necessary from a preventive po<strong>in</strong>t of view. 513 In this c<strong>on</strong>text, the State Secretary for Security and Justice<br />

has <strong>in</strong>dicated the need to <strong>in</strong>vestigate whether it would be possible to extend the current supervisi<strong>on</strong><br />

to life-l<strong>on</strong>g supervisi<strong>on</strong> follow<strong>in</strong>g the completi<strong>on</strong> of treatment under placement under a hospital<br />

order. 514,515<br />

In Germany, a similar regulati<strong>on</strong> is already established <strong>in</strong> the law. Although it is a general rule that<br />

supervisi<strong>on</strong> can take place for a m<strong>in</strong>imum of two and a maximum of five years, 516 it appears that<br />

the possibility has been created for the court to provide supervisi<strong>on</strong> for an unlimited time if the<br />

c<strong>on</strong>victed perpetrator has committed a certa<strong>in</strong> sexual offence, such as the sexual abuse of children<br />

517 . The purpose of the law seems to be that this unlimited period of supervisi<strong>on</strong> can <strong>on</strong>ly be<br />

imposed by the court if the c<strong>on</strong>victed perpetrator has been sentenced to a custodial sentence for<br />

a m<strong>in</strong>imum of two years or has been placed <strong>in</strong> a psychiatric hospital or is be<strong>in</strong>g treated for addicti<strong>on</strong>.<br />

Furthermore, c<strong>on</strong>crete facts or <strong>in</strong>dicati<strong>on</strong>s must exist to suggest that without supervisi<strong>on</strong>,<br />

the c<strong>on</strong>victed perpetrator would represent a threat to society because he (or she) could be able to<br />

necessary to ga<strong>in</strong> greater <strong>in</strong>sight <strong>in</strong>to the target group of sex offenders for whom this order is <strong>in</strong>tended,<br />

and <strong>in</strong>to the possibilities for the implementati<strong>on</strong> of this supervisi<strong>on</strong>. For the purpose of the <strong>in</strong>tended<br />

legislative amendment, the Directie Sanctie- en Preventiebeleid (DSP) [Directorate for Sancti<strong>on</strong><strong>in</strong>g and Preventi<strong>on</strong><br />

Policy] and the Directie Wetgev<strong>in</strong>g (DW) [Directorate for Legislati<strong>on</strong>] have asked the Scientific<br />

Research and Documentati<strong>on</strong> Centre to provide an overview of various legal frameworks for life-l<strong>on</strong>g<br />

supervisi<strong>on</strong> such as those that have been designed <strong>in</strong> a number of other countries. Besides this, it is<br />

important to ga<strong>in</strong> <strong>in</strong>sight <strong>in</strong>to the scope and background characteristics of the group of sex offenders<br />

who were placed under a hospital order who were (recently) released <strong>in</strong>to society. In order to be able<br />

to arrive at an effective implementati<strong>on</strong> of the supervisi<strong>on</strong>, it is relevant to exam<strong>in</strong>e the methods of<br />

supervisi<strong>on</strong> and after-care that could be employed for the implementati<strong>on</strong> of life-l<strong>on</strong>g supervisi<strong>on</strong>.<br />
