report 33 and the fact that they have sought to collaborate <strong>on</strong> such a report dem<strong>on</strong>strates the relati<strong>on</strong>ship<br />

and a certa<strong>in</strong> overlap between the stated fields <strong>in</strong> which reports are produced, and the issue of violence<br />

aga<strong>in</strong>st children, <strong>in</strong>clud<strong>in</strong>g sexual violence. Some of these various areas of overlap will be discussed <strong>in</strong><br />

this report, and the comm<strong>on</strong> denom<strong>in</strong>ator is the protecti<strong>on</strong> of children from sexual violence.<br />

Structure of the report<br />

The aim of this <strong>in</strong>itial report is to provide some <strong>in</strong>sight <strong>in</strong>to the phenomen<strong>on</strong> of child pornography. The<br />

current state of affairs is also broadly analysed. The core theme with<strong>in</strong> the analysis is that the approach<br />

towards tackl<strong>in</strong>g child pornography is <strong>in</strong>extricably l<strong>in</strong>ked to the overall approach towards tackl<strong>in</strong>g sexual<br />

violence aga<strong>in</strong>st children, and must form part of this. At the present time, ample attenti<strong>on</strong> is already<br />

be<strong>in</strong>g paid to the structure of the policy <strong>on</strong> child pornography, specifically with regard to the repressive<br />

strategy. C<strong>on</strong>siderati<strong>on</strong>s are be<strong>in</strong>g made regard<strong>in</strong>g the most effective way of allocat<strong>in</strong>g the police capacity<br />

<strong>in</strong>volved <strong>in</strong> the programme of measures, at a central and regi<strong>on</strong>al level, as described <strong>in</strong> the secti<strong>on</strong> <strong>on</strong><br />

detecti<strong>on</strong> <strong>in</strong> Chapter 3. However, an effective programme c<strong>on</strong>sists of more than just repressive acti<strong>on</strong><br />

al<strong>on</strong>e. Bodies other than the police and the judicial authorities have resp<strong>on</strong>sibilities <strong>in</strong> this area, as well;<br />

these other bodies will also be discussed <strong>in</strong> the follow<strong>in</strong>g chapters.<br />

Chapter 1 ‘The phenomen<strong>on</strong> of child pornography’<br />

This chapter forms the resp<strong>on</strong>se to an extensive literature study, which enabled us to ga<strong>in</strong> an <strong>in</strong>sight<br />

<strong>in</strong>to the complexity of the phenomen<strong>on</strong>. In this regard, it is important to recognise that the subject<br />

c<strong>on</strong>cerned provokes a great many emoti<strong>on</strong>s <strong>in</strong> society, which can easily give rise to the formati<strong>on</strong> of<br />

an <strong>in</strong>complete or <strong>in</strong>accurate picture. It is precisely for this reas<strong>on</strong> that, for the sake of the efficacy of<br />

the policy, it is necessary to take the <strong>in</strong>formati<strong>on</strong> about the phenomen<strong>on</strong> that is currently available<br />

as a basis, as much as possible. In any case, that <strong>in</strong>formati<strong>on</strong> shows that this issue c<strong>on</strong>cerns an extraord<strong>in</strong>arily<br />

varied and multiform phenomen<strong>on</strong>. The legal c<strong>on</strong>text will be described, and the nature<br />

of the phenomen<strong>on</strong> will be <strong>in</strong>terpreted as a social phenomen<strong>on</strong> by <strong>in</strong>vestigat<strong>in</strong>g the various aspects<br />

<strong>in</strong> greater detail, namely perpetrators, victims and technology. Based up<strong>on</strong> the various ways <strong>in</strong> which<br />

<strong>in</strong>dividuals can be perpetrators and victims, comb<strong>in</strong>ed with the developments <strong>in</strong> the technological<br />

doma<strong>in</strong>, we clarify the actual forms that child pornography can take. We will also devote attenti<strong>on</strong> to<br />

the questi<strong>on</strong> of the extent of the phenomen<strong>on</strong>, a questi<strong>on</strong> that is important but that can hardly ever<br />

be answered. The number of perpetrators, the number of victims and the quantity of the material cannot<br />

be expressed <strong>in</strong> figures, although it is clear that the phenomen<strong>on</strong> of child pornography is grow<strong>in</strong>g<br />

exp<strong>on</strong>entially. Furthermore, we will provide an overview of the way <strong>in</strong> which the government’s visi<strong>on</strong><br />

and social attitudes with regard to the phenomen<strong>on</strong> have evolved from the end of the 1960s to the<br />

present day. The latter period of that timescale is characterised by the rapidly <strong>in</strong>creas<strong>in</strong>g importance of<br />

ICT. This report will describe the <strong>in</strong>fluence that this has had up<strong>on</strong> the capacity of be<strong>in</strong>g a perpetrator<br />

and the potential of becom<strong>in</strong>g victimized. The fact that is of key importance here is that the Internet<br />

has become a pre-em<strong>in</strong>ently facilitat<strong>in</strong>g medium for child abuse material and that at the same time an<br />

important questi<strong>on</strong> is raised, namely the extent to which ICT actually provides new opportunities to<br />

protect children from sexual violence.<br />
