From 1993-1994, a change took place with regard to how child pornography was viewed. The House of<br />

Representatives called for adequate acti<strong>on</strong> to be taken. The approach at that time was ma<strong>in</strong>ly based <strong>on</strong><br />

crim<strong>in</strong>al provisi<strong>on</strong>s other than the Article aga<strong>in</strong>st child pornography, because the law made the necessary<br />

coercive measures possible for those offences, which were not permitted by virtue of Article 240b<br />

of the Dutch Crim<strong>in</strong>al Code. 16 Furthermore, detecti<strong>on</strong> and prosecuti<strong>on</strong> was (and is) particularly labour<strong>in</strong>tensive,<br />

which was not proporti<strong>on</strong>ate to the low sentence carried by the offence at the time, namely a<br />

custodial sentence of three m<strong>on</strong>ths. Detecti<strong>on</strong> was therefore assigned a low priority. 17 Article 240b of the<br />

Dutch Crim<strong>in</strong>al Code was amended <strong>in</strong> 1996: the custodial sentence carried by the offence was <strong>in</strong>creased<br />

from a period of three m<strong>on</strong>ths to four years. Furthermore, <strong>in</strong> order to be able to combat the commercial<br />

trade <strong>in</strong> child abuse material more effectively, the Article was supplemented by a clause regard<strong>in</strong>g the<br />

penalizati<strong>on</strong> of <strong>in</strong>dividuals who make a habit or professi<strong>on</strong> of committ<strong>in</strong>g the crim<strong>in</strong>al offences. In additi<strong>on</strong><br />

to this, a step was taken towards mak<strong>in</strong>g the simple possessi<strong>on</strong> of child abuse material a crim<strong>in</strong>al<br />

offence. Up until then, this had not c<strong>on</strong>stituted a crim<strong>in</strong>al offence. 18<br />

In the meantime, an <strong>in</strong>creas<strong>in</strong>g number of <strong>in</strong>itiatives were be<strong>in</strong>g carried out <strong>in</strong> order to keep up with<br />

<strong>on</strong>l<strong>in</strong>e developments. In 1996, the Meldpunt K<strong>in</strong>derporno op Internet [Hotl<strong>in</strong>e Combat<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g><br />

<strong>on</strong> the Internet] was launched. 19 Material c<strong>on</strong>stitut<strong>in</strong>g child pornography that had been discovered <strong>on</strong>l<strong>in</strong>e<br />

<strong>on</strong> a specific website or <strong>in</strong> a certa<strong>in</strong> message could be reported by c<strong>on</strong>tact<strong>in</strong>g the Hotl<strong>in</strong>e. Computer<br />

specialists were employed at the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Crim<strong>in</strong>al Intelligence Service, and <strong>in</strong>ter-regi<strong>on</strong>al teams specialis<strong>in</strong>g<br />

<strong>in</strong> computer crime were also active <strong>in</strong> this field. L<strong>in</strong>ks were then established with other specialists,<br />

such as those specialis<strong>in</strong>g <strong>in</strong> cases c<strong>on</strong>cern<strong>in</strong>g sexual offences, who were employed as <strong>in</strong>vestigators at<br />

regi<strong>on</strong>al police forces. In the op<strong>in</strong>i<strong>on</strong> of the M<strong>in</strong>ister of Justice, the resp<strong>on</strong>sibility for enforc<strong>in</strong>g legislati<strong>on</strong><br />

relat<strong>in</strong>g to public decency <strong>on</strong> the Internet should form part of ord<strong>in</strong>ary crim<strong>in</strong>al <strong>in</strong>vestigati<strong>on</strong>s. 20<br />

<str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> and <str<strong>on</strong>g>Child</str<strong>on</strong>g> Prostituti<strong>on</strong> Work<strong>in</strong>g Group<br />

The first World C<strong>on</strong>gress aga<strong>in</strong>st Commercial Sexual Exploitati<strong>on</strong> of <str<strong>on</strong>g>Child</str<strong>on</strong>g>ren <strong>in</strong> Stockholm (Sweden)<br />

<strong>in</strong> September 1996 and the unrest surround<strong>in</strong>g the Dutroux case <strong>in</strong> Belgium <strong>in</strong> 1996 c<strong>on</strong>stituted reas<strong>on</strong><br />

for additi<strong>on</strong>al attenti<strong>on</strong> to be devoted to combat<strong>in</strong>g child pornography and the sexual exploitati<strong>on</strong> of<br />

children. 21 Towards the end of 1996, two meet<strong>in</strong>gs took place, result<strong>in</strong>g <strong>in</strong> the formati<strong>on</strong> of the <str<strong>on</strong>g>Child</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Pornography</str<strong>on</strong>g> and <str<strong>on</strong>g>Child</str<strong>on</strong>g> Prostituti<strong>on</strong> Work<strong>in</strong>g Group. 22 The work<strong>in</strong>g group c<strong>on</strong>sisted of experts from<br />

the police, judicial authorities, <strong>in</strong>stituti<strong>on</strong>s provid<strong>in</strong>g assistance and research <strong>in</strong>stituti<strong>on</strong>s, and it was<br />

apparent that it had a great deal of practical experience with the issue of child pornography and child<br />
