offences refer to digital data storage media with<strong>in</strong> the c<strong>on</strong>text of an <strong>in</strong>formative <strong>in</strong>terview, no reference is<br />
made to seizure. 361 By emphasis<strong>in</strong>g the importance of seizure of data storage media <strong>in</strong> both the Implementati<strong>on</strong><br />
Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography and the Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g public decency<br />
offences, the efficacy of detecti<strong>on</strong> can be improved and the focus can actually be shifted to the abuse.<br />
Thirdly, more <strong>in</strong>formati<strong>on</strong> regard<strong>in</strong>g the efficacy of detecti<strong>on</strong> needs to be collected. For example, the<br />
number of victims that were found via the Internet is practically unknown. For that reas<strong>on</strong>, details of<br />
victims must be recorded. As a result, we will have greater <strong>in</strong>sight <strong>in</strong>to the efficacy of detecti<strong>on</strong>, which<br />
may have implicati<strong>on</strong>s for the policy to be implemented. 362<br />
Pend<strong>in</strong>g cases<br />
The current number of pend<strong>in</strong>g cases forms a burden for the police and the judicial authorities. The proposed<br />
new structure does not (yet) offer any <strong>in</strong>sight <strong>in</strong>to the way <strong>in</strong> which the pend<strong>in</strong>g cases could be<br />
worked through, except for the alternative means of settl<strong>in</strong>g cases. 363 No analysis of the nature of the pend<strong>in</strong>g<br />
cases is available and c<strong>on</strong>sequently it is almost impossible to draft a policy. The m<strong>in</strong>imal capacity available<br />
has also been designated as a cause for the pend<strong>in</strong>g cases. This is the issue, however, as the number of<br />
pend<strong>in</strong>g cases should <strong>in</strong>crease if 100 to 300 cases are received every year. This is not happen<strong>in</strong>g, though, as<br />
although the number of pend<strong>in</strong>g cases cannot be c<strong>on</strong>trolled, it is nevertheless relatively stable and even<br />
decreases now and then. An <strong>in</strong>vestigati<strong>on</strong> of the <strong>in</strong>flow and outflow of the pend<strong>in</strong>g cases could provide an<br />
<strong>in</strong>sight <strong>in</strong>to this situati<strong>on</strong>. The existence of pend<strong>in</strong>g cases may potentially be the result of the low priority<br />
that is assigned to child pornography cases, the work<strong>in</strong>g method be<strong>in</strong>g used, or the <strong>in</strong>flux of <strong>in</strong>vestigati<strong>on</strong>s<br />
from other countries. The assumpti<strong>on</strong> that a shortage <strong>in</strong> capacity forms the cause of the pend<strong>in</strong>g cases<br />
is partly unfounded. A potential soluti<strong>on</strong> could be to develop an <strong>in</strong>ternati<strong>on</strong>al prioritisati<strong>on</strong> model. To<br />
this end, the possibilities for mak<strong>in</strong>g <strong>in</strong>ternati<strong>on</strong>al agreements <strong>in</strong> this regard could be explored further.<br />
3.5 Prosecuti<strong>on</strong> and trial<br />
In this secti<strong>on</strong>, we will firstly discuss the prosecuti<strong>on</strong> of child pornography offences, and the subsequent<br />
trials. Sentences and orders are the subject of §3.5.3, whereby we must take <strong>in</strong>to account that <strong>in</strong> terms<br />
of the sentence carried, Article 240b of the Dutch Crim<strong>in</strong>al Code does not dist<strong>in</strong>guish between different<br />
forms of c<strong>on</strong>duct, such as the possessi<strong>on</strong>, distributi<strong>on</strong> or producti<strong>on</strong> of child pornography. A separate<br />
secti<strong>on</strong> is then devoted to statistics regard<strong>in</strong>g prosecuti<strong>on</strong>s, decisi<strong>on</strong>s not to prosecute, sentences and<br />
c<strong>on</strong>victi<strong>on</strong>s. In additi<strong>on</strong> to this, we will also address the characteristics of suspects and c<strong>on</strong>victed perpetrators.<br />
F<strong>in</strong>ally, this secti<strong>on</strong> will set out a number of trends that can be ascerta<strong>in</strong>ed from the statistics.<br />
3.5.1 Prosecuti<strong>on</strong><br />
For the detecti<strong>on</strong> and prosecuti<strong>on</strong> of child pornography offences, the Implementati<strong>on</strong> Provisi<strong>on</strong>s<br />
c<strong>on</strong>cern<strong>in</strong>g child pornography govern all acti<strong>on</strong>s undertaken by the police and the Public Prosecuti<strong>on</strong><br />
