effective detecti<strong>on</strong> <strong>on</strong> the Internet, particularly the ability to record c<strong>on</strong>fidential communicati<strong>on</strong> us<strong>in</strong>g<br />

a technical device <strong>in</strong> a home (Article 126l, paragraph 2 of the Dutch Code of Crim<strong>in</strong>al Procedure). 160 To<br />

this end, the potential offence must carry a sentence of at least eight years. The powers thus deployed<br />

<strong>in</strong> detecti<strong>on</strong> may, for example, take the form of fitt<strong>in</strong>g a device to a suspect’s computer <strong>in</strong> order to trace<br />

his/her communicati<strong>on</strong>s with others. By <strong>in</strong>creas<strong>in</strong>g the sentenc<strong>in</strong>g term <strong>in</strong> this way, the legislator’s aim<br />

was also to c<strong>on</strong>vey that the systematic producti<strong>on</strong>, distributi<strong>on</strong> and possessi<strong>on</strong> of child abuse material<br />

are regarded as serious crim<strong>in</strong>al offences. It should be noted <strong>in</strong> this regard that the amendment did not<br />

arise out of a necessity that emerged <strong>in</strong> legal practice to <strong>in</strong>tr<strong>in</strong>sically re-evaluate the maximum sentence<br />

carried by child pornography offences. Furthermore, the recent evaluati<strong>on</strong> of decency legislati<strong>on</strong> has<br />

c<strong>on</strong>firmed this. 161 In the view of the legislator, the crim<strong>in</strong>al court has sufficient means to impose a sentence<br />

that is appropriate <strong>in</strong> the case <strong>in</strong> questi<strong>on</strong>.<br />

A number of amendments were made to legislati<strong>on</strong> as a result of the ratificati<strong>on</strong> of the Lanzarote<br />

C<strong>on</strong>venti<strong>on</strong>, 162 <strong>in</strong>clud<strong>in</strong>g amendments <strong>in</strong> relati<strong>on</strong> to the penal provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography.<br />

S<strong>in</strong>ce January 2010, Article 240b of the Dutch Crim<strong>in</strong>al Code also crim<strong>in</strong>alises the obta<strong>in</strong><strong>in</strong>g of access to<br />

child abuse material by means of <strong>in</strong>formati<strong>on</strong> and communicati<strong>on</strong> technology. 163 This tighten<strong>in</strong>g of legislati<strong>on</strong><br />

was deemed desirable, as the questi<strong>on</strong> arose as to whether acti<strong>on</strong> could be taken <strong>on</strong> the grounds<br />

of crim<strong>in</strong>al possessi<strong>on</strong> <strong>in</strong> all cases. It is now also possible to prosecute viewers <strong>in</strong> cases where it cannot be<br />

proven that they <strong>in</strong>tenti<strong>on</strong>ally downloaded child abuse material to the temporary Internet files folder <strong>on</strong><br />

the hard drive, 164 for example, but it can be proven that they obta<strong>in</strong>ed access with (c<strong>on</strong>diti<strong>on</strong>al) <strong>in</strong>tent<br />

to websites featur<strong>in</strong>g child abuse material, whether <strong>in</strong> the form of images, hyperl<strong>in</strong>ks or live webcam<br />

streams. 165 The amendments to crim<strong>in</strong>al provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography <strong>in</strong> Article 240b of<br />

the Dutch Crim<strong>in</strong>al Code are partly the result of new technologies that have enabled those methods of<br />

producti<strong>on</strong> and distributi<strong>on</strong> (see §1.2.3 and §1.4.1.2). The offer<strong>in</strong>g and acquisiti<strong>on</strong> of child abuse material<br />

also became crim<strong>in</strong>al offences with<strong>in</strong> the scope of the same legislative amendments.<br />

Current def<strong>in</strong>iti<strong>on</strong> under crim<strong>in</strong>al law<br />

Article 240b of the Dutch Crim<strong>in</strong>al Code c<strong>on</strong>ta<strong>in</strong>s provisi<strong>on</strong>s that crim<strong>in</strong>alise a variety of acts that relate<br />

to child pornography, though the word ‘child pornography’ does not appear as such <strong>in</strong> the Dutch<br />

Crim<strong>in</strong>al Code. The number of crim<strong>in</strong>al acts listed under Article 240b of the Dutch Crim<strong>in</strong>al Code has<br />

expanded c<strong>on</strong>siderably over the past few decades. As we have already seen <strong>in</strong> previous secti<strong>on</strong>s, developments<br />

<strong>in</strong> both the doma<strong>in</strong> of technology and <strong>in</strong> <strong>in</strong>ternati<strong>on</strong>al agreements have formed the basis for<br />

the amendments to the provisi<strong>on</strong>. Over a period of 16 years, the sentence carried by child pornography<br />

offences has been <strong>in</strong>creased from three m<strong>on</strong>ths’ impris<strong>on</strong>ment to (<strong>in</strong> pr<strong>in</strong>ciple) a maximum of eight<br />
