The Amsterdam sexual abuse case surround<strong>in</strong>g Robert M. is a recent example of the abovementi<strong>on</strong>ed<br />

problem. In the Dutch newspaper ‘Trouw’, am<strong>on</strong>gst others, the lawyer of parents of a<br />

number of victims expla<strong>in</strong>ed that many parents regret hav<strong>in</strong>g reported the offences. Regardless<br />

of the cost, parents want to keep their children’s names out of the media and out of the case notes<br />

relat<strong>in</strong>g to crim<strong>in</strong>al proceed<strong>in</strong>gs, <strong>in</strong> order to ensure that this w<strong>on</strong>’t follow them around for the rest<br />

of their lives. 387 Although the Public Prosecuti<strong>on</strong> Service has recognised this problem, <strong>in</strong> practice<br />

it rema<strong>in</strong>s difficult to ensure that the images rema<strong>in</strong> an<strong>on</strong>ymous. In the first <strong>in</strong>stance, the Public<br />

Prosecuti<strong>on</strong> Service <strong>in</strong>dicated that it was worried that it would offend the victim’s parents if their<br />

child was reduced to a number. 388 However, <strong>in</strong> the end, the decisi<strong>on</strong> was made to give the images<br />

numbers, as an attempt to ma<strong>in</strong>ta<strong>in</strong> the an<strong>on</strong>ymity of victims <strong>in</strong> the crim<strong>in</strong>al proceed<strong>in</strong>gs.<br />

At the moment, however, there is no statutory or other provisi<strong>on</strong> to guarantee the complete an<strong>on</strong>ymity<br />

of victims <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs <strong>in</strong> situati<strong>on</strong>s such as this, and as such to protect the identity and<br />

pers<strong>on</strong>al details of victims. The way <strong>in</strong> which this can be achieved, without this be<strong>in</strong>g <strong>in</strong> c<strong>on</strong>flict with<br />

Article 6 of the European C<strong>on</strong>venti<strong>on</strong> of Human Rights, must be <strong>in</strong>vestigated. 389 Furthermore, parents<br />

or carers can face the dilemma of whether or not to tell the child c<strong>on</strong>cerned about what happened to<br />

them.<br />

Dur<strong>in</strong>g the substantive hear<strong>in</strong>g of the crim<strong>in</strong>al case, victims of serious crimes are able to make a statement<br />

regard<strong>in</strong>g the c<strong>on</strong>sequences that they have suffered as a result of the offences. In the Amsterdam<br />

sexual abuse case, discussi<strong>on</strong> arose as to whether parents of underage victims are able to exercise this<br />

right to speak <strong>on</strong> behalf of their children <strong>in</strong> the crim<strong>in</strong>al case. Exercis<strong>in</strong>g the right to speak depends <strong>on</strong><br />

the age of the victim. Only children over the age of twelve are able to exercise this right themselves, and<br />

children younger than twelve cannot make use of this right. 390 S<strong>in</strong>ce July 2011, the State Secretary for<br />

moti<strong>on</strong> for a directive c<strong>on</strong>cern<strong>in</strong>g m<strong>in</strong>imum standards for victims of crime, Proposal for a Directive of the<br />

European Parliament and of the Council establish<strong>in</strong>g m<strong>in</strong>imum standards <strong>on</strong> the rights, support and protecti<strong>on</strong> of victims<br />

of crime, COM (2011) 275 f<strong>in</strong>al to replace the current Framework Decisi<strong>on</strong>. This proposal <strong>in</strong>cludes a provisi<strong>on</strong><br />

regard<strong>in</strong>g the protecti<strong>on</strong> of privacy, whereby a best efforts obligati<strong>on</strong> is established <strong>in</strong> order to<br />

ensure that judicial authorities are able to take measures dur<strong>in</strong>g a hear<strong>in</strong>g to safeguard the privacy and<br />

images of victims and their families. In additi<strong>on</strong> to this, the Member States must encourage nati<strong>on</strong>al<br />

media to take self-regulatory measures, as a result of which they too will protect the privacy of victims<br />

and their families.<br />
