Implementati<strong>on</strong><br />

A recent <strong>in</strong>vestigati<strong>on</strong> reveals that deprivati<strong>on</strong> of certa<strong>in</strong> rights is demanded and imposed primarily<br />

<strong>in</strong> cases of sex offences and fraud. 401 The <strong>in</strong>vestigati<strong>on</strong> also br<strong>in</strong>gs to light the fact that judges<br />

and public prosecutors are often unfamiliar with the possibilities for deprivati<strong>on</strong> of rights. In cases<br />

<strong>in</strong> which the Public Prosecuti<strong>on</strong> Service requested removal from the professi<strong>on</strong> or removal from<br />

office, this was granted <strong>in</strong> 88% of all sexual abuse cases (67 cases). This <strong>in</strong>vestigati<strong>on</strong> c<strong>on</strong>cerned<br />

sexual abuse cases <strong>in</strong> which removal from the professi<strong>on</strong> or removal from office was requested<br />

between 1995 and 2008. The same <strong>in</strong>vestigati<strong>on</strong> also revealed that hardly any checks take place <strong>on</strong><br />

whether the removal has been enforced. An explanati<strong>on</strong> for this is that it is hard to f<strong>in</strong>d judgments<br />

<strong>in</strong> which a removal has been imposed, as a result of which professi<strong>on</strong>al organisati<strong>on</strong>s are not often<br />

aware of this and therefore do not take appropriate measures. The Educati<strong>on</strong> Inspectorate carries<br />

out most checks for removals, <strong>in</strong> particular by means of the requirements for a Certificate of Good<br />

C<strong>on</strong>duct. 402 In sexual abuse cases, professi<strong>on</strong>s <strong>in</strong> the healthcare sector form the largest group for<br />

which the Public Prosecuti<strong>on</strong> Service demands removals and that these are imposed by the court. 403<br />

Exact figures regard<strong>in</strong>g the number of removals from a professi<strong>on</strong> <strong>in</strong> cases c<strong>on</strong>cern<strong>in</strong>g child pornography<br />

are not known. Restricti<strong>on</strong>s <strong>in</strong> terms of professi<strong>on</strong> and voluntary work are also imposed as a special c<strong>on</strong>diti<strong>on</strong><br />

<strong>on</strong> <strong>in</strong>dividuals c<strong>on</strong>victed <strong>in</strong> sexual abuse cases that also c<strong>on</strong>cern an <strong>in</strong>fr<strong>in</strong>gement of Article 240b<br />

of the Dutch Crim<strong>in</strong>al Code. This special c<strong>on</strong>diti<strong>on</strong> is then associated with a probati<strong>on</strong>ary period, dur<strong>in</strong>g<br />

which supervisi<strong>on</strong> can be exercised <strong>in</strong> order to determ<strong>in</strong>e compliance with this c<strong>on</strong>diti<strong>on</strong> (see §3.6.2). 404<br />

Another additi<strong>on</strong>al penalty that can be imposed is the c<strong>on</strong>fiscati<strong>on</strong> of objects, for example, which were<br />

used to help commit the offence. 405 It is often the case <strong>in</strong> child pornography cases that certa<strong>in</strong> objects<br />

are seized and that the court subsequently c<strong>on</strong>fiscates these. These objects can <strong>in</strong>clude computers, teleph<strong>on</strong>es<br />

and record<strong>in</strong>g equipment (see §3.5.4.2 below).<br />

‘Professi<strong>on</strong> or habit’ circumstance, which carries an <strong>in</strong>creased penalty<br />

Those who make a professi<strong>on</strong> of committ<strong>in</strong>g <strong>on</strong>e of the child pornography offences or those who make<br />

a habit of committ<strong>in</strong>g such offences can be sentenced to a higher penalty: a custodial sentence of a<br />

maximum of eight years or a f<strong>in</strong>e of the fifth category. 406 When does the situati<strong>on</strong> of ‘professi<strong>on</strong> or<br />
