strong>ce these<br />

chiefly c<strong>on</strong>cern repressive measures based up<strong>on</strong> detecti<strong>on</strong> and m<strong>on</strong>itor<strong>in</strong>g, pursuant to Article 240b of the<br />

Dutch Crim<strong>in</strong>al Code, and would not take account of the pr<strong>in</strong>ciples expressed <strong>in</strong> the Lanzarote C<strong>on</strong>venti<strong>on</strong>)<br />
