Implementati<strong>on</strong><br />
<strong>in</strong>g child pornography. Based <strong>on</strong> this, the Court was able to determ<strong>in</strong>e that the suspect “made a<br />
habit,” as referred to <strong>in</strong> Article 240b of the Dutch Crim<strong>in</strong>al Code, of possess<strong>in</strong>g those images and<br />
data storage media, with<strong>in</strong> the mean<strong>in</strong>g of the sec<strong>on</strong>d Paragraph of that stipulati<strong>on</strong>.’ 413<br />
In his c<strong>on</strong>clusi<strong>on</strong>, the Advocate-General Vell<strong>in</strong>ga states, am<strong>on</strong>gst other th<strong>in</strong>gs, that possessi<strong>on</strong> is a<br />
c<strong>on</strong>diti<strong>on</strong> that does not lend itself to plurality, but that the habitual possessi<strong>on</strong> of an image or data<br />
storage medium may already exist <strong>in</strong> the possessi<strong>on</strong> of multiple abusive images or multiple data<br />
storage media with (a) child pornography image(s). The designati<strong>on</strong> as a habit can also be revealed<br />
through the durati<strong>on</strong> of the possessi<strong>on</strong> or the way <strong>in</strong> which possessi<strong>on</strong> came about. It may be the case<br />
that the suspect collected the images bit by bit and that he therefore came <strong>in</strong>to possessi<strong>on</strong> of more and<br />
more new images, thereby <strong>in</strong>dicat<strong>in</strong>g that he made a habit out of collect<strong>in</strong>g, and therefore possess<strong>in</strong>g<br />
abusive images; accord<strong>in</strong>g to the Advocate-General loc. cit., the evidence employed c<strong>on</strong>cludes that the<br />
suspect collected the multimedia files c<strong>on</strong>cerned <strong>in</strong> parts. 41,213 multimedia files were discovered <strong>in</strong><br />
this case, stored <strong>on</strong> a large number of different media. Stor<strong>in</strong>g that amount of data cannot happen at<br />
<strong>on</strong>ce, neither tak<strong>in</strong>g <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> the number of multimedia files nor tak<strong>in</strong>g <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong><br />
the fact that these were stored <strong>on</strong> various media. From the evidence put forward, it was therefore<br />
decided that the suspect did not take possessi<strong>on</strong> of the files all at <strong>on</strong>ce, accord<strong>in</strong>g to the Advocate-<br />
General. The proven facts – mak<strong>in</strong>g a habit – can therefore be deduced from the evidence employed<br />
al<strong>on</strong>e. Mak<strong>in</strong>g a habit of possessi<strong>on</strong> of child abuse material can also be proven by the circumstance<br />
that the suspect not <strong>on</strong>ly collected those images, but also organised them. By occupy<strong>in</strong>g himself with<br />
his possessi<strong>on</strong> <strong>in</strong> such a way, the suspect expresses that he not <strong>on</strong>ly obta<strong>in</strong>ed and saved images from<br />
the Internet, but that by organis<strong>in</strong>g his collecti<strong>on</strong>, he accentuated the c<strong>on</strong>t<strong>in</strong>uati<strong>on</strong> of the possessi<strong>on</strong>,<br />
thereby keep<strong>in</strong>g it alive, certa<strong>in</strong>ly when tak<strong>in</strong>g <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> the extent of the collecti<strong>on</strong> and the<br />
time that it must have taken to organise the collecti<strong>on</strong>, accord<strong>in</strong>g to the Advocate-General.<br />
A sentence for professi<strong>on</strong> or habit can also be imposed if it c<strong>on</strong>cerns possessi<strong>on</strong> of, for example, 100,000<br />
images al<strong>on</strong>e or download<strong>in</strong>g images repeatedly over a certa<strong>in</strong> period of time.<br />
Public Prosecuti<strong>on</strong> Service Guidel<strong>in</strong>es for Demands<br />
The Crim<strong>in</strong>al Procedure Guidel<strong>in</strong>es <strong>in</strong> cases c<strong>on</strong>cern<strong>in</strong>g child pornography (here<strong>in</strong>after: the Guidel<strong>in</strong>es) 414<br />
provide a framework for the Public Prosecuti<strong>on</strong> Service for the formulati<strong>on</strong> of demands. As a start<strong>in</strong>g po<strong>in</strong>t,<br />
both the Guidel<strong>in</strong>es as well as the Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography adopt the view<br />
that it is necessary to protect both the child who is directly <strong>in</strong>volved <strong>in</strong> the producti<strong>on</strong> of child abuse material,<br />
as well as children <strong>in</strong> general. This applies to children <strong>in</strong> the Netherlands, but also to those abroad. A<br />
large amount of material is produced <strong>in</strong> countries where this can take place with very little risk, and this is<br />
subsequently distributed, certa<strong>in</strong>ly by means of the Internet, all over the world <strong>in</strong> a very short period of time.<br />
In additi<strong>on</strong> to the dist<strong>in</strong>cti<strong>on</strong> that is made between possessi<strong>on</strong>, distributi<strong>on</strong> and producti<strong>on</strong> of child abuse<br />
material, which each carry their own sentence <strong>in</strong> the Guidel<strong>in</strong>es, these Guidel<strong>in</strong>es also take account of three<br />
specific factors: the nature of the images, the age of the victims, and the period of time dur<strong>in</strong>g which the<br />
activities took place. When tak<strong>in</strong>g account of the nature of the images, the poses of the children are relevant,<br />
as is the questi<strong>on</strong> as to whether the images show acts of sexual abuse, actual penetrati<strong>on</strong> or photos that are<br />
