4.2.3 Implementati<strong>on</strong><br />

C<strong>on</strong>clusi<strong>on</strong>s and recommendati<strong>on</strong>s<br />

4.2.3.1 General<br />

On a practical level, the complexity of the phenomen<strong>on</strong> of child pornography, and the variety of forms<br />

that it is able to take, present c<strong>on</strong>siderable challenges for the implementati<strong>on</strong> of measures for the preventi<strong>on</strong><br />

and combat<strong>in</strong>g of child pornography. This report set out to exam<strong>in</strong>e the status of the issue <strong>in</strong><br />

terms of the c<strong>on</strong>stituent processes that can be dist<strong>in</strong>guished from <strong>on</strong>e another <strong>in</strong> this c<strong>on</strong>necti<strong>on</strong>. These<br />

processes <strong>in</strong>clude preventi<strong>on</strong>, registrati<strong>on</strong> and identificati<strong>on</strong>, detecti<strong>on</strong>, prosecuti<strong>on</strong> and trial, aftercare<br />

and supervisi<strong>on</strong> of offenders, and the provisi<strong>on</strong> of assistance to victims. The ways <strong>in</strong> which these<br />

processes are implemented have been <strong>in</strong>vestigated and analysed, encompass<strong>in</strong>g various programmes<br />

that are underway and are directed towards perpetrators and victims of domestic violence, child abuse,<br />

sexual health and sexual violence. From this analysis it has emerged that <strong>in</strong> practice, little attenti<strong>on</strong> is<br />

devoted to aspects related specifically to child pornography, such as digital forms of sexual violence<br />

aga<strong>in</strong>st children and the <strong>in</strong>ter-relatedness of the <strong>on</strong>l<strong>in</strong>e and offl<strong>in</strong>e worlds of offenders and victims. The<br />

situati<strong>on</strong> with regard to the repressive implementati<strong>on</strong> processes, such as detecti<strong>on</strong>, prosecuti<strong>on</strong> and<br />

trial and probati<strong>on</strong> and after-care, <strong>in</strong> which Article 240b of the Dutch Crim<strong>in</strong>al Code is, of course, the<br />

guid<strong>in</strong>g pr<strong>in</strong>ciple for the actors, is a different <strong>on</strong>e. However, even <strong>in</strong> these processes, the c<strong>on</strong>necti<strong>on</strong><br />

between <strong>on</strong>l<strong>in</strong>e and offl<strong>in</strong>e sexual violence can sometimes be <strong>in</strong>complete.<br />

As child pornography takes place with<strong>in</strong> the wider c<strong>on</strong>text of sexual violence aga<strong>in</strong>st children, and due<br />

to the fact that the practical implementati<strong>on</strong> of the relevant approach is, <strong>in</strong> many cases, not specifically<br />

directed towards child pornography, a c<strong>on</strong>siderable part of this process <strong>in</strong>volves the implementati<strong>on</strong> of<br />

programmes aga<strong>in</strong>st sexual violence, with no specific c<strong>on</strong>text that relates to child pornography.<br />

For <strong>in</strong>terventi<strong>on</strong>s <strong>in</strong> the digital doma<strong>in</strong>, the government is, <strong>in</strong> part, dependent <strong>on</strong> collaborati<strong>on</strong>s with<br />

private parties. Bear<strong>in</strong>g this is m<strong>in</strong>d, the extent to which public-private sector partnerships have been<br />

tak<strong>in</strong>g shape has been <strong>in</strong>vestigated.<br />

F<strong>in</strong>ally, the <strong>in</strong>vestigati<strong>on</strong> also focused <strong>on</strong> the extent to which c<strong>on</strong>necti<strong>on</strong>s have been formed between<br />

and with<strong>in</strong> the processes where this is necessary, and <strong>on</strong> the issue of whether or not l<strong>in</strong>ks exist between<br />

policy and implementati<strong>on</strong>, with which policy can be translated <strong>in</strong>to practice and vice versa. Many of<br />

the problem areas found <strong>in</strong> the processes of implementati<strong>on</strong> seem to be related to the complexity of the<br />

phenomen<strong>on</strong> and the fragmentati<strong>on</strong> <strong>in</strong> terms of policy.<br />

4.2.3.2 Preventi<strong>on</strong><br />

The preventi<strong>on</strong> of child pornography is evidently closely related to the preventi<strong>on</strong> of sexual abuse of<br />

children. After all, material c<strong>on</strong>stitut<strong>in</strong>g child pornography cannot (usually) be produced without the<br />

sexual abuse of children hav<strong>in</strong>g taken place. Potential perpetrators and victims therefore would appear<br />

to form the most obvious target groups of measures designed to prevent the sexual abuse of children.<br />

However, as the sexual abuse of children takes place with<strong>in</strong>, and is <strong>in</strong>fluenced by, specific situati<strong>on</strong>al and<br />

social c<strong>on</strong>texts, am<strong>on</strong>gst other th<strong>in</strong>gs, the literature takes a broader approach as a basis for the preventi<strong>on</strong><br />

of sexual abuse of children. This approach gives rise to four target groups for the implementati<strong>on</strong><br />

of preventative measures: perpetrators, victims, situati<strong>on</strong>s and communities. Primary preventi<strong>on</strong> aims<br />

to prevent <strong>in</strong>dividuals from becom<strong>in</strong>g perpetrators or victims by means of general provisi<strong>on</strong> of <strong>in</strong>formati<strong>on</strong>,<br />

and the rais<strong>in</strong>g of awareness am<strong>on</strong>g these target groups as a whole. This type of preventive<br />

measure is geared towards each of the four target groups as a whole. By c<strong>on</strong>trast, sec<strong>on</strong>dary preventi<strong>on</strong> is<br />
