Implementati<strong>on</strong><br />
C<strong>on</strong>diti<strong>on</strong>s<br />
When suspended sentences are imposed, general 528 c<strong>on</strong>diti<strong>on</strong>s are then imposed, and special c<strong>on</strong>diti<strong>on</strong>s<br />
that are l<strong>in</strong>ked to an associated probati<strong>on</strong>ary period may also be imposed. Dur<strong>in</strong>g the probati<strong>on</strong>ary period,<br />
the c<strong>on</strong>victed perpetrator must comply with the special c<strong>on</strong>diti<strong>on</strong>s, and is subject to probati<strong>on</strong> and after-care<br />
supervisi<strong>on</strong>. The list of possible special c<strong>on</strong>diti<strong>on</strong>s available under the law is n<strong>on</strong>-exhaustive. In practice,<br />
the behavioural c<strong>on</strong>diti<strong>on</strong> 529 is employed, am<strong>on</strong>gst other th<strong>in</strong>gs, for the enforcement of a street ban, the<br />
enforcement of outpatient treatment and compliance with <strong>in</strong>structi<strong>on</strong>s from probati<strong>on</strong> and after-care <strong>in</strong> a<br />
general sense. Instructi<strong>on</strong> from probati<strong>on</strong> and after-care services can also <strong>in</strong>clude outpatient treatment, such<br />
as attend<strong>in</strong>g a day programme at a cl<strong>in</strong>ic or undergo<strong>in</strong>g treatment at a department of the Netherlands Institute<br />
for Psychological Care and Addicti<strong>on</strong> Care, <strong>in</strong> so far as and for as l<strong>on</strong>g as the probati<strong>on</strong> and after-care staff<br />
c<strong>on</strong>siders this to be necessary. 530 An obligati<strong>on</strong> to undergo such treatment can therefore either be <strong>in</strong>cluded<br />
<strong>in</strong> the judgment itself, or can be left to the probati<strong>on</strong> and after-care services for further implementati<strong>on</strong>.<br />
Term of probati<strong>on</strong>ary period<br />
The maximum term of the probati<strong>on</strong>ary period for a suspended sentence is two years for the special<br />
c<strong>on</strong>diti<strong>on</strong>s relat<strong>in</strong>g to bail and the behavioural c<strong>on</strong>diti<strong>on</strong>. For all other c<strong>on</strong>diti<strong>on</strong>s (payment of damages,<br />
admissi<strong>on</strong> to a care <strong>in</strong>stituti<strong>on</strong> and pay<strong>in</strong>g a sum of m<strong>on</strong>ey <strong>in</strong>to the Crim<strong>in</strong>al Injuries Compensati<strong>on</strong><br />
Fund), the maximum term of the probati<strong>on</strong>ary period is three years. S<strong>in</strong>ce the Maximum Sentences (Renew)<br />
Act entered <strong>in</strong>to force <strong>on</strong> 1 February 2006, a probati<strong>on</strong>ary period with a maximum term of ten years<br />
may be imposed <strong>in</strong> certa<strong>in</strong> cases for all c<strong>on</strong>diti<strong>on</strong>s, <strong>in</strong> the event that it is necessary to seriously take <strong>in</strong>to<br />
account the likelihood that the c<strong>on</strong>victed perpetrator will <strong>on</strong>ce aga<strong>in</strong> commit an offence that is directed<br />
towards, or will present a risk to, the physical <strong>in</strong>violability of <strong>on</strong>e or more pers<strong>on</strong>s. 531 This possibility has<br />
been <strong>in</strong>cluded <strong>in</strong> the law <strong>in</strong> order to be able to m<strong>on</strong>itor the c<strong>on</strong>victed perpetrator for a l<strong>on</strong>ger period<br />
of time, for example <strong>in</strong> certa<strong>in</strong> cases of sexual abuse or for cases <strong>in</strong>volv<strong>in</strong>g offenders with psychological<br />
disturbances. This l<strong>on</strong>g probati<strong>on</strong>ary period will be particularly important for certa<strong>in</strong> behavioural c<strong>on</strong>diti<strong>on</strong>s<br />
such as outpatient treatment or <strong>in</strong>structi<strong>on</strong>s from probati<strong>on</strong> and after-care services. 532<br />
C<strong>on</strong>diti<strong>on</strong>s for c<strong>on</strong>victi<strong>on</strong>s for child pornography<br />
In cases <strong>in</strong>volv<strong>in</strong>g child pornography, the <strong>in</strong>dividual may have been charged with the producti<strong>on</strong> of child<br />
abuse material or with hav<strong>in</strong>g committed sexual abuse. Besides treatment, the special c<strong>on</strong>diti<strong>on</strong> <strong>in</strong> the<br />
form of a c<strong>on</strong>tact ban or street ban can then be imposed, for example, with a probati<strong>on</strong>ary period which<br />
may last up to ten years. In case law <strong>in</strong>volv<strong>in</strong>g other sexual offences <strong>in</strong> additi<strong>on</strong> to act<strong>in</strong>g <strong>in</strong> breach of<br />
