3.5.6 C<strong>on</strong>clusi<strong>on</strong><br />
Implementati<strong>on</strong><br />
<str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Public Prosecutor’s Office<br />
At present, the prosecuti<strong>on</strong> of child pornography offences <strong>in</strong> first <strong>in</strong>stance is carried out exclusively<br />
at district court public prosecutor’s offices. C<strong>on</strong>sider<strong>in</strong>g the scope and complexity of some cases, it is<br />
necessary to c<strong>on</strong>sider whether this type of case should not also be made part of the remit of the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g><br />
Public Prosecutor’s Office, so that the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Public Prosecutor’s Office can play a guid<strong>in</strong>g role <strong>in</strong><br />
extensive, complex and cross-border cases and can also be <strong>in</strong>volved <strong>in</strong> the development of <strong>in</strong>novative<br />
detecti<strong>on</strong> methods.<br />
Diversity of c<strong>on</strong>duct which c<strong>on</strong>stitutes a crim<strong>in</strong>al offence<br />
Article 240b of the Dutch Crim<strong>in</strong>al Code covers various forms of c<strong>on</strong>duct, rang<strong>in</strong>g from ga<strong>in</strong><strong>in</strong>g access to<br />
and possessi<strong>on</strong> of child abuse material to the producti<strong>on</strong> and distributi<strong>on</strong> thereof. The formulati<strong>on</strong> of<br />
the secti<strong>on</strong> of the law does not, from the statistical material, lay out how prosecuti<strong>on</strong> and trial relate to<br />
the various forms of c<strong>on</strong>duct. A formulati<strong>on</strong> c<strong>on</strong>sist<strong>in</strong>g of various categories should be taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong>.<br />
It is possible that the new forthcom<strong>in</strong>g EU Guidel<strong>in</strong>e provides occasi<strong>on</strong> for re-exam<strong>in</strong>ati<strong>on</strong><br />
of the formulati<strong>on</strong> of the current provisi<strong>on</strong> of penalties.<br />
Determ<strong>in</strong>ati<strong>on</strong> of the punishment<br />
The above dist<strong>in</strong>cti<strong>on</strong> is also relevant for the process of impos<strong>in</strong>g sentences. In practice, the court usually<br />
imposes a suspended custodial sentence <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with a community service order. From the<br />
figures, there appears to be a clear tendency towards impos<strong>in</strong>g more severe sentences: the proporti<strong>on</strong><br />
of n<strong>on</strong>-suspended or partially suspended custodial sentences <strong>in</strong>creased <strong>in</strong> the period between 2006 and<br />
2010 and <strong>in</strong> 2010, a community service order was imposed less often as the ma<strong>in</strong> sentence. At present,<br />
it is still unclear if, and to what extent, the possibilities for impos<strong>in</strong>g community service orders will be<br />
limited <strong>in</strong> the future for cases <strong>in</strong>volv<strong>in</strong>g a breach of Article 240b of the Dutch Crim<strong>in</strong>al Code. Limit<strong>in</strong>g<br />
the possibilities to impose a community service order, particularly if this would no l<strong>on</strong>ger be possible<br />
<strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with suspended sentences, would <strong>in</strong> any case provide courts with fewer opportunities<br />
to tailor the sentence to the <strong>in</strong>dividual case. In this c<strong>on</strong>text, possibilities for <strong>in</strong>fluenc<strong>in</strong>g behaviour by<br />
means of supervisi<strong>on</strong> <strong>on</strong> the basis of c<strong>on</strong>diti<strong>on</strong>s imposed for a suspended prosecuti<strong>on</strong>, for example,<br />
must also be taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong>.<br />
Alternative means of settlement<br />
In June 2011, the government stated <strong>in</strong> a letter to the Lower House that other methods of settl<strong>in</strong>g cases<br />
must be sought. This ma<strong>in</strong>ly c<strong>on</strong>cerns the possessi<strong>on</strong> of child abuse material. The dist<strong>in</strong>cti<strong>on</strong> between<br />
the different forms of c<strong>on</strong>duct is also relevant here. However, the rati<strong>on</strong>ale beh<strong>in</strong>d abolish<strong>in</strong>g or limit<strong>in</strong>g<br />
the possibility to impose a community service order (‘stricter sentenc<strong>in</strong>g’) does not seem to corresp<strong>on</strong>d<br />
with the alternative means of settlement which the Public Prosecuti<strong>on</strong> Service and (also) the government<br />
are seek<strong>in</strong>g, namely for those offences c<strong>on</strong>trary to Article 240b of the Dutch Crim<strong>in</strong>al Code which are<br />
relatively mild cases, such as the possessi<strong>on</strong> of a small quantity of material where the suspect has not<br />
had any previous <strong>in</strong>volvement with judiciary <strong>in</strong> this field.<br />
Victims <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs<br />
The handl<strong>in</strong>g of crim<strong>in</strong>al cases with regard to identified victims of child pornography raises a number<br />
of – relatively – new questi<strong>on</strong>s. In additi<strong>on</strong>, the issue <strong>in</strong>volves victims who are, by def<strong>in</strong>iti<strong>on</strong>, particularly<br />
vulnerable, as they are always children. There is currently no statutory or other provisi<strong>on</strong> to<br />
