Meldpunt K<strong>in</strong>derporno: government or no government?<br />
The years between 2002 and 2005 were characterised by a discussi<strong>on</strong> about the Meldpunt K<strong>in</strong>derporno op<br />
Internet [the Hotl<strong>in</strong>e Combat<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> <strong>on</strong> the Internet]. 50 A parliamentary questi<strong>on</strong> was<br />
asked as to whether the resp<strong>on</strong>sibility for a hotl<strong>in</strong>e combat<strong>in</strong>g child pornography should not be borne<br />
by the government. 51 The Hotl<strong>in</strong>e, launched <strong>in</strong> 1996 by Internet Service Providers, was and is a private<br />
foundati<strong>on</strong>. 52 In 2005, the M<strong>in</strong>isters for Justice and Ec<strong>on</strong>omic Affairs announced that they were launch<strong>in</strong>g<br />
their own Meldpunt Cybercrime, [Cyber Crime Report<strong>in</strong>g Website], al<strong>on</strong>gside the Hotl<strong>in</strong>e Combat<strong>in</strong>g<br />
<str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> <strong>on</strong> the Internet. This became operati<strong>on</strong>al <strong>in</strong> February 2006. Citizens could report<br />
child abuse material as well as terrorism to this hotl<strong>in</strong>e. The Hotl<strong>in</strong>e Combat<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> <strong>on</strong><br />
the Internet also rema<strong>in</strong>ed operati<strong>on</strong>al. By that time, citizens had two hotl<strong>in</strong>es at their disposal to which<br />
they could report. 53<br />
Evaluati<strong>on</strong> of the sexual offences legislati<strong>on</strong><br />
In 2006, an evaluati<strong>on</strong> of the tightened sexual offences legislati<strong>on</strong> was published; this evaluati<strong>on</strong> had<br />
been carried out <strong>on</strong> behalf of the M<strong>in</strong>istry of Justice. 54 The evaluati<strong>on</strong> report discussed the tightened<br />
sexual offences legislati<strong>on</strong> <strong>in</strong> general. <str<strong>on</strong>g>Child</str<strong>on</strong>g> pornography formed a part of this.<br />
Evaluati<strong>on</strong> of the sexual offences legislati<strong>on</strong><br />
In 2006, the amendments to the sexual offences legislati<strong>on</strong> from 2002 were evaluated, which led<br />
to the follow<strong>in</strong>g f<strong>in</strong>d<strong>in</strong>gs. Sentences for virtual child abuse material were hardly ever imposed,<br />
doubts arose as to the legitimacy of the crim<strong>in</strong>alisati<strong>on</strong> of this practice, and a lack of clarity<br />
emerged as to what exactly c<strong>on</strong>stituted ‘virtual child pornography’. 55 Cases <strong>in</strong>volv<strong>in</strong>g victims<br />
whose apparent age was between 16 and 18 years were not be<strong>in</strong>g pursued. This led to the questi<strong>on</strong><br />
of whether this group was unprotected. 56 ICT developments led to problems for detecti<strong>on</strong>.<br />
Digital methods of detecti<strong>on</strong> were necessary <strong>in</strong> order to supplement the traditi<strong>on</strong>al methods.<br />
The level of knowledge possessed by the police and the Public Prosecuti<strong>on</strong> Service, as well as<br />
the judiciary, needed to be <strong>in</strong>creased. 57 The number of cases reported <strong>in</strong>creased. The likelihood<br />
of prosecuti<strong>on</strong> and trial for offences that fell under Article 140b of the Dutch Crim<strong>in</strong>al Code <strong>in</strong>creased.<br />
There were fewer decisi<strong>on</strong>s not to prosecute by reas<strong>on</strong> of unlikelihood of c<strong>on</strong>victi<strong>on</strong>,<br />
and fewer acquittals. A number of problems <strong>in</strong> terms of evidence, such as the requirement that<br />
the victims must be apparently under sixteen years of age, were solved by <strong>in</strong>creas<strong>in</strong>g the age. The<br />
general c<strong>on</strong>clusi<strong>on</strong> was that the revised child pornography stipulati<strong>on</strong> had reduced problems <strong>in</strong><br />
