The phenomen<strong>on</strong> of child pornography<br />

years’ impris<strong>on</strong>ment if an offender makes a habit of committ<strong>in</strong>g an act described <strong>in</strong> Article 240b of the<br />

Dutch Crim<strong>in</strong>al Code. 166 In additi<strong>on</strong>, the (apparent) age limit of potential victims has been raised from<br />

sixteen to eighteen years of age.<br />

The text of Article 240b of the Dutch Crim<strong>in</strong>al Code reads as follows:<br />

- A custodial sentence of up to four years or a f<strong>in</strong>e of category five shall be imposed up<strong>on</strong> an <strong>in</strong>dividual<br />

who distributes, offers, openly exhibits, produces, imports, c<strong>on</strong>veys, exports, acquires or has possessi<strong>on</strong><br />

of an image, or a data storage medium c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g an image, of sexual c<strong>on</strong>duct <strong>in</strong> which<br />

some<strong>on</strong>e who has apparently not yet reached the age of eighteen years is <strong>in</strong>volved or is apparently<br />

<strong>in</strong>volved, or who obta<strong>in</strong>s access to such material by means of a computer system or us<strong>in</strong>g a communicati<strong>on</strong>s<br />

service.<br />

- A custodial sentence of up to eight years or a f<strong>in</strong>e of category five shall be imposed up<strong>on</strong> an <strong>in</strong>dividual<br />

who makes a professi<strong>on</strong> from or a habit of committ<strong>in</strong>g <strong>on</strong>e of the offences described <strong>in</strong> paragraph <strong>on</strong>e.<br />

However, the custodial sentences stipulated <strong>in</strong> Article 240b of the Dutch Crim<strong>in</strong>al Code may be <strong>in</strong>creased<br />

by <strong>on</strong>e third <strong>in</strong> the event that the offence is committed by two or more pers<strong>on</strong>s act<strong>in</strong>g <strong>in</strong> c<strong>on</strong>cert, or <strong>in</strong><br />

the event that the offence is committed <strong>in</strong> a relati<strong>on</strong>ship of dependency. In the event that the offence<br />

results <strong>in</strong> serious physical <strong>in</strong>jury or threatens the life of another <strong>in</strong>dividual, a custodial sentence of up<br />

to 15 years or a f<strong>in</strong>e of category five may be imposed. If an offence as described <strong>in</strong> Article 240b of the<br />

Dutch Crim<strong>in</strong>al Code causes death, such an offence carries a custodial sentence of up to 18 years or a f<strong>in</strong>e<br />

of category five. 167 A community service order may also be imposed <strong>in</strong> place of a custodial sentence. 168<br />

Sentences and orders that are imposed may also be suspended. 169<br />

169 A suspended sentence or order offers opportunities to work <strong>on</strong> behaviour modificati<strong>on</strong> and therefore<br />

to prevent any recidivism. However, that depends not so much <strong>on</strong> the durati<strong>on</strong> of the suspended<br />

custodial sentence, for example, but actually up<strong>on</strong> the durati<strong>on</strong> of the probati<strong>on</strong>ary period, which<br />

is generally two years. Dur<strong>in</strong>g the probati<strong>on</strong>ary period, the pers<strong>on</strong> c<strong>on</strong>victed must comply with the<br />

special c<strong>on</strong>diti<strong>on</strong>s, and is subject to supervisi<strong>on</strong> by the probati<strong>on</strong> and after-care service. The threat of<br />

the suspended sentence be<strong>in</strong>g executed <strong>in</strong> the event of failure to comply with the special c<strong>on</strong>diti<strong>on</strong>s<br />

serves as a deterrent. The special c<strong>on</strong>diti<strong>on</strong>s that may be imposed as part of suspended sentences will<br />

be exam<strong>in</strong>ed <strong>in</strong> greater detail <strong>in</strong> §3.6.2.<br />
