In June 2011, the government stated <strong>in</strong> a letter to the House of Representatives that alternative methods<br />

of settl<strong>in</strong>g cases must be sought. This ma<strong>in</strong>ly c<strong>on</strong>cerns the possessi<strong>on</strong> of child abuse material. The<br />

dist<strong>in</strong>cti<strong>on</strong> between the different forms of c<strong>on</strong>duct is also relevant here. However, the rati<strong>on</strong>ale beh<strong>in</strong>d<br />

abolish<strong>in</strong>g or limit<strong>in</strong>g the possibility to impose a community service order (‘stricter sentenc<strong>in</strong>g’) does<br />

not seem to corresp<strong>on</strong>d with the alternative means of settlement which the Public Prosecuti<strong>on</strong> Service<br />

and (also) the government are seek<strong>in</strong>g, namely for those offences c<strong>on</strong>trary to Article 240b of the Dutch<br />

Crim<strong>in</strong>al Code which are relatively mild cases such as the possessi<strong>on</strong> of a small quantity of material<br />

where the suspect has not had any previous <strong>in</strong>volvement with the judiciary <strong>in</strong> this field.<br />

Not all child pornography cases are the same. C<strong>on</strong>sider<strong>in</strong>g the scope and complexity of some cases, it is<br />

necessary to c<strong>on</strong>sider whether this type of case should not also be made part of the remit of the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g><br />

Public Prosecutor’s Offices, so that the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Public Prosecutor’s Office can play a guid<strong>in</strong>g role <strong>in</strong><br />

extensive, complex and cross-border cases and can also be <strong>in</strong>volved <strong>in</strong> the development of <strong>in</strong>novative<br />

detecti<strong>on</strong> methods. At present, the prosecuti<strong>on</strong> of child pornography offences <strong>in</strong> the first <strong>in</strong>stance is<br />

carried out exclusively at district court public prosecutor’s offices.<br />

The handl<strong>in</strong>g of crim<strong>in</strong>al cases raises a number of –relatively – new questi<strong>on</strong>s with regard to identified<br />

victims of child pornography. This <strong>in</strong>volves victims who are, by def<strong>in</strong>iti<strong>on</strong>, particularly vulnerable, as<br />

they are always children. There is currently no statutory or other provisi<strong>on</strong> to guarantee the complete<br />

an<strong>on</strong>ymity of victims <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs <strong>in</strong> situati<strong>on</strong>s such as this, and as such to protect the identity<br />

and pers<strong>on</strong>al details of victims. The way <strong>in</strong> which this can be achieved, without this be<strong>in</strong>g c<strong>on</strong>trary<br />

to Article 6 of the European C<strong>on</strong>venti<strong>on</strong> of Human Rights, must be <strong>in</strong>vestigated. An important questi<strong>on</strong><br />

is how justice can also be d<strong>on</strong>e to victims when it is assumed that they will become victim time and time<br />

aga<strong>in</strong> as a result of the distributi<strong>on</strong> of child abuse material (revictimisati<strong>on</strong>), and what the c<strong>on</strong>sequences<br />

would be if it were possible for them to receive compensati<strong>on</strong>. This should be <strong>in</strong>vestigated <strong>in</strong> more detail.<br />

The judge <strong>in</strong> the Amsterdam sexual abuse case is expected to deliver a judgment <strong>in</strong> the near future<br />

regard<strong>in</strong>g the questi<strong>on</strong> as to whether parents of victims who are m<strong>in</strong>ors should be able to exercise the<br />

right to speak <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs <strong>on</strong> behalf of their child. S<strong>in</strong>ce July 2011, the State Secretary for<br />

Security and Justice has been prepar<strong>in</strong>g a legislative proposal <strong>in</strong> which the parents of children younger<br />

than twelve can exercise the right to speak <strong>on</strong> behalf of their child. Whether parents, as such, should be<br />

regarded as victims and whether they should, for example, also be granted the right to speak <strong>in</strong> this<br />

capacity – and not just as a representative of their child – should also be <strong>in</strong>vestigated.<br />

4.2.3.6 After-care and supervisi<strong>on</strong><br />

The opportunities to provide supervisi<strong>on</strong> that are presented <strong>in</strong> this report focus primarily <strong>on</strong> supervisi<strong>on</strong><br />

and after-care with<strong>in</strong> the judicial framework. This framework also has its limits. In the event that a custodial<br />

sentence is imposed with a term l<strong>on</strong>ger than four years, no part of this sentence may be suspended,<br />

and special c<strong>on</strong>diti<strong>on</strong>s cannot therefore be associated with this sentence. Supervisi<strong>on</strong> and after-care are<br />

therefore also not possible <strong>in</strong> this form. Supervisi<strong>on</strong> of a c<strong>on</strong>victed sex offender can also no l<strong>on</strong>ger be<br />

provided after executi<strong>on</strong> of the sentence. Unless placement under a hospital order has been imposed,<br />

if a c<strong>on</strong>victed perpetrator has served their sentence or if the c<strong>on</strong>diti<strong>on</strong>al release period has expired,<br />

it is not currently possible to enforce supervisi<strong>on</strong> and treatment with<strong>in</strong> a judicial framework. From a<br />

scientific po<strong>in</strong>t of view, it is regretted that there is no l<strong>on</strong>ger a compulsory framework for supervisi<strong>on</strong><br />

and treatment. It is also <strong>in</strong>terest<strong>in</strong>g that the State Secretary for Security and Justice has now <strong>in</strong>dicated<br />

the need to carry out research <strong>in</strong>to the possibility of extend<strong>in</strong>g life-l<strong>on</strong>g supervisi<strong>on</strong> to the supervisi<strong>on</strong><br />

of sex offenders who have completed their course of treatment under a hospital order.
