<strong>in</strong>stead of ‘pornography’. After all, the word ‘pornography’ seems to suggest that it is glamoris<strong>in</strong>g<br />
the obscene c<strong>on</strong>tent <strong>in</strong> questi<strong>on</strong>. 146 This approach, which <strong>in</strong>volves plac<strong>in</strong>g the term ‘child<br />
pornography’ with<strong>in</strong> the c<strong>on</strong>text of abuse as much as possible, is also evident <strong>in</strong> the resp<strong>on</strong>se of<br />
the European Parliament to the proposal for a new EU directive to combat sexual abuse, sexual<br />
exploitati<strong>on</strong> of children and child pornography, submitted by the European Commissi<strong>on</strong> <strong>in</strong> 2010. 147<br />
<str<strong>on</strong>g>Child</str<strong>on</strong>g> pornography is also regarded as a ‘souvenir’ of the sexual humiliati<strong>on</strong>, molestati<strong>on</strong>, abuse<br />
or assault of a child, for example <strong>in</strong> the United States of America. 148 It is also referred to <strong>in</strong> terms<br />
of ‘child pornographic exploitati<strong>on</strong>’ <strong>in</strong> order to <strong>in</strong>dicate that child pornography c<strong>on</strong>cerns a form of<br />
child exploitati<strong>on</strong>. 149 F<strong>in</strong>ally, the literature also employs the terms ‘child exploitati<strong>on</strong> material 150 ’<br />
and ‘child erotica’ 151 for all material that is not child pornography as such but makes reference to<br />
children and also serves a sexual purpose for the user of this material.<br />
Legislati<strong>on</strong> <strong>in</strong> other countries<br />
<str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> legislati<strong>on</strong> c<strong>on</strong>cern<strong>in</strong>g child pornography varies between countries and certa<strong>in</strong>ly across the<br />
world. That <strong>in</strong>dicates that countries may view the phenomen<strong>on</strong> of child pornography <strong>on</strong> the Internet <strong>in</strong><br />
different ways, and may also have different views with regard to the severity and extent of this phenomen<strong>on</strong>.<br />
For example, accord<strong>in</strong>g to the Special <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> of the UN Human Rights Council, the manner<br />
of deal<strong>in</strong>g with aspects such as age limits and subjects such as virtual child abuse material and groom<strong>in</strong>g<br />
vary from country to country. 152 Because of the fact that the Internet provides a worldwide envir<strong>on</strong>ment<br />
for the distributi<strong>on</strong> of child abuse material, it is very important to achieve legal harm<strong>on</strong>isati<strong>on</strong> of legislati<strong>on</strong><br />
between countries and it is possible that the problem will become greater if countries do not<br />
tackle sexual exploitati<strong>on</strong> of children and child pornography. 153 An <strong>in</strong>itial exam<strong>in</strong>ati<strong>on</strong> of resp<strong>on</strong>ses to<br />
questi<strong>on</strong>naires from 45 countries of the Council of Europe <strong>in</strong> March 2011 also showed a number of gaps<br />
<strong>in</strong> nati<strong>on</strong>al legislati<strong>on</strong> with regard to child pornography. For example, some nati<strong>on</strong>al legislati<strong>on</strong> does<br />
not adequately def<strong>in</strong>e the various forms of sexual exploitati<strong>on</strong> of children, or the phras<strong>in</strong>g is too general,<br />
