Article 240b of the Dutch Crim<strong>in</strong>al Code, other special c<strong>on</strong>diti<strong>on</strong>s can be imposed, such as not be<strong>in</strong>g<br />
allowed to carry out (voluntary) work aimed at children, not be<strong>in</strong>g permitted to affiliate with a scout<strong>in</strong>g<br />
organisati<strong>on</strong>, not be<strong>in</strong>g allowed to use social network<strong>in</strong>g sites to approach m<strong>in</strong>ors 533 and not be<strong>in</strong>g allowed<br />
to give s<strong>in</strong>g<strong>in</strong>g or piano less<strong>on</strong>s at home. 534 Judgments have also been known <strong>in</strong> which a c<strong>on</strong>victed<br />
perpetrator has had to make a c<strong>on</strong>tributi<strong>on</strong> to ECPAT. In <strong>on</strong>e of these cases, a suspect was sentenced to<br />
a community service order of 240 hours and a suspended custodial sentence with a term of six m<strong>on</strong>ths,<br />
with a probati<strong>on</strong>ary period of three years for the possessi<strong>on</strong> of child abuse material. Because the court<br />
judged that a work<strong>in</strong>g order and a suspended custodial sentence would not suffice, it imposed the special<br />
c<strong>on</strong>diti<strong>on</strong> for the suspended custodial sentence, am<strong>on</strong>gst others, that the suspect must “be forced to<br />
transfer a sum of 5,000 euros to Defence for <str<strong>on</strong>g>Child</str<strong>on</strong>g>ren-ECPAT <strong>in</strong> Amsterdam.” 535<br />
In cases <strong>in</strong>volv<strong>in</strong>g child pornography, some judgments are also known <strong>in</strong> which a computer ban or <strong>in</strong>ternet<br />
m<strong>on</strong>itor<strong>in</strong>g has been imposed as a special c<strong>on</strong>diti<strong>on</strong>. 536 These are drastic measures. In <strong>on</strong>e case that<br />
stood before the Court of Zutphen, the Public Prosecuti<strong>on</strong> Service requested the special c<strong>on</strong>diti<strong>on</strong> that<br />
the police would be able to digitally <strong>in</strong>spect the data storage media of the suspect at any time, but the<br />
court chose not to follow this request: “In view of the implementati<strong>on</strong> of this <strong>in</strong> practice and the possible<br />
breach of fundamental rights associated with this, the court rules that there are too many objecti<strong>on</strong>s.”<br />
However, the court was of the op<strong>in</strong>i<strong>on</strong> that the same effect could be achieved by impos<strong>in</strong>g the special<br />
c<strong>on</strong>diti<strong>on</strong> that the suspect would have to comply with the <strong>in</strong>structi<strong>on</strong>s from probati<strong>on</strong> and after-care<br />
services. In this case, the suspect was placed under a c<strong>on</strong>diti<strong>on</strong>al order, <strong>in</strong>clud<strong>in</strong>g the c<strong>on</strong>diti<strong>on</strong> that he<br />
would not be allowed to have possessi<strong>on</strong> of a computer, unless approval for this was granted first. 537<br />
The right to access the Internet is also the subject of discussi<strong>on</strong> with<strong>in</strong> the European Uni<strong>on</strong>. Complete<br />
prohibiti<strong>on</strong> of access to the Internet should <strong>on</strong>ly be permitted if this is ‘appropriate, proporti<strong>on</strong>ate<br />
and necessary with<strong>in</strong> a democratic society’, 538 and must specifically respect the pre-<br />
