Community Service Order<br />

In the Public Prosecuti<strong>on</strong> Service Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g community service orders,<br />

suspects of child pornography are <strong>in</strong> any case excluded from a basic community service order. 422 The<br />

reference po<strong>in</strong>ts of the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> C<strong>on</strong>sultative Committee for the Chairmen of Crim<strong>in</strong>al Law Sectors<br />

are based <strong>on</strong> a community service order, but this is <strong>in</strong> additi<strong>on</strong> to a suspended custodial sentence of<br />

six m<strong>on</strong>ths, <strong>on</strong>ly <strong>in</strong> those cases which <strong>in</strong>volve the acquisiti<strong>on</strong> or possessi<strong>on</strong> of, or the ga<strong>in</strong><strong>in</strong>g of access<br />

to child abuse material. It does occur that basic community service orders are imposed for offences as<br />

referred to <strong>in</strong> Article 240 of the Dutch Crim<strong>in</strong>al Code (see §3.5.4.2).<br />

S<strong>in</strong>ce 2009, there has been discussi<strong>on</strong> surround<strong>in</strong>g a legislative proposal to limit the possibilities to<br />

impose a community service order for serious sexual abuse offences and violent offences and <strong>in</strong> the<br />

event of re-offend<strong>in</strong>g. 423 The legislative proposal beg<strong>in</strong>s by propos<strong>in</strong>g to make it no l<strong>on</strong>ger possible to<br />

impose a community service order <strong>in</strong> sentences <strong>on</strong> the basis of, <strong>in</strong>clud<strong>in</strong>g others, Article 240b of the<br />

Dutch Crim<strong>in</strong>al Code, unless <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with suspended or n<strong>on</strong>-suspended sentences or orders<br />

that <strong>in</strong>volve deprivati<strong>on</strong> of freedom. The choice of, am<strong>on</strong>gst other offences, child pornography was<br />

<strong>in</strong>spired by the desire to highlight the severity of this offence and to emphasise the importance of the<br />

protecti<strong>on</strong> that this stipulati<strong>on</strong> <strong>in</strong>tends to provide to m<strong>in</strong>ors. In sentences for Article 240b of the Dutch<br />

Crim<strong>in</strong>al Code, basic community service orders cannot be imposed, accord<strong>in</strong>g to the explanati<strong>on</strong>, 424<br />

regardless as to whether or not the offence resulted <strong>in</strong> a serious <strong>in</strong>fr<strong>in</strong>gement of the victim’s physical<br />

<strong>in</strong>tegrity.<br />

In November 2010, the M<strong>in</strong>ister for Security and Justice submitted a government amendment, which<br />

amended two parts of the legislative proposal. First of all, the court would no l<strong>on</strong>ger be able to impose a<br />

community service order <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with a (suspended or n<strong>on</strong>-suspended) sentence or orders that<br />

<strong>in</strong>volve deprivati<strong>on</strong> of freedom. Sec<strong>on</strong>dly, the discreti<strong>on</strong>ary capacity of the Public Prosecuti<strong>on</strong> Service <strong>in</strong><br />

the case of the enforcement of a (partly) failed community service order would disappear, so that <strong>in</strong> the<br />

future the Public Prosecuti<strong>on</strong> Service would be required to order the enforcement of alternative detenti<strong>on</strong><br />

for those cases. As stated, this government amendment proposes abolish<strong>in</strong>g the possibility of impos<strong>in</strong>g<br />

a community service order <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with a suspended or n<strong>on</strong>-suspended sentence or orders that<br />

<strong>in</strong>volve deprivati<strong>on</strong> of freedom for serious sexual abuse offences and violent offences and <strong>in</strong> the event of<br />

a custodial sentence is expressly c<strong>on</strong>sidered, possibly an entirely or partially suspended sentence,<br />

but not a basic community service order, “In any case, suspects of serious violent offences or sexual<br />

abuse offences – <strong>in</strong> which a custodial sentence of six or more years has been imposed and which<br />

<strong>in</strong>volve a serious <strong>in</strong>fr<strong>in</strong>gement of physical <strong>in</strong>tegrity – are excluded from a basic community service<br />

order. In these cases, the suspect should always be summ<strong>on</strong>ed.” In additi<strong>on</strong> to these violent offences<br />

or sexual abuse offences, those suspected of hav<strong>in</strong>g committed offences c<strong>on</strong>trary to Article<br />

240b of the Dutch Crim<strong>in</strong>al Code, am<strong>on</strong>gst others, which carry a sentence of less than six years,<br />

should also be excluded from a basic community service order. “Those suspects should also be<br />

summ<strong>on</strong>ed.”<br />
