2 The government agenda<br />
2.1 Introducti<strong>on</strong><br />
Chapter 1 states that when material c<strong>on</strong>stitut<strong>in</strong>g child pornography is discovered, it usually means<br />
that sexual violence aga<strong>in</strong>st children is tak<strong>in</strong>g place or has taken place: child abuse material is more<br />
than simply <strong>in</strong>formati<strong>on</strong> c<strong>on</strong>stitut<strong>in</strong>g a crim<strong>in</strong>al offence. The crim<strong>in</strong>alisati<strong>on</strong> of child pornography<br />
has its foundati<strong>on</strong>s <strong>in</strong> the protecti<strong>on</strong> of children from sexual abuse. <str<strong>on</strong>g>Child</str<strong>on</strong>g>ren need to be protected by<br />
putt<strong>in</strong>g an end to the abuse and by provid<strong>in</strong>g assistance. Although child abuse material is primarily<br />
of a digital nature, the offenders and victims exist <strong>in</strong> both the offl<strong>in</strong>e and <strong>on</strong>l<strong>in</strong>e worlds, mean<strong>in</strong>g<br />
that the phenomen<strong>on</strong> of child pornography has both analogue and digital comp<strong>on</strong>ents relat<strong>in</strong>g to a<br />
sexual offence.<br />
This chapter will focus <strong>on</strong> the policy <strong>in</strong>itiatives that are <strong>in</strong>tended to protect children from sexual<br />
violence, as well as up<strong>on</strong> the policy strategy for deal<strong>in</strong>g with child pornography. What is relevant<br />
here is the questi<strong>on</strong> as to what extent the digital comp<strong>on</strong>ent and the aspect child pornography play a<br />
role <strong>in</strong> (or is <strong>in</strong>tegrated <strong>in</strong>to) the policy for combat<strong>in</strong>g sexual violence aga<strong>in</strong>st children. Internati<strong>on</strong>al<br />
developments and events <strong>in</strong> other countries, and the extent to which these have <strong>in</strong>fluenced developments<br />
<strong>in</strong> terms of policy <strong>in</strong> the Netherlands, will be discussed. This chapter beg<strong>in</strong>s with an overview<br />
of policy developments <strong>in</strong> the Netherlands <strong>in</strong> the areas menti<strong>on</strong>ed above, and provides an <strong>in</strong>sight<br />
<strong>in</strong>to the measures that have been taken over the past decades, which, <strong>in</strong> part, form the foundati<strong>on</strong>s<br />
for the current policy. A number of relevant programmes that have s<strong>in</strong>ce come to an end (some of<br />
these were c<strong>on</strong>cluded some time ago now), could still serve as <strong>in</strong>spirati<strong>on</strong> for the policy that is to be<br />
developed today.<br />
Follow<strong>in</strong>g a descripti<strong>on</strong> of the developments that have taken place s<strong>in</strong>ce the early 1980s, the current<br />
policy agenda will be expla<strong>in</strong>ed, and the activities that the various m<strong>in</strong>istries are currently develop<strong>in</strong>g<br />
– <strong>in</strong>dividually or jo<strong>in</strong>tly, <strong>in</strong> a number of comb<strong>in</strong>ati<strong>on</strong>s – will be exam<strong>in</strong>ed <strong>in</strong> detail. The ma<strong>in</strong> idea<br />
beh<strong>in</strong>d this is that the task of tackl<strong>in</strong>g child pornography needs to be carried out from the perspective<br />
that children need to be protected from sexual violence. This not <strong>on</strong>ly comprises a task for the M<strong>in</strong>istry<br />
of Security and Justice <strong>in</strong> terms of combat<strong>in</strong>g child pornography, but also for other government bodies<br />
<strong>in</strong> terms of protect<strong>in</strong>g children. Policy with regard to measures for tackl<strong>in</strong>g child pornography needs<br />
to form an <strong>in</strong>tegrated comp<strong>on</strong>ent of the policy with regard to measures for combat<strong>in</strong>g sexual violence<br />
aga<strong>in</strong>st children. This does not therefore merely <strong>in</strong>volve (repressive) measures to tackle the producti<strong>on</strong>,<br />
distributi<strong>on</strong> and possessi<strong>on</strong> of child abuse material, but it also encompasses preventive measures. For<br />
example, policy that is directed towards the safe use of the Internet by children may also be able to have<br />
an <strong>in</strong>direct effect <strong>on</strong> prevent<strong>in</strong>g the producti<strong>on</strong> of child abuse images.
