S<strong>in</strong>ce the block<strong>in</strong>g of child abuse material <strong>in</strong> the Netherlands was not implemented, the Internet Safety<br />

Platform no l<strong>on</strong>ger has an active work<strong>in</strong>g group that promotes public-private partnerships <strong>in</strong> the field<br />

of child pornography. It follows from §3.8.3 that this does not mean that the parties cited above – the<br />

government, <strong>in</strong>termediate-level social organisati<strong>on</strong>s and the private sector – are not currently develop<strong>in</strong>g<br />

any PPS <strong>in</strong>itiatives or are not able to do so.<br />

Challenges faced by public-private sector partnerships<br />

Public-private sector partnerships provide opportunities to tackle child pornography, but also face challenges<br />

that prompt a clearer distributi<strong>on</strong> of resp<strong>on</strong>sibilities, tasks and competences. The relevance of<br />

recognis<strong>in</strong>g and acknowledg<strong>in</strong>g the <strong>in</strong>terests of the <strong>in</strong>volved parties <strong>in</strong> order to arrive at effective publicprivate<br />

sector partnerships comes to the fore above. 784 In the case of child pornography, this <strong>in</strong>volves<br />

vulnerable victims, calculat<strong>in</strong>g offenders and material that c<strong>on</strong>stitutes a crim<strong>in</strong>al offence. This means<br />

that public-private sector partnerships are <strong>on</strong>ly possible after carefully assess<strong>in</strong>g all relevant <strong>in</strong>terests,<br />

whereby the <strong>in</strong>terest of the victim must be paramount. The appo<strong>in</strong>tment of community and security<br />

managers at various Internet companies and collaborati<strong>on</strong>s with the police <strong>in</strong> the event of abuse illustrate<br />

that this is actually tak<strong>in</strong>g place <strong>in</strong> practice. Each time, a new assessment must be made as to<br />

which tasks that strictly lie with<strong>in</strong> the governmental doma<strong>in</strong> would be suitable for a shared resp<strong>on</strong>sibility<br />

with<strong>in</strong> public-private sector partnerships, or for transferr<strong>in</strong>g resp<strong>on</strong>sibility to private partners. Police<br />

surveillance <strong>on</strong> Habbo (see box §3.8.3.1 and the Internet Safety Platform are examples of <strong>in</strong>stances where<br />

the government is actively <strong>in</strong>vest<strong>in</strong>g <strong>in</strong> its own digital knowledge and resources. Such <strong>in</strong>vestment also<br />

applies to the safeguard<strong>in</strong>g of the fundamental rights of Internet users. Not <strong>on</strong>ly civil rights organisati<strong>on</strong>s<br />

and the academic world have referred to this po<strong>in</strong>t, 785 but this is also an explicit request of the government<br />

itself with regard to the combat<strong>in</strong>g of Internet-related offences. 786 Wherever the governmental<br />

tasks are left to self-regulat<strong>in</strong>g capacity of the private sector, the role of the government as the party that<br />

bears ultimate resp<strong>on</strong>sibility must exert a guid<strong>in</strong>g <strong>in</strong>fluence. 787<br />

3.8.3 C<strong>on</strong>crete (acti<strong>on</strong>s of) public-private sector partnerships<br />

In this sub-secti<strong>on</strong>, various <strong>in</strong>terventi<strong>on</strong>s undertaken by public-private sector partnerships, which <strong>in</strong>volve<br />

the preventi<strong>on</strong> and/or combat<strong>in</strong>g of digital child abuse material, will be discussed. However, as<br />

shown <strong>in</strong> the ‘<str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Cyber Security Strategy’ box below, it emerges that public-private sector partnerships<br />

also exist <strong>in</strong> other fields that are relevant to the issue of tackl<strong>in</strong>g child pornography.<br />

<str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Cyber Security Strategy<br />

In February 2011, the impetus was given to form a <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Cyber Security Strategy (NCSS), <strong>on</strong>e<br />

of the ma<strong>in</strong> po<strong>in</strong>ts of which was that “child pornography must be tackled by public and private<br />
