occur. 375 In additi<strong>on</strong> to this, the Public Prosecuti<strong>on</strong> Service also has the opportunity to postp<strong>on</strong>e the<br />

decisi<strong>on</strong> as to whether prosecuti<strong>on</strong> will have to take place, for a certa<strong>in</strong> amount of time, subject to<br />

a number of set c<strong>on</strong>diti<strong>on</strong>s: a c<strong>on</strong>diti<strong>on</strong>al decisi<strong>on</strong> not to prosecute. This route of c<strong>on</strong>diti<strong>on</strong>ally not<br />

prosecut<strong>in</strong>g also provides the Public Prosecuti<strong>on</strong> Service with opportunities to settle cases. The <str<strong>on</strong>g>Child</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Pornography</str<strong>on</strong>g> Expertise Centre is therefore seek<strong>in</strong>g new methods of deal<strong>in</strong>g with as many cases as possible<br />

by means of the Niets Doen Is Geen Optie (INDIGO) [Do<strong>in</strong>g Noth<strong>in</strong>g is not an Opti<strong>on</strong>] <strong>in</strong>itiative. 376 The<br />

<strong>in</strong>tenti<strong>on</strong> beh<strong>in</strong>d this is to allow sufficient time and attenti<strong>on</strong> for complex and serious cases, without<br />

allow<strong>in</strong>g suspects of relatively light cases to end up receiv<strong>in</strong>g m<strong>in</strong>imal attenti<strong>on</strong>. For these cases, which<br />

<strong>in</strong>volve the possessi<strong>on</strong> of and the ga<strong>in</strong><strong>in</strong>g of access to child abuse material, alternatives to prosecuti<strong>on</strong><br />

are then sought. 377 The project such as the <strong>on</strong>e tak<strong>in</strong>g place <strong>in</strong> Rotterdam still needs to be evaluated.<br />

Al<strong>on</strong>gside this, a barrier model is currently be<strong>in</strong>g developed <strong>in</strong> order to be able to <strong>in</strong>tervene at the<br />

‘fr<strong>on</strong>t-end’ of the problem and thus to prevent possible child pornography offences. 378 (See §3.8.4).<br />

A plan for the Public Prosecuti<strong>on</strong> Service with regard to combat<strong>in</strong>g child pornography is expected to<br />

be established after the summer, partly <strong>in</strong> light of recent police developments (see §3.4.4). The Public<br />

Prosecuti<strong>on</strong> Service, the M<strong>in</strong>istry of Security and Justice, the police and other partners <strong>in</strong> the cha<strong>in</strong> have<br />

expressed the <strong>in</strong>tenti<strong>on</strong> to <strong>in</strong>crease the effectiveness of their efforts to combat child pornography. For<br />

this purpose, jo<strong>in</strong>t frameworks for a new plan of acti<strong>on</strong> have been formulated. This will have c<strong>on</strong>sequences<br />

for the police with regard to its structure, and it will <strong>in</strong> any case have c<strong>on</strong>sequences for the Public<br />

Prosecuti<strong>on</strong> Service with regard to the way <strong>in</strong> which operati<strong>on</strong>, prioritisati<strong>on</strong> and prosecuti<strong>on</strong> of child<br />

pornography cases are implemented. Whilst ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the role and resp<strong>on</strong>sibility of each party, the<br />

Public Prosecuti<strong>on</strong> Service and police both formulate a plan of acti<strong>on</strong>, aimed at achiev<strong>in</strong>g uniformity,<br />

us<strong>in</strong>g different forms of settlement, pool<strong>in</strong>g the knowledge held by the police and Public Prosecuti<strong>on</strong><br />

Service <strong>in</strong> a jo<strong>in</strong>t expertise centre, and <strong>in</strong>vest<strong>in</strong>g <strong>in</strong> <strong>in</strong>novati<strong>on</strong> and research. The implementati<strong>on</strong> of this<br />

plan is tak<strong>in</strong>g place <strong>in</strong> close collaborati<strong>on</strong> with the partners <strong>in</strong> the cha<strong>in</strong>. The plan of acti<strong>on</strong> for the Public<br />

Prosecuti<strong>on</strong> Service is expected to be completed after the summer of 2011. 379<br />

3.5.2 Trial<br />

Each year, between 250 and 300 crim<strong>in</strong>al cases are settled at court, <strong>in</strong> which cases charges are made <strong>on</strong><br />

the basis of Article 240b of the Dutch Crim<strong>in</strong>al Code, some of which occur al<strong>on</strong>gside other offences. 380<br />

In pr<strong>in</strong>cipal, child pornography cases are <strong>in</strong> the first <strong>in</strong>stance settled by all courts. In 2009, the Cybercrime<br />

Centre of Excellence was set up at the Court of Appeal <strong>in</strong> The Hague, which not <strong>on</strong>ly ma<strong>in</strong>ta<strong>in</strong>s<br />
