an <strong>in</strong>tegrated approach will be outl<strong>in</strong>ed. It is important to ga<strong>in</strong> an <strong>in</strong>sight <strong>in</strong>to – <strong>on</strong> the <strong>on</strong>e hand – the<br />

way <strong>in</strong> which the various regi<strong>on</strong>s can benefit from <strong>on</strong>e another’s knowledge and experience, and <strong>on</strong> the<br />

other hand, the steps that can be undertaken to ensure that a case is dealt with <strong>in</strong> a clear and <strong>in</strong>tegrated<br />

manner, br<strong>in</strong>g<strong>in</strong>g together the <strong>in</strong>terests of all parties <strong>in</strong>volved. Examples from other countries will also<br />

be discussed, which may be of benefit to the approach to be implemented <strong>in</strong> the Netherlands.<br />

3.6.3.1 Start<strong>in</strong>g po<strong>in</strong>ts<br />

The Acti<strong>on</strong> Plan to Tackle <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse states that the applicati<strong>on</strong> of crim<strong>in</strong>al law for tackl<strong>in</strong>g (sexual)<br />

abuse of children must be aimed at putt<strong>in</strong>g an immediate stop to the abuse, prevent<strong>in</strong>g re-offend<strong>in</strong>g<br />

by means of targeted <strong>in</strong>terventi<strong>on</strong>s, and restor<strong>in</strong>g the standard that has been breached. This cannot be<br />

achieved exclusively through punishment of the offender. The <strong>in</strong>terests of the child must be key. From<br />

this po<strong>in</strong>t of view, crim<strong>in</strong>al law may be implemented <strong>in</strong> order to guide offenders towards the use of assistance<br />

services for offenders. This may be achieved by impos<strong>in</strong>g special c<strong>on</strong>diti<strong>on</strong>s <strong>in</strong> the event of a<br />

suspended sentence or a c<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong> not to prosecute, or <strong>in</strong> the event of suspensi<strong>on</strong> of pre-trial<br />

detenti<strong>on</strong> (see §3.6.2 above). The crim<strong>in</strong>al law then functi<strong>on</strong>s as a deterrent. Applicati<strong>on</strong> of crim<strong>in</strong>al law<br />

is specifically applicable if the mental and/or physical <strong>in</strong>tegrity of the victim who is a m<strong>in</strong>or is seriously<br />

under threat, c<strong>on</strong>sider<strong>in</strong>g the nature of the harm (<strong>in</strong> any case <strong>in</strong> the event of grievous bodily harm) and/<br />

or the frequency (systematic nature) of the violence. Crim<strong>in</strong>al acti<strong>on</strong> is <strong>on</strong>e of the possible routes that<br />

can be taken follow<strong>in</strong>g the report<strong>in</strong>g of serious abuse, if necessary <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with <strong>on</strong>e of the other<br />

routes also be<strong>in</strong>g applied: voluntary or compulsory assistance (for child and perpetrator) or a child protecti<strong>on</strong><br />

measure. 559 The Center for Sex Offender Management (CSOM) <strong>in</strong> the United States formulated<br />

a number of start<strong>in</strong>g po<strong>in</strong>ts specifically for c<strong>on</strong>victed sex offenders, which l<strong>in</strong>k <strong>in</strong> with this noti<strong>on</strong> and<br />

should be applied to all phases of an <strong>in</strong>tegrated model, namely: specialised knowledge and tra<strong>in</strong><strong>in</strong>g,<br />

rais<strong>in</strong>g public awareness, m<strong>on</strong>itor<strong>in</strong>g and evaluati<strong>on</strong> and cooperati<strong>on</strong>. 560 In practice <strong>in</strong> the Netherlands,<br />

these start<strong>in</strong>g po<strong>in</strong>ts are represented <strong>in</strong>dividually <strong>in</strong> the form of various <strong>in</strong>itiatives. The importance of<br />

<strong>in</strong>terc<strong>on</strong>nectivity between all of the start<strong>in</strong>g po<strong>in</strong>ts, and the necessity of a central executive adm<strong>in</strong>istrati<strong>on</strong><br />

<strong>in</strong> order to enable an <strong>in</strong>tegrated approach, are especially evident <strong>in</strong> the establishment of the Safety<br />

Houses and scenario teams (see the box ‘Safety Houses’ at the end of this secti<strong>on</strong>).<br />

The Center for Sex Offender Management (CSOM) was founded <strong>in</strong> 1996. S<strong>in</strong>ce then, the Center<br />

has been develop<strong>in</strong>g and collect<strong>in</strong>g best practices from nati<strong>on</strong>al and local jurisdicti<strong>on</strong> <strong>in</strong> the United<br />

States. Besides this, the CSOM arranges tra<strong>in</strong><strong>in</strong>g sessi<strong>on</strong>s and provides technical assistance to all<br />

relevant actors who are <strong>in</strong>volved with after-care and supervisi<strong>on</strong> of sex offenders. Five start<strong>in</strong>g<br />

po<strong>in</strong>ts formulated by the CSOM for an <strong>in</strong>tegrated approach towards sex offenders, and related<br />

examples from practice <strong>in</strong> the Netherlands are outl<strong>in</strong>ed below.<br />

Focus <strong>on</strong> the victim<br />

When provid<strong>in</strong>g after-care and supervisi<strong>on</strong> to an offender, the victim must be taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong><br />

first of all. This means that the <strong>in</strong>terests of victims play a clear role <strong>in</strong> decisi<strong>on</strong>s regard<strong>in</strong>g the <strong>in</strong>terests<br />

of offenders. Strategies with regard to after-care and supervisi<strong>on</strong> should not overlook the requirements<br />

of victims, re-traumatise them or have a negative impact <strong>on</strong> them <strong>in</strong> any other way. This balanc<strong>in</strong>g of <strong>in</strong>terests<br />

can create troublesome dilemmas. The possibility exists – especially <strong>in</strong> cases where offenders are<br />
