As expla<strong>in</strong>ed <strong>in</strong> Chapter 1, the term ‘child pornography’ is not clear or unambiguous; neither <strong>in</strong> relati<strong>on</strong><br />
to perpetrators, abusive material c<strong>on</strong>cern<strong>in</strong>g children or victims, nor <strong>in</strong> relati<strong>on</strong> to c<strong>on</strong>duct. This<br />
means that <strong>in</strong>terventi<strong>on</strong>s can be equally unclear, as will be described <strong>on</strong> the basis of two problems that<br />
have been observed <strong>in</strong> relati<strong>on</strong> to offenders, namely the issue of offenders who have been c<strong>on</strong>victed for<br />
sexual violence aga<strong>in</strong>st children and who return to society <strong>in</strong> the same municipality or regi<strong>on</strong> where the<br />
offence was committed, and the problematic usage of the Internet by those who have been c<strong>on</strong>victed<br />
for view<strong>in</strong>g child abuse material. 510 On the basis of these po<strong>in</strong>ts, we will clarify the necessity for an<br />
<strong>in</strong>tegrated approach towards after-care and supervisi<strong>on</strong>, the elements of which this must c<strong>on</strong>sist, and<br />
the extent to which this is already the case <strong>in</strong> the Netherlands. Attenti<strong>on</strong> will also be paid to experiences<br />
<strong>in</strong> other countries which could be used as examples for the development of an <strong>in</strong>tegrated approach <strong>in</strong><br />
the Netherlands.<br />
The extent to which attenti<strong>on</strong> is paid to an <strong>in</strong>tegrated approach or to which an <strong>in</strong>tegrated approach is<br />
employed varies for each regi<strong>on</strong> and each authority. The f<strong>in</strong>d<strong>in</strong>gs from the Korpsm<strong>on</strong>itor 2010 also illustrate<br />
this po<strong>in</strong>t. Approximately half of all police regi<strong>on</strong>s seek cooperati<strong>on</strong> with authorities that provide<br />
help and treatment for suspects, such as Het Dok, De Waag, de Reclasser<strong>in</strong>g [the Probati<strong>on</strong> Service] and<br />
Algemeen Forensische Psychiatrie [General Forensic Psychiatry] (AFP), <strong>in</strong> the form of referral by the general<br />
practiti<strong>on</strong>er or judicial authorities. 511 Best practices <strong>in</strong> this regard need to be collected and promoted.<br />
Carry<strong>in</strong>g out research <strong>in</strong>to the desirability of an <strong>in</strong>tegrated framework regard<strong>in</strong>g c<strong>on</strong>victed perpetrators<br />
of sexual offenses aga<strong>in</strong>st children and the centralised directi<strong>on</strong> of this system, such as exists <strong>in</strong> the<br />
United K<strong>in</strong>gdom, will form part of the recommendati<strong>on</strong>s.<br />
3.6.2 Legal framework<br />
Various opportunities exist with<strong>in</strong> the legal framework to enable the provisi<strong>on</strong> of supervisi<strong>on</strong> to suspects<br />
and perpetrators of sexual abuse offences, <strong>in</strong>clud<strong>in</strong>g those <strong>in</strong>volv<strong>in</strong>g child pornography. It is also<br />
important to outl<strong>in</strong>e the legal possibilities that are available <strong>in</strong> so far as after-care is c<strong>on</strong>cerned. The opportunities<br />
to provide supervisi<strong>on</strong> that are presented <strong>in</strong> this secti<strong>on</strong> focus primarily <strong>on</strong> supervisi<strong>on</strong> and<br />
after-care with<strong>in</strong> the legal framework. This framework also has its limits. In the event that a custodial<br />
sentence is imposed with a term l<strong>on</strong>ger than four years, no part of this may be suspended, and special<br />
c<strong>on</strong>diti<strong>on</strong>s cannot therefore be associated with this. Supervisi<strong>on</strong> and after-care are therefore also not<br />
possible <strong>in</strong> this form. 512<br />
Supervisi<strong>on</strong> of a c<strong>on</strong>victed sex offender can also no l<strong>on</strong>ger be provided after executi<strong>on</strong> of the sentence.<br />
Experts have already stated <strong>in</strong> the past that given the current legal framework, it is not possible <strong>in</strong><br />
the Netherlands to extend a period of supervisi<strong>on</strong> <strong>in</strong> the event that a (treatment) <strong>in</strong>dicati<strong>on</strong> exists for<br />
this, and that special legislati<strong>on</strong> for the compulsory treatment and after-care of sex offenders seems<br />
